Roadt, and Tracy Stefanski Tuesday, November 24, 2020 6:00 PM City Hall, Common Council Chambers 7525 W. Greenfield Ave. REGULAR MEETING - HEARING A. CALL TO ORDER The meeting was called to order by Chair Vitale at 6:00 p.m. B. ROLL CALL Present 5- Vitale, Grisham, Reinke, Roadt, and Stefanski Others present: Satwinder Singh, Nicole J. Nowak, Matthew D. Brzezinski, Samantha M. Liban, Atty. Brad Dagen, David Zarate, Henry Bruno, and Patricia Zarate, Nicholas Cerwin, Assistant City Attorney, Rebecca Hammock, Assistant City Attorney, and Ann Marie Neff, Secretary to the Committee. C. APPROVAL OF MINUTES 1. 2020-0433 Minutes (draft) of the License & Health Committee special meeting of October 24, 2020, recess meetings of November 4, 2020 and November 17, 2020 A motion was made by Roadt, seconded by Grisham, that this matter be Approved. The motion carried unanimously. D. NEW AND PREVIOUS MATTERS 2. 2020-0756 2020-2021 Class C Wine License application of Milwaukee Banquet LLC, Satwinder Singh, Agent, d/b/a Wini’s Kitchen for premises located at 10535 W. Greenfield Ave. (new-nonexisting location) Appearance by Satwinder Singh. Discussion ensued regarding the plan of operation, doors and the floor plan. Mr. Singh stated he would update and resubmit those items for the December 1, 2020 Common Council meeting. This matter was Held. 3. 2020-0757 2020-2021 Class B Beer License application of Milwaukee Banquet LLC, Satwinder Singh, Agent, d/b/a Wini’s Kitchen for premises located at 10535 W. Greenfield Ave. (new-nonexisting location) See legislative file number 2020-0756. This matter was Held. 4. 2020-0565 2020-2022 Food Peddler Permit application of Isaac Meyo Xique Nonappearance of Isaac Meyo Xique. Isaac did not respond to the letter mailed to him to allow him an appearance before the License & Health Committee to appeal the City of West Allis Page 1 Printed on 1/11/2021 License and Health Committee Meeting Minutes November 24, 2020 Committee's recommendation for denial. A motion was made by Grisham, seconded by Reinke, that this matter be Recommended for Denial based on the record being substantially related to the licensed activity and the applicant's failure to provide competent evidence of rehabilitation. The motion carried unanimously. 5. 2020-0704 2020-2022 Operator’s License (bartender/sales clerk) application of Nicole J. Nowak Appearance by Nicole J. Nowak. A motion was made by Grisham, seconded by Reinke, that this matter be Recommended For Approval. The motion carried unanimously. 6. 2020-0611 2020-2022 Operator’s License (bartender/sales clerk) application of Matthew D. Brzezinski Appearance by Matthew D. Brzezinski. A motion was made by Grisham, seconded by Reinke, that this matter be Recommended For Approval. The motion carried unanimously. 7. 2020-0670 2020-2022 Operator’s License (bartender/sales clerk) application of Samantha M. Liban Appearance by Samantha M. Liban. A motion was made by Reinke, seconded by Stefanski, that this matter be Recommended For Approval. The motion carried unanimously. 8. 2020-0606 2020-2022 Operator’s License (bartender/sales clerk) application of Rebecca L. Reyes Nonappearance of Rebecca L. Reyes. Rebecca did not respond to the letter mailed to her to allow her an appearance before the License & Health Committee to appeal the Committee's recommendation for denial. A motion was made by Grisham, seconded by Reinke, that this matter be Recommended for Denial based on the record being substantially related to the licensed activity and the applicant's failure to provide competent evidence of rehabilitation. The motion carried unanimously. 9. 2020-0701 2020-2022 Operator’s License (bartender/sales clerk) application of Erica J. Schluenz Nonappearance of Erica J. Schluenz. Erica did not respond to the letter mailed to her to allow her an appearance before the License & Health Committee to appeal the Committee's recommendation for denial. A motion was made by Stefanski, seconded by Grisham, that this matter be Recommended for Denial based on the record being substantially related to the licensed activity and the applicant's failure to provide competent evidence of rehabilitation. The motion carried unanimously. City of West Allis Page 2 Printed on 1/11/2021 License and Health Committee Meeting Minutes November 24, 2020 10. 2020-0706 Review of license applicant background checks for consideration of possible approval or denial License & Health Committee recommended approval of the following applicant's for the next Common Council meeting. 2020-2022 Operator (bartender/sales clerk) License applications: Padilla, Yaritza Vallejo, Tanya A. 2020-2021 Food Peddler Permit application. Molina, Vanessa A motion was made by Grisham, seconded by Stefanski, that this matter be Recommended For Approval. The motion carried unanimously. E. HEARING Appearance by Atty. Brad Dagen, David Zarate, Henry Bruno, and Patricia Zarate. A Hearing was not held. Assistant City Attorney presented a stipulation agreed upon by Atty. Dagen and Mr. Zarate. Additional questions were answered. F. CLOSED SESSION At 7:30 p.m. a motion was made by Steffanski, seconded by Reinke, to convene in closed session. The motion carried unanimously. Upon conclusion of the closed session at 7:55 p.m., the License and Health Committee reconvened in open session. 11. 2020-0536 Summons and Complaint in the matter of the complaint against Z’s Bar, LLC, David Zarate, Agent, for the premises located at 6309 W. National Ave., d/b/a Z’s Bar (2020-2021 Class B Tavern License No. 2256) The License & Health Committee Recommended approval of the signed stipulation for a three (3) day closure to be approved at the December 1, 2020 Common Council meeting, and that the Summons and Complaint be Placed on File. A motion was made by Stefanski, seconded by Grisham, that this matter be Recommended to be Placed on File. The motion carried unanimously. G. In order for the general public to make comments at the committee meetings, the individual(s) must be scheduled (as an appearance) with the chair of the committee or the appropriate staff contact; otherwise, the meeting of the committee is a working session for the committee itself, and discussion by those in attendance is limited to committee members, the mayor, other alderpersons, staff and others that may be a party to the matter being discussed. E. HEARING 11. 2020-0536 Summons and Complaint in the matter of the complaint against Z’s Bar, LLC, David Zarate, Agent, for the premises located at 6309 W. National Ave., d/b/a Z’s Bar (2020-2021 Class B Tavern License No. 2256) F. CLOSED SESSION For agenda file number 2020-0536, the committee may convene in closed session pursuant to the provisions of WI State Statutes Sections 19.85(1)(a) and (g) for the purpose of deliberating concerning a case which was the subject of any quasi-judicial hearing and conferring with the city attorney who will render oral or written advice concerning strategy to be adopted with respect to litigation in which the city is or is likely to become involved. This committee may reconvene in open session after completion of the closed session to consider the balance of the agenda. G.
