WEST BOUNTIFUL CITY RESOLUTION #558-24 A RESOLUTION CONSENTING TO THE APPOINTMENT OF HAVEN DICKSON AS YOUTH CITY COUNCIL ADVISOR WHEREAS, the West Bountiful City Council established the West Bountiful Youth City Council by adoption of Ordinance #403-18; and, WHEREAS, pursuant to the above referenced Ordinance, the Mayor, with the advice and consent of the City Council, shall appoint youth advisors to assist with activities of the Youth City Council. NOW THEREFORE, BE IT RESOLVED by the City Council of West Bountiful City that it consents to the Mayor’s appointment of Haven Dickson as Youth City Council Advisor with a term ending December 31, 2027. EFFECTIVE DATE. This resolution shall take effect immediately upon passing. Background State code requires that cities create a SAP for areas within a 0.5 mile radius around fixed transit stations. The stated objected of these plans are for: “1. increasing the availability and affordability of housing, including moderate income housing; 2. promoting sustainable environmental conditions; 3. enhancing access to opportunities; and 4. increasing transportation choices and connections.” From the Woods Cross Frontrunner station, the 0.5 mile radius extends into portions of West Bountiful, thus making a SAP required for the area. Based on this, the city adopted the creation of a SAP as one of its three moderate income housing goals within the General Plan. The city applied to Wasatch Front Regional Council (WFRC) for funding to create a SAP, and was awarded. After consultation with the Community and Economic Development Director at WFRC, staff concurred that before a full SAP was created, a feasibility study would be prudent based on the existing land uses and conditions in the area. The state law contains provisions for declaring the creation of a SAP to be impracticable if conditions exist that “make opportunities for new development and long-term redevelopment infeasible…”. Feasibility Study Upon consultation with the city, WFRC commission land use consultants to perform the attached feasibility study. The study clearly demonstrates that a SAP would be impracticable based primarily on the existence of the HF Sinclair refinery. It is important to note that the city communicated directly with the refinery, and representatives from HF Sinclair confirmed that they did not see the need for or value of a SAP. Staff recommends the adoption of the attached resolution. Similar to the city’s other moderate income housing goals, staff expects the process to begin of selecting new goals. 550 North 800 West, West Bountiful, UT 84087 (801) 292-4486 WEST BOUNTIFUL CITY RESOLUTION #559-24 A RESOLUTION FINDING THAT A STATION AREA PLAN FOR WOODS CROSS FRONTRUNNER STATION IS IMPRACTICABLE FOR AREA WITHIN WEST BOUNTIFUL CITY WHEREAS, Utah Code Section 10-9a-403.1, requires that any city within a half mile of an existing or future fixed guideway public transit station review and approve a Station Area Plan; and, WHEREAS, the Station Area Plan requirement of the Utah Code Section 10-9a-403.1 also provides for consideration of the existing conditions near a Station and whether those existing conditions make a Station Area Plan impracticable; and, WHEREAS, West Bountiful City and the Wasatch Front Region Council performed a study known as the “West Bountiful City Feasibility Study for a Potential Station Area Plan” (Exhibit A); and, WHEREAS, based on this study, the City Council of West Bountiful City finds that the four major objectives of Station Area Plans cannot be met and are impracticable due to the existing land uses. NOW THEREFORE, BE IT RESOLVED by the City Council of West Bountiful City that: Section 1. Adoption. The City Council hereby approves this Resolution based on the findings of the study, shown as Exhibit 1. Such findings being that a Station Area Plan in West Bountiful City is clearly unable to meet the State’s prescribed goals and is therefore impracticable. This Resolution and study shall be forwarded to the Wasatch Front Regional Council. Section 2. Severability. If any section, clause or portion of this Resolution is declared invalid by a court of competent jurisdiction, the remainder shall not be affected thereby and shall remain in full force and effect. Section 3. Effective date. This Resolution shall become effective immediately upon passage. Background The existing playground equipment on the south side of the park was purchased and installed in 1988, made possible by a donation by a family in the name of Brandon McCulley, a boy killed in a plane crash that same year (see page 422 of West Bountiful – A Pictorial History). This playground has served the community well for 36 years, and has reached the end of its life. Section of New Equipment In finding options for new equipment, staff used the following principles: 1. With the installation of larger playground equipment in the center of the park, this playground area is ideally suited for smaller children. 2. The curbing around the playground will be replaced with sidewalk on the circumference, as well as a new walkway to the parking lot and the volleyball courts. This will allow the shape of the area to modified if the city so chooses. 3. If practical, it is beneficial to have the equipment serviced by the same vendor that services the larger playground. Based on these principles, staff worked with Big T Recreation – the same vendor selected for the larger playground. This vendor has a state contract, which in part means that procurement policies do not require the purchase to be competitively bid; however, staff did solicit proposals from another vendor for comparisons. After an initial review, staff confirmed the value of using the same vendor, and worked to refine options. Staff recommends that the council select from one of the following; however, the council is free to request any necessary changes or ask staff to come back with completely different proposals. 550 North 800 West, West Bountiful, UT 84087 (801) 292-4486 Option 1: New Playground with Shade Canopies. $186,557.80 Attached you will find a layout and images of this new equipment, which in includes a new platform structure with slides, adjacent climbing toys, a carousel, and swings Option 2: New Playground with no shade. $171,566.77 This option varies only by the removal of the shade canopies. Color Scheme: The city can select basically whatever colors it wants. Options presented include a Purple/Green scheme (bright); Dark red and green (earthy tones); and a Blue/Beige scheme. The city could also try to match the scheme on the larger playground. Installation If the council chooses an option soon, the staff will work to demolish the existing site, procure a contractor for the new concrete, and get the installation scheduled for this fall. 550 North 800 West, West Bountiful, UT 84087 (801) 292-4486 MEMORANDUM TO: Mayor & Council DATE: July 11, 2024 FROM: Duane Huffman RE: Road Maintenance Projects __________________________________________________________________________ The memo introduces staff’s proposal for road maintenance work for this summer season for council’s approval. Background The life of an asphalt road can be significantly lengthened if treated to protect it from damages associated with water infiltration and the oil drying out. With this in mind, the city has proactively treated its “good” roads to preserve them, and sought out options for older roads that include full re-builds (such as planned for 660 W) or other aggressive treatments such as mill/overlays (as planned for 1200 N). For FY 25, the city budget included $100,000 for general seal coats or associated work, as well as $25,000 for general patching repairs. FY 25 Proposal • Holbrook Asphalt: $75,731.06 for high density mineral bond seal (seal coat). On the attached map, this work is shown in RED. Warranty work on previous seal coats is shown in ORANGE, and will be at no cost to the city. • Anderson Asphalt: $43,000 for slurry seal, mastic seal, and AP4 seal coat. This work is shown in GREEN and BLUE. At Tuesday’s council meeting, public works and engineering will briefly review the differences in the types of preservation work and why they are recommended for the specific roads. 550 North 800 West, West Bountiful, UT 84087 (801) 292-4486 MEMORANDUM TO: Mayor and City Council DATE: 7-12-24 FROM: Duane Huffman RE: Expenditure Approvals _______________________________________________________________________________ The city’s procurement code requires that certain expenditures of $10,000 or more first be approved by the city council. Approval is requested for the following: 1. Police Video Server - $18,530 This year’s budget includes $18,500 for a new server to handle the dash camera and body camera system for the police department. The old server is no longer compatible with the camera system and cannot receive new updates. Additionally, the new server system will streamline the time- consuming redaction process. Quote attached. 2. Police Video Server - $25,520 This year’s budget includes $16,000 for a statistical reporting system compatible with our new records management system (the change from Fatpot to Spillman). The system is necessary to track officer productivity and generate reports on policing activities throughout the city. The initial quote has since increased to $25,520; however, the city will now also receive a state grant to cover $13,000, for a net remaining cost of $12,520. Quote attached. 3. Golf Course Spray Rig - $57,875 This year’s budget includes $57,900 for a spray rig for the golf course. This equipment is used to spray fertilizer, wetting agents, and pesticides on the course’s greens, fairways, and tee boxes. This will replace an old rig, and the city may be able to recover some value through auction, though that is not currently factored as revenue we are counting on. Quote attached. 4. Golf Course Top Dresser - $22,495 The FY 24 budget (last year’s) included $22,500 for a top dresser. This equipment spreads sand that is important for maintaining greens and creating level playing areas. The course ordered this equipment over a year ago, but due to manufacturing delays we still haven’t received the equipment. The latest update is that it will be available within the next month. A budget amendment will be necessary to move the funds from FY 24 to FY 25. Ordinance 491-24 – An Ordinance Amending Title 17.52 of West Bountiful Municipal 109 Code Related to off Street Parking. 110 111 Addison presented the proposed ordinance. It is meant to accomplish one of the city’s 112 moderate income housing goals. He shared two different drafts of the ordinance, one that was 113 recommended by the planning commission and the other modified after additional work by 114 city staff. Steve Doxey explained that the two drafts were very similar, with the staff changes 115 mostly making needed clarifications – though staff does recommend a larger the reduction in 116 required parking spaces. Under the section 17.52.030(K)(4)(b) related to housing near 117 enhanced transit service areas, the planning commission had recommended up to a 15% 118 reduction in required parking while the staff draft recommended up to a 20% reduction. 119 Duane explained that the intent behind the reduction change is to demonstrate to the state that 120 the city is attempting to accommodate moderate income housing. Council member Nielsen 121 asked about not having a parking space for every unit. Duane explained that the idea behind 122 this is that is some cases the developments will be designed so that the tenants will be using 123 public transit. 124 125 126 MOTION: Dell Butterfield made a motion to adopt the staff draft of Ordinance 491-24 127 – An Ordinance Amending Title 17.52 of West Bountiful Municipal Code 128 Related to off Street Parking, 17.52.030(K)(4)(b). Discussion on Design Updates for 1200 N Project and 1100 W Project. 137 138 Improvement options for 1200 N were discussed. Instead of doing a total road replacement, 139 the intent is to mill and overlay existing asphalt while also adding new asphalt to create a 140 wider pavement section. Staff presented an option that would use extra asphalt width as a 141 bicycle/pedestrian path protected by concrete separators and delineators. This would create a WEST BOUNTIFUL Page 4 of 7 CITY COUNCIL MEETING June 18, 2024 142 cost-effective separated path, that would also be flexible to changes in the future. Council 143 asked that the project be bid with this as an option for a future decision. 144 145 The sidewalk project on 1100 W between 200 N and 400 Nwas then discussed. The two 146 options were a 6ft sidewalk with no park strip or the standard 4ft sidewalk with a 4ft park 147 strip. The location of trees and power poles were discussed. The council members discussed 148 how a 6ft sidewalk would create a smaller impact on some existing yards. Many council 149 members expressed their opinion that they would rather see a 6ft sidewalk. Staff said they 150 would design the project with a 6ft sidewalk. 151 152 153 9. Resolution 555-24 – A Resolution Enacting an Amendment to the Fiscal Year 2023-2024 154 Budget. 155 156 Duane explained that no changes had been made since the last city council meeting where it 157 was discussed. 158 159 160 MOTION: Kelly Enquist made a motion to adopt Resolution 555-24 – A Resolution 161 Enacting an Amendment to the Fiscal Year 2023-2024 Budget. He 173 explained that North Salt Lake had requested funding to offset the higher court costs, with 174 $10,000 added to the expenditures. 175 176 177 MOTION: Jenn Nielsen made a motion to adopt Resolution 556 – A Resolution 178 Adopting the West Bountiful City Budget and Property Tax Rate for the 179 Fiscal Year 2024-2025 with the years corrected and the certified property 180 tax rate.
