MAY 18, 2022 8259 Magistrate Olasz swore in Police Officers Emma Brown and Dante DiBeradin. COUNCIL OF THE BOROUGH OF WEST MIFFLIN met in regular session in the Municipal Building Council Chambers on May 18, 2022 at 6:33 p.m. prevailing time with President Scott Stephenson presiding. ROLL CALL: Topolnak Present Davis Present Santoro Present Inglis Present Kostelnik Present Moses Present Stephenson Present Six members present. Mayor Kelly present. CITIZEN COMMENTS ON AGENDA ITEMS: APPROVAL OF MINUTES: Motion by Kostelnik, seconded by Santoro that the minutes of the April 19, 2022 Council Meeting be approved. Roll Call Six ayes, no nays. Motion carried. AGENDA ITEMS: A. RATIFY RESOLUTION OF THE BOROUGH OF WEST MIFFLIN AUTHORIZING THE FILING OF AN APPLICATION FOR GRANT APPLICATION WITH THE REDEVELOPMENT AUTHORITY OF ALLEGHENY COUNTY FOR THE LEBANON CHURCH ROAD STORMWATER STUDY IN THE AMOUNT OF $175,000.00. Motion by Inglis, seconded by Davis Roll Call: Six ayes, no nays. Motion carried. B. RESOLUTION OF THE BOROUGH OF WEST MIFFLIN APPROVING THAT THE ACQUISITION AND SUBSEQUENT DISPOSITION OF A PARCEL OF VACANT PROPERTY KNOWN AS LOT AND BLOCK NUMBER 237-J-215 WOULD BE IN ACCORD WITH THE COMPREHENSIVE PLAN OF THE MUNICIPALITY Motion by Kostelnik, seconded by Santoro Roll Call: Six ayes, no nays. RESOLUTION OF THE BOROUGH OF WEST MIFFLIN APPROVING THAT THE ACQUISITON AND SUBSEQUENT DISPOSITION OF A PARCEL OF VACANT PROPERTY KNOWN AS LOT AND BLOCK NUMBER 241-G-251 WOULD BE IN ACCORD WITH THE COMPREHENSIVE PLAN OF THE MUNICIPALITY. Motion by Kostelnik, seconded by Inglis Roll Call: Six ayes, no nays Motion carried. D. RESOLUTION OF THE BOROUGH OF WEST MIFFLIN APPROVING THAT THE ACQUISITION AND SUBSEQUENT DISPOSITION OF A PARCEL OF VACANT PROPERTY KNOWN AS LOT AND BLOCK NUMBER 238-J-132 WOULD BE IN ACCORD WITH THE COMPREHENSIVE PLAN OF THE MUNICIPALITY. RESOLUTION OF THE BOROUGH OF WEST MIFFLIN APPROVING THAT THE ACQUISITION AND SUBSEQUENT DISPOSITION OF A PARCEL OF VACANT PROPERTY KNOWN AS LOT AND BLOCK NUMBER 238-J-134 WOULD BE IN ACCORD WITH THE COMPREHENSIVE PLAN OF THE MUNICIPALITY. Motion by Kostelnik, seconded by Inglis Roll Call: Six ayes, no nays. Motion carried. F. Motion by Kostelnik, seconded by Santoro to approve participating in the SHACOG 2022 Joint Police Test. Roll Call: Six ayes, no nays. Motion carried. G. Motion by Kostelnik, seconded by Inglis to approve a $1 Million CyberRisk Policy with Travelers for coverage of West Mifflin Borough at a 1-year premium cost of $10,694.00. Roll Call: Six ayes, no nays. Motion carried. H. Motion by Kostelnik, seconded by Davis to approve GPS tracking system for West Mifflin Borough Fleet Vehicles provided by Verizon Connect. Agreement covers 54 vehicles at a monthly cost of $947.50. Roll Call: Six ayes, no nays. Motion carried. I. Motion by Kostelnik, seconded by Davis to approve agreement with CivicPlus to Develop, Host and Maintain West Mifflin Borough Website, development and first year price of $25,081.00. With second year renewal cost of $4,725.00. Roll Call: Six ayes, no nays. Motion carried. Mayor Kelly asked if the details of this motion were discussed. Mr. Kamauf replied yes, and it was discussed at the work session. Mayor Kelly asked how we decided on this specific company. Mr. Kamauf replied they were a recommendation from SHACOG and are used by a lot of other local municipalities. MAY 18, 2022 8261 J. Motion by Kostelnik, seconded by Inglis to approve bid from Frankl Electric in the amount of $181,385.00 for Contract 2021-06 Public Works Facility Electrical Upgrade. Roll Call: Six ayes, no nays. Motion carried. K. Motion by Kostelnik, seconded by Davis to reapprove the Hejnosz and Faiello Subdivision located on St. Agnes Lane. Roll Call: Six ayes, no nays. Motion carried. L. Motion by Kostelnik, seconded by Inglis to approve the appointment of Anthony DiCenzo as Director of West Mifflin Public Works. Roll Call: Six ayes, no nays. Motion carried. M. Motion by Kostelnik, seconded by Davis to approve the hiring of Edward Moody as Assistant Director of West Mifflin Public Works. Roll Call: Six ayes, no nays. Motion carried. N. Motion by Kostelnik, seconded by Santoro to approve a One Thousand Dollar annual salary increase for Jeff Youkers for successful completion of ICC Accessibility Inspector/Plans Examiner Certification. Roll Call: Six ayes, no nays. Motion carried. O. Motion by Kostelnik, seconded by Inglis to approve a One Thousand Dollar annual salary increase for Joseph Hlasnick for successful completion of ICC Residential Energy Inspection Certification. Roll Call: Six ayes, no nays. Motion carried. P. Motion by Kostelnik, seconded by Inglis to approve the hiring of Shane Estep as mechanic for the Public Works Department, pending successful completion of background checks and drug and alcohol testing. Roll Call: Six ayes, no nays. Motion carried. DEPARTMENTAL REPORTS: Community Development…………………………………………………...Walter B. Anthony Mr. Anthony read the Community Development Report for the Month of April 2022. Mayor Kelly referred to the food truck ordinance, and asked Mr. Anthony if food trucks are completely on private property is a permit required. Mr. Anthony replied the intent of the ordinance that a permit is required, even if an individual is having a party on private property. Mayor Kelly asked if it is pulled into the driveway, they would still need a permit. Mr. Kamauf replied they are actually only allowed on private property. MAY 18, 2022 8262 Mayor Kelly stated he is referring to someone that is requesting a pretzel truck in front of Kohl’s for a fundraiser. Mayor Kelly asked if a permit is required in a shopping center. Mr. Anthony replied yes. Police……………………………………………………………..…...Chief Gregory McCulloch Chief Gregory McCulloch read the Police Report for the Month of April 2022. Mr. Davis commented he has noticed there have been more accidents on Lebanon Church Road and asked if it was due to an uptick in traffic because of construction. Chief McCulloch commented it does get confusing at times due to the construction. Chief McCulloch commented recently the SHACOG Cirt team, which is the SWAT team had an opening, Officer Meyer showed interest and passed 3 phases of testing. Officer Meyer is now an official member of the SHACOG Cirt team. Chief McCulloch commented E-tickets are now in 4 of the Police Departments cars, the system allows the officer to print the ticket and hand it to the person. Chief McCulloch commented West Mifflin was the first department in SHACOG to have that. Any new vehicle purchased going forward will now have that system. Public Works……………………………………………………………….…Anthony DiCenzo Mr. DiCenzo thanked Council for their support and confidence in him to fill the Public Works Director position. Mr. DiCenzo read the Public Works Report for the Month of April 2022. Mr. Stephenson asked about dumping at the Borough garage. Mr. DiCenzo replied the fee is $35.00, but if a resident brings a trash bag or 2 there is not a fee. Mr. DiCenzo commented there are people that bring loads of construction material, and if seen someone will inform them to purchase a dump ticket from the Borough. Mr. Kostelnik asked if there was a camera to pick up license plates if dumping without a permit. Mr. DiCenzo replied yes there is. Mr. Stephenson asked Mr. DiLucente if there was an ordinance or anything for someone to purchase an annual permit. Mr. DiLucente replied there is not anything like that and if Council did want to pass something like that it would have to be reasonably related to the fee that would be charged. MAY 18, 2022 8263 Mr. Stephenson commented he knows someone cleaning out a relative’s house and would like to purchase tickets to dump. Mr. Kamauf stated he could come into the Borough and purchase as many dump tickets as he would like, then use them as he needs to. Mr. DiCenzo commented they should do a better job policing the dumpsters. When they come into work on a Monday the dumpsters are overflowing, and materials are on the ground around the dumpsters. Ms. Santoro commented it is ugly especially with the ball field right there. Mayor Kelly congratulated Mr. DiCenzo and asked if there was any thought regarding the weight limit on St Agnes Lane. Chief McCulloch commented there are no truck signs at both ends of the road and he has had officers sit in the St. Agnes lot to try and catch the trucks coming through. Mayor Kelly commented the trucks coming through should be using Lower Bill Run and are contracted by the Sanitary Authority because their truck is currently broken down. Chief McCulloch they are still not allowed to use that road except for local deliveries. Chief McCulloch will have someone stop at the Sewer Authority. Mayor Kelly replied Mr. Marecic talked to the Sewer Authority and said they were told they were not allowed to use Lower Bull Run due to the weight limit. Chief McCulloch commented they will have to start going around and go up Municipal Road across the bridge and down Homestead Duquesne Road. Mr. Kostelnik commented he was unaware of that but will make sure he calls the Sewer Authority tomorrow. Mr. Kostelnik commented he agrees and does not think they should be going on Lower Bull Run or St. Agnes Lane. EMS…………………………………………………………Assistant Chief Brian McCaffrey Assistant Chief McCaffrey read the EMS Report for the month of April 2022. Mayor Kelly asked why EMS is not signing on with the 3 major insurance companies. Assistant Chief McCaffrey replied on the surface the bill was to alleviate costs and would help the local EMS, but it actually does not help in anyway. Assistant Chief McCaffrey commented what it does is allows the insurance company to set a rate for what they would pay for services, that compared to what it actually cost is significantly less. MAY 18, 2022 8264 Mayor Kelly stated he understands. REPORT OF THE MAYOR: Mayor Kelly asked if there has been any progress on the brake retarder system specifically on Homestead Duquesne, and Lebanon Church Road. Mr. Kamauf reported there has not been any update. Mr. Davis stated he reached out to the County and Penn Dot and the Borough will have to do the study. Mayor Kelly understands, but commented he believes if the Chief of Police states it is prohibited that would work. Mr. Kamauf commented not on a County Road. Mr. Kamauf stated we would have to do the study, and they will still probably deny it. Mr. Davis stated we must follow the Penn Dot requirements for the study. Even after paying for the study, they can still deny it. Mr. Davis went through the proper channels to get answers. Ms. Santoro commented Mr. Shanley from the County told her he would send someone out. Mayor Kelly stated on May 28, 2022 at 10:00 there will be a Memorial Day Service at Mitchell Paige Memorial Park. Mr. Inglis stated he reached out to 2 students to sing the National Anthem, and will have an answer by Friday. REPORT OF THE SOLICITOR: Solicitor DiLucente commented all items were discussed in the Work Session. REPORT OF THE ENGINEER: Mr. Elyes reported Mele has completed all 2021 paving work. Mr. Elyes reported he reached out to PA American Water regarding the water line relocation for the Duquesne Avenue Culvert Replacement. PA American Water will complete the relocation in the next 1-2 weeks, then the project can go out for bid. Mr. Elyes reported he and Mr. DiCenzo rode around to put together the paving list, and it will be ready for next month. MAY 18, 2022 8265 REPORT OF THE BOROUGH MANAGER: Mr. Kamauf read the Finance Report for the month of April 2022. PAYMENT OF BILLS: Motion by Kostelnik, seconded by Inglis that all bills properly approved by the Finance Committee be paid. Roll Call: Six ayes, no nays. Motion carried. NEW BUSINESS: Mr. Inglis reported the Movie Night for the Recreation Department will be held at the Community Park on June 10, 2022. CITIZENS COMMENTS: Regis Griffin 812 Meadow Drive commented he lives at one of the 3 properties that had a landslide in the backyard. Mr. Griffin stated they are ready to start moving forward with work. Mr. Griffin’s contractor is requesting access to the service Road on Clover Lane. The contractor will bring an excavator in to see what work needs to be done, then will put together a proposal. At that time, he is willing to meet with the Borough Engineer so that everything is done correctly due to the property connecting to Borough property. Mr. Kamauf stated he is waiting for the insurance due to a legal issue. Solicitor DiLucente commented he would prefer the contractor to contact the Borough Manager and provide his insurance information.
