March 19, 2024 8856 COUNCIL OF THE BOROUGH OF WEST MIFFLIN met in regular session in the Municipal Building Council Chambers on March 19, 2024, at 6:32 p.m. prevailing time with President Scott Stephenson presiding. ROLL CALL: Topolnak Present Davis Present Santoro Present Inglis Absent Kostelnik Present Moses Present Stephenson Present Six members present. Mayor Kelly present via phone. CITIZEN COMMENTS ON AGENDA ITEMS: Jim Jasinski 4100 Home Street – Mr. Jasinski asked if Item G was due to misuse of equipment. Mr. Kamauf said no however the machine is over 30 years old. Mr. Jasinski asked what the containers are for that were mentioned in Item H. Mr. Anthony stated that the Borough would like to use them for safe storage of the Solider Banners. Mr. Jasinski asked what is going to happen with the old incinerator. Mr. Kamauf replied that the building inside is not usable, and the Borough is exploring options of tearing it down. Mr. Jasinski asked if the Winklevoss field is still being used and where the tower will be placed. Mr. Stephenson replied it will be on the fair right outside of the field. APPROVAL OF MINUTES: Motion by Davis, seconded by Santoro that the minutes of the Council Meeting be approved. Roll Call Six ayes, no nays. Motion carried.  March 19, 2024 8857 AGENDA ITEMS: A. A RESOLUTION OF THE BOROUGH OF WEST MIFFLIN, ALLEGHENY COUNTY, PENNSYLLVANIA, AUTHORIZING THE PROPER DISPOAL OF CERTAIN RECORDS IN COMPLIANCE WITH THE REQUIREMENTS OF THE RETENTION AND DISPOITION SCHEDULE FOR RECORDS OF PENNSYLVANIA MUNICIPAL GOVERNMENTS. Motion by Kostelnik, seconded by Topolnak. Roll Call: Six ayes, no nays. Motion carried. B. Motion to approve the advertisement of an Ordinance Amending Chapter 82 Regulating Animals and Pets. Motion by, seconded by Roll Call: Six ayes, no nays. Motion carried. C. Motion to approve the Steiner Two Lot Consolidation Place of Parcels #181-F-300 & 181-F-381 on Terrace Avenue. Motion by, seconded by Roll Call: Six ayes, no nays Motion carried. D. Motion to approve the Haybec Two Lot Consolidation Plan of Parcels #305-P-205 & 205-F-312 on Texas Avenue. Motion by, seconded by Roll Call: Six ayes, no nays. Motion carried. E. Motion to approve purchase Advertisement of Public Hearing for the following Conditional Use Applications: a. CHG Tenant Holdings, LLC c/o Capital Healthcare Group, LLC. To allow the internal use of the property located at 4043 Irene Street (Locust Grove) to provide psychiatric treatment and crisis support for mental health issues to seniors. b. Mon Valley Boys Academy (a Private School) to reopen the former St. Agnes School building at 635 St. Agnes Lane to provide educational services to high school age boys. c. Pittsburgh SMSA Limited Partnership dba Verizon Wireless to allow for the construction of a 125’ telecommunications pole at 507 Dennison Drive (Winklevoss Field). F. Motion to approve Right-of-Way agreement between the Borough of West Mifflin and Duquesne Light Company for Utility right-of-way on Parcel 468-C-175. G. Motion to approve the purchase of two (2) 20-foot standard wind and watertight shipping containers from Mann’s Cans at a total cost of $4,900.00. I. Motion to approve Lease Agreement with West Mifflin Little League Baseball for Lease of the Little League Fields at St. Agnes. J. REPORT OF THE SOLICITOR: Solicitor DiLucente read the report for February 2024. Jim Jasinski of 4100 Home Street asked if the equipment located at Century III Mall was there for show.  March 19, 2024 8859 Solicitor DiLucente replied no, the demolition should be starting next week. Meeting paused to have Judge Olasz swear in Officer Sayer. REPORT OF THE ENGINEER: Mr. Elyias reported that the Public Works garage is about 95 percent complete. REPORT OF THE BOROUGH MANAGER: Mr. Kamauf read the Finance Report for the month of February 2024. PAYMENT OF BILLS: Motion by Davis, seconded Santoro by that all bills properly approved by the Finance Committee be paid. Roll Call: Six ayes, no nays. Motion carried. NEW BUSINESS: Mr. Moses would like a Resolution for the Borough of West Mifflin recognize the week of April 9th – April 12th as Local Government Week and April 10th as Local Government Day. Motion by Moses, seconded by Kostelnik. Roll Call: Six ayes, no nays. Motion carried. CITIZENS COMMENTS: Paul Thomas 5125 Skylark Avenue – Mr. Thomas sent an email to Council, except for Mr. Moses and Mr. Kostelnik, and asked that it be forwarded to them. Mr. Kostelnik and Mr. Moses have both received the email. Mr. Thomas said he is disappointed that he has not received a response from Council. Mr. Kamauf replied that the Borough cannot advertise businesses on the Borough website. Solicitor Dilucente said he will review the email that was sent and get back to Mr. Thomas. Mark and Mary Cooper 1739 Clairton Road – Mr. and Mrs. Cooper said they are attending to find our if there are any updates on the 885 clean fill dump site. Mr. Moses said he followed up with Mr. Anthony to make sure the proper permits are place for the business to be there and the proper permits were issued.  March 19, 2024 8860 Mr. Cooper asked if there was a business permit issued for the dump site location. Mr. Kamauf said it is not required as the business is not located at the dump site address. Mr. Cooper asked if anyone else on the council believes that there is not business at the location. Mr. Kamauf said it is the same as if a roofing company comes to fix your roof but the business is not located in West Mifflin, they do not need a business permit for West Mifflin to work here. Mr. Cooper stated that the first thing he smells every morning is diesel fuel. Tim Sailor 416 Wiliam Street - Mr. Sailor said he has talked with Mr. Cooper and has no hard feelings but there is no way that the diesel fuel is not as bad as Mr. Cooper is saying. Mr. Sailor has offered to plant trees and install a turn around for the Coopers. Anna Colter 416 Toura Drive – Ms. Colter is asking if the Wells on the property of the 885 dump site have been properly capped. Ms. Colter is afraid someone is going to fall into the well, especially a child. Mr. Anthony stated that it is private property and he is not sure if they were capped. Ms. Colter asked again if the multiple wells were capped. Solicitor DiLucente replied that West Mifflin Borough is not legally allowed to step onto private property to force them to cap a well. Jim Jasinski 4100 Home Street – Mr. Jasinski asked if the old “G&K” Hall near Duquesne is industrial because of the truck repairs that are occurring. Mr. Anthony replied that the location in question is zoned for C1 General Commercial, which includes auto repair shops. Mr. Jasinski asked if the Borough will release a road repair schedule for the spring. Mr. Stephenson replied yes and asked if Mr. Jasinski had a road request. Mr. Jasinski asked for Hoffman Blvd to be added to the list. Mr. Stephenson replied that he has already discussed that street with Mr. DiCenzo. Mr. Jasinski asked if there are any grants for a K9 for West Mifflin. Chief McCulloch replied that there are no grants and most officers in other communities purchase their own dogs.  March 19, 2024 8861 ADJOURNMENT: Motion by Santoro, seconded by Kostelnik that the Meeting be adjourned.
