August 20, 2024 8875 COUNCIL OF THE BOROUGH OF WEST MIFFLIN met in regular session in the Municipal Building Council Chambers on August 20, 2024 at 6:30 p.m. prevailing time with President Scott Stephenson presiding. CITIZEN COMMENTS ON AGENDA ITEMS: APPROVAL OF MINUTES: Motion by Topolnak, seconded by Davis that the minutes of the July 16, 2024 Council Meeting be approved. Roll Call Seven ayes, no nays. Motion carried. AGENDA ITEMS: A. Motion to approve the preliminary and final site plan for KIA Dealership located at 2483 Lebanon Church Road. Motion by Davis, seconded by Moses. Roll Call: Five ayes, no nays. Motion carried. B. Motion to approve the 1600 Texas Avenue Consolidation Plan. Motion by Topolnak, seconded by Davis. Roll Call: Five ayes, no nays. Motion carried. C. Motion to approve the advertising paving contract for Pickleball Court and the Community Park. Motion by Santoro, seconded by Davis. Roll Call: Five ayes, no nays Motion carried. D. Motion to approve One Year Funding Extension Agreement between the Borough of West Mifflin and the West Mifflin Fire Departments. Motion to approve increasing the Crossing Guard Wage for the 2024-25 school year to Fifteen Dollars ($15.00) per hour. Motion by Santoro, seconded by Moses. Roll Call: Five ayes, no nays. Motion carried. F. Motion to approve temporary construction access agreement between the Borough of West Mifflin and Property owners at 812 Meadow Dive, West Mifflin. Motion by Davis, seconded by Topolnak. Roll Call: Five ayes, no nays. Motion carried. G. Motino to approve the hiring of Javaun Daniels to the Public Works Department, pending successful completion of background checks and drug and alcohol screening. Motion by Moses, seconded by Davis. Roll Call: Five ayes, no nays. Motion carried. H. Motion to approve the hiring of Nicholas Nesiti to the Public Works Department, pending successful completion of background checks and drug and alcohol screening. NEW BUSINESS: Mr. Moses had the following two NEW BUSINESS items. A RESOLUTION OF THE BOROUGH OF WEST MIFFLIN AUTHORIZING THE FILING OF AN APPLICATION FOR CDBG FUNDS WITH THE ALLEGHENY COUNTY ECONOMIC DEVELOPMENT. Motion by Moses, seconded by Davis. Roll Call: Five ayes, no nays. Motion carried. A RESOLTUION OF THE BOROUGH OF WEST MIFFLIN THAT THERE ARE SEVERAL VACANT AND DILAPIDATED STRUCTURES LOCATED WITH THE MUNICIPLAITY OF WEST MIFFLIN. Motion by Moses, seconded by Davis. Roll Call: Five ayes, no nays. Motion carried. CITIZENS COMMENTS:  August 20, 2024 8877 Caroline Vinay 219 Dundee Drive – Ms. Vinay would like to know if it’s possible to get a monthly list of citations and incidents regarding dogs. Chief McCullouch stated that if the Council approves, he can provide that information. Ms. Vinay asked if there is anything that can help her understand the difference between a “kennel” and a “structure.” Mr. Anthony replied that the picture she has is of a structure kennel, not a business kennel. Mr. Anthony stated that it is an accessory structure, just as a garage would be. Elieen Straub 200 Castle Drive – Ms. Straub asked why there is a structure built before the consolidation was approved. Mr. Anthony replied because it is currently in the hands of the court. Mr. Kamuaf said that the property owners were find in court. Ms. Straub then asked if the Borough plans on approving the consolidation. Mr. Anthony replied yes. Ms. Straub asked Solicitor DiLucente what was going on with the updating of the Nuisance Dog Ordinance. Solicitor DiLucente responded that you cannot target people individually with ordinances. Mr. Davis asked if the dogs have been seen being walked or barking. Ms. Straub replied that they do bark, but it has not been as bad. Ms. Straub added that the property owner has a can of dog feces he keeps near her property line until garbage day, and it stinks. Mr. Stephenson said that the feces is a nuisance and maybe the health department would be able to help. Chief McCullouch stated that most dog owners would keep their pets’ feces bagged up and taken out to the garbage on their pickup day. Dan Mikulay 4803 Aspen Street – Mr. Mikulay said he has been having problems with sewage and would like to know if there’s anything that can be done about it. Mr. Kamauf replied that the Sewer Authority has offered a special pump to Mr. Mikulay but Mr. Mikulay turned it down. Mr. Mikulay said the sewage is an ongoing thing and it is not a sure fix. Mr. Davis asked Mr. Moses if this is not a Sewer Authority issue. Mr. Moses replied that it is. ADJOURNMENT: Motion by Topolank, seconded by Santoro that the Meeting be adjourned.
