MINUTES OF COUNCIL REGULAR MEETING AUGUST 16, 2022 -1- THE WEST VALLEY CITY COUNCIL MET IN REGULAR ELECTRONIC SESSION ON TUESDAY, AUGUST 16, 2022, AT 6:30 P.M. IN THE COUNCIL CHAMBERS, WEST VALLEY CITY HALL, 3600 CONSTITUTION BOULEVARD, WEST VALLEY CITY, UTAH. THE MEETING WAS CALLED TO ORDER AND CONDUCTED BY MAYOR PRO TEM HUYNH. There were no changes, corrections or deletions. Councilmember Nordfelt moved to approve the Minutes of the Regular Meeting held August 9, 2022. Councilmember Whetstone seconded the motion. A voice vote was taken and all members voted in favor of the motion. COMMENT PERIOD A. PUBLIC COMMENTS Michael Dotson stated that he is in opposition to Resolution 22-126. He expressed concern about consolidating or centralizing any type of power, especially the Police Department. Mr. Dotson indicated that he is concerned Salt Lake City does not have the same ethics that West Valley City has. Myles Winn expressed concern about speeding in neighborhood. He also stated that he has been attending Council meetings for several weeks and has felt that some comments made by the public are out of line in relation to singling people out, bigotry, etc. Mr. Winn stated that he doesn’t feel like these Council meetings are a safe space and asked that the Council hold attendees accountable. Jim Vesock stated that performers at USANA and the Maverik Center should recognize that they are in West Valley City. He expressed concern about Code Enforcement and the status of some homes in the Hunter Village area. Mr. Vesock stated that Parking Enforcement needs to work on the weekend. B. CITY MANAGER COMMENTS Wayne Pyle, City Manager, had no comments. C. CITY COUNCIL COMMENTS Mayor Pro Tem Huynh requested that Chief Jacobs contact Mr. Winn regarding speeding. RESOLUTION 22-126: AUTHORIZE THE CITY TO ENTER INTO A MEMORANDUM OF UNDERSTANDING WITH OTHER AGENCIES TO CREATE THE SALT LAKE VALLEY REGIONAL PUBLIC ORDER UNIT Wayne Pyle, City Manager, discussed proposed Resolution 22-126 that would authorize the City to Enter into a Memorandum of Understanding with Other Agencies to Create the Salt Lake Valley Regional Public Order Unit.  MINUTES OF COUNCIL REGULAR MEETING AUGUST 16, 2022 -3- Written documentation previously provided to the City Council included information as follows: All Parties to this MOU have a Public Protection Unit or Public Order Unit (POU) concerned with preserving the public peace, preventing crime, arresting offenders, and protecting the rights of persons and property. The Parties desire that the POUs work as a team pursuant to this MOU under appropriate circumstances for the purpose of obtaining maximum efficiency in cooperative law enforcement operations. All parties are authorized to enter into this MOU pursuant to Utah Code § 11-13- 202, Agreements for Joint or Cooperative Undertaking. Local law enforcement agencies encountering recent civil unrest determined that resources were a primary concern. Established protocol for collective efforts was not in place and requests for assistance came in emergency situations and lacked proper planning and coordination. Establishment of the SLVR POU addresses these concerns and provides the ability for participating agencies to identify protocols for training, personnel, equipment, transportation, communication, and other resources. Upon inquiry by Mayor Pro Tem Huynh there were no further questions from members of the City Council, and he called for a motion. Councilmember Whetstone moved to approve Resolution 22-126. Councilmember Christensen seconded the motion. Mayor Pro Tem Huynh asked how long the City has been part of this unit. Wayne replied that this is a new unit. Mayor Pro Tem Huynh asked who will operate the unit. Wayne replied that if there were an event where a City needed backup, the unit would respond in that jurisdiction at their request. NEW BUSINESS A. CONSIDER APPLICATION S-2-2022, FILED BY MIKE CHAMBERS, REQUESTING FINAL PLAT APPROVAL FOR THE KENT BOOSTER SUBDIVISION LOCATED AT 4408 SOUTH 4800 WEST Wayne Pyle, City Manager, discussed Application S-2-2022, Filed by Mike Chambers, Requesting Final Plat Approval for the Kent Booster Subdivision Located at 4408 South 4800 West. Written documentation previously provided to the City Council included information as follows: Mike Chambers with Hansen Allen and Luce Inc., representing Granger Hunter Improvement District, is requesting final approval for the Kent Booster Subdivision. The purpose for the subdivision is to configure property lines that will be consistent with ownership of existing water tanks between Granger Hunter Improvement District and Jordan Valley Water Conservancy District. Granger-Hunter Improvement District is in the process of acquiring one of Jordan Valley Water Conservancy District’s 5MG tanks and is currently soliciting bids to replace the existing booster pump station at 4404 South 4800 West. As part of the tank purchase and upcoming pump station construction, Granger Hunter is proposing to acquire from Jordan Valley Water Conservancy District, the parcel on which the tank is currently located, as well as additional property for tank piping. This acquisition requires that the existing property be subdivided. The proposed subdivision is gained from a single access point from 4800 West. Because Jordan Valley still has utilities on their two parcels, both Granger Hunter and Jordan Valley will enter into arrangements granting permanent access and various easements in and through the property to operate and maintain said utilities and appurtenances. Upon inquiry by Mayor Pro Tem Huynh there were no further questions from members of the City Council, and he called for a motion. B. CONSIDER APPLICATION SD-3-2022, FILED BY DAI UTAH, REQUESTING FINAL PLAT APPROVAL FOR THE DECKER LANE PARTIAL STREET DEDICATION LOCATED AT 2860 SOUTH 2050 WEST Wayne Pyle, City Manager, discussed Application SD-3-2022, Filed by DAI Utah, Requesting Final Plat Approval for the Decker Lane Partial Street Dedication Located at 2860 South 2050 West Written documentation previously provided to the City Council included information as follows: Joe Salisbury, representing DAI Utah, is requesting a partial street dedication for a portion of Decker Lane. The property to be dedicated is part of the H2O Lofts development and is located at approximately 2860 South 2050 West The H2O development received conditional use approval from the Planning Commission in March 2022. During the City’s review of the site plan, it was determined that additional right-of-way was needed on the east side of Decker Lane. Decker Lane was dedicated in 2003 as part of the Decker Lane and Decker Lake Boulevard Extension plat. When this right-of-way was dedicated, public improvements included curb and gutter on both sides of the street and sidewalk on one side. However, with new residential development going in east of the existing  MINUTES OF COUNCIL REGULAR MEETING AUGUST 16, 2022 -6- dedicated street, additional right-of-way is needed for parkstrip and sidewalk improvements. The existing curb and gutter will remain and will be modified only where new access points are proposed. The dedication will only affect property that is being developed as part of the H2O Lofts. The right-of-way will increase in size by 10 feet which will provide 5 feet each for the parkstrip and sidewalk. Upon inquiry by Mayor Pro Tem Huynh there were no further questions from members of the City Council, and he called for a motion. Councilmember Whetstone moved to approve Application SD-3-2022. Councilmember Harmon seconded the motion.
