MINUTES OF COUNCIL STUDY MEETING – NOVEMBER 20, 2018 -1- THE WEST VALLEY CITY COUNCIL MET IN STUDY SESSION ON TUESDAY, NOVEMBER 20, 2018, AT 4:30 P.M. AT WEST VALLEY CITY HALL, MULTIPURPOSE ROOM, 3600 CONSTITUTION BOULEVARD, WEST VALLEY CITY, UTAH. THE MEETING WAS CALLED TO ORDER AND CONDUCTED BY MAYOR BIGELOW. There were no changes, corrections or deletions.  MINUTES OF COUNCIL STUDY MEETING – NOVEMBER 20, 2018 -2- Councilmember Buhler moved to approve the Minutes of the Study Meeting held November 13, 2018. Councilmember Christensen seconded the motion. A voice vote was taken and all members voted in favor of the motion. REVIEW AGENDA FOR REGULAR CITY COUNCIL AND SPECIAL REDEVELOPMENT AGENCY MEETING OF NOVEMBER 20, 2018 Upon inquiry by Mayor Bigelow, members of the Council had no further questions or concerns regarding items listed on the Agenda for the Regular City Council and Special Redevelopment Agency Meeting scheduled later this night. PUBLIC MEETINGS SCHEDULED FOR NOVEMBER 27, 2018 A. ACCEPT PUBLIC INPUT REGARDING THE WEST VALLEY CITY POLICE DEPARTMENT'S APPLICATION FOR A JUSTICE ASSISTANCE GRANT (JAG) THROUGH THE U.S. DEPARTMENT OF JUSTICE PROGRAMS Mayor Bigelow informed a public hearing had been advertised for the Regular Council Meeting scheduled November 27, 2018, in order for the City Council to hear and consider public comments regarding the West Valley City Police Department's application for a Justice Assistance Grant (JAG) through the U.S. Department of Justice Programs. Proposed Resolution 18-225 related to the proposal to be considered by the City Council subsequent to the public hearing, was discussed as follows: ACTION: RESOLUTION NO. 18-225, AUTHORIZE THE WEST VALLEY CITY POLICE DEPARTMENT TO APPLY FOR JUSTICE ASSISTANT GRANT FUNDING FROM THE UNITED STATES DEPARTMENT OF JUSTICE Colleen Jacobs, Police Chief, discussed proposed Resolution 18-225 that would authorize the West Valley City Police Department to apply for Justice Assistant Grant funding from the United States Department of Justice. Written documentation previously provided to the City Council included information as follows: The U.S. Depai1ment of Justice Program is allowing the West Valley City Police Department to apply for the 2018 Edward Byrne Memorial Justice Assistance Grant (J.A.G.). The allowable expenses of the grant are the purchase of equipment, to fund training, to fund programs they approve through the application process, and in some cases, pay salaries for those  MINUTES OF COUNCIL STUDY MEETING – NOVEMBER 20, 2018 -3- programs. The funds are allocated to West Valley City based on a formula that considers among other things, the population of West Valley City and our part one crime statistics. There is separate funding allocated to each state to ensure fairness. The J.A.G. Program allows states and local governments implement otherwise unfunded programs designed to improve the criminal justice system. The Utah State Legislature passed legislation in 2014 and 2015 chai1ging how police SWAT teams operate. There have been significant changes in national best practices for tactical teams over the last five years. Our SWAT team has been implementing new, safer tactics using outdated equipment and without all the necessary training. The department would like to use the J.A.G. grant to provide our SWAT team with the training and equipment needed to keep our community and our officers safe. Councilmember Buhler asked specifically what items the money would be used for. Chief Jacobs replied special vests, helmets, training, etc. Councilmember Buhler asked what happens to expired items. Chief Jacobs replied that items become surplus or are utilized in other ways. The City Council will consider Resolution 18-225 at the Regular Council Meeting scheduled November 27, 2018, at 6:30 P.M. RESOLUTION 18-226: APPROVE A PARTICIPATION AGREEMENT BETWEEN THE CITY AND THE GOVERNOR'S OFFICE OF ENERGY DEVELOPMENT FOR PARTICIPATION IN THE STATE C-PACE DISTRICT Jeff Jackson, CED, presented proposed Resolution 18-226 that would approve a Participation Agreement between the City and the Governor's Office of Energy Development for participation in the State C-Pace District. Written documentation previously provided to the City Council included information as follows: The Governor’s Office of Energy Development has created a CPACE district which is fully staffed and equipped to administer the C-PACE program and to assist property owners through the CPACE process without taking up valuable time and resources from municipal staff. The CPACE district is equipped to assist in the following areas: 1: Full administration of C-PACE projects 2: C-PACE education and outreach to property owners in our city  MINUTES OF COUNCIL STUDY MEETING – NOVEMBER 20, 2018 -4- 3: Connects property owner with capital providers and OED 4: Manages project development C-PACE charges the property owner a 1% fee up to $80,000 for participating in the service. As is usual with most projects, West Valley City secures a catalyst to ensure program viability and interest. Wheeler Machinery is the first company/property owner who is interested in pursuing a deal managed by the OED C-PACE district. C-PACE will continue to proactively reach out to and educate property owners within West Valley City to participate in C-PACE through new construction and or upgrades to existing infrastructure in order to reduce energy demands. C-PACE (Commercial Property Assessed Clean Energy) is a bill passed in Utah in 2013 that authorizes local governments to offer commercial property owners a unique mechanism for financing energy efficient, renewable energy, and water conservation improvements to their buildings. In 2017 an amendment was made to allow for the establishment of a statewide C-PACE district to simplify the establishment of C-PACE areas. Mayor Bigelow clarified that the City applied for the first approval on its own. Jeff replied yes and added that West Valley City is the first and only City to do so. Councilmember Fitisemanu asked what the 1% cost entails. Jeff replied 1% of the cost of C-Pace materials. The City Council will consider Resolution 18-226 at the Regular Council Meeting scheduled November 27, 2018, at 6:30 P.M. COMMUNICATIONS A. COUNCIL CALENDAR Mayor Bigelow referenced a Memorandum previously received from the City Manager that outlined upcoming meetings and events. Members of the City Council had no further questions regarding the Council Update. NEW BUSINESS A. POTENTIAL FUTURE AGENDA ITEMS Council Suggestions  MINUTES OF COUNCIL STUDY MEETING – NOVEMBER 20, 2018 -5- Councilmember Christensen stated that if the proposed RV ordinance passes, a homeowner may be required to come to the Board of Adjustment to ask for a variance which incurs a substantial cost runs with the land. He suggested that a possible alternative could be to have homeowners meet with staff and be given an exemption on a case by case scenario. Cat Ordinance Councilmember Buhler stated that people feel very strongly about these issues but he isn’t sure that there is a right or wrong number per household. Mayor Bigelow stated that there are people who cannot take care of their pets which is why the ordinance is in place. Councilmember Fitisemanu stated that he doesn’t think it’s necessary to change the number but other City’s allow for owners to apply for a license and go through a Planning Commission meeting. He indicated that these residents would need to prove their ability to care for an additional pet. Councilmember Huynh stated that he doesn’t feel the need to change the City’s policy due to a few requests. Councilmember Nordfelt stated that he feels it’s important to measure the impact on the neighbors in the community. He indicated that he doesn’t feel three cats is more of an impact than two and added that less cats in the shelter is better. Mayor Bigelow stated that he is less concerned about cats than he is with dogs. Councilmember Fitisemanu stated that he likes the idea of residents applying for a license and having a public hearing. The Mayor and Council requested that staff bring back the Taylorsville ordinance and see how it may apply in West Valley City. B. COUNCIL REPORTS COUNCILMEMBER CHRISTENSEN- WESTERN GROWTH Councilmember Christensen stated that he attended Western Growth and met with Tom Dolan, Sandy City’s previous Mayor, and discussed civic corridors and recreation opportunities. Councilmember Christensen stated that he has been listening to the KSL podcast about Susan Powell’s disappearance and asked if there is any new relevant information. Wayne replied that no new information has been provided from the Police Department. MAYOR BIGELOW- OLYMPIC MEETING AND ELEMENTARY SCHOOLS Mayor Bigelow indicated that he attended an Olympic meeting where the Maverik Center was mentioned. He stated that the committee was impressed by the depth of support here in the community and the quality of the venues in the area. Mayor Bigelow stated that he recently attended an elementary school and encouraged other Councilmembers to do so as well.  MINUTES OF COUNCIL STUDY MEETING – NOVEMBER 20, 2018 -6- C. REVIEW AGENDA FOR SPECIAL REDEVELOPMENT AGENCY MEETING SCHEDULED NOVEMBER 27, 2018 RESOLUTION 18-10: AUTHORIZE THE AGENCY TO EXECUTE AN INCENTIVE AGREEMENT WITH CONSTITUTION BOULEVARD HOTEL, LLC Mark Nord, CED, presented proposed Resolution 18-10 that would authorize the Agency to execute an Incentive Agreement with Constitution Boulevard Hotel, LLC. Written documentation previously provided to the Redevelopment Agency included information as follows: The $1,000,000 incentive to be paid to CBH will come from the City Center RDA in 5 annual payments starting in November 2019. The City Center RDA area will expire in 2025 and so all incentives and payments need to be completed by end of year 2024 Pursuant to the Agreement, the RDA would pay CBH the five annual payments of $200,000 provided that CBH commit to spend the $1,000,000 on improvements to the site. CBH is intending to build a Marriott Springhill suites on the east side of the Valley Fair Mall. As the developer worked with staff on the permitted use, the West Valley City RDA engaged and encouraged the developer to build taller and change the design to be more unique. The costs associated with building taller and the design change are being partially offset with the purposed incentive. The purposed Marriott will be part of our Fairbourne downtown and staff felt this Hotel needed to be upgraded to look the part of our downtown vision. Mayor Bigelow asked if this agreement is similar to others. Mark replied it is slightly different since the City Center RDA will be expiring. Mayor Bigelow asked if the City ordinance would allow a lesser design quality. Mark replied it would allow four stories but the City wanted to really require something special with this hotel. Councilmember Buhler asked if the number of rooms increased with the upgrade. Mark replied yes. Councilmember Buhler asked if the property will be leased. Mark replied it will be purchased. Councilmember Buhler asked if this is the first Springhill Suites in the City. MOTION FOR CLOSED SESSION Councilmember Buhler moved to adjourn and reconvene in a Closed Session for discussion of pending litigation, professional competency, and disposition of real property. Councilmember Christensen seconded the motion. A voice vote was taken and all members voted in favor of the motion.
