MINUTES OF COUNCIL REGULAR MEETING – NOVEMBER 27, 2018 -1- THE WEST VALLEY CITY COUNCIL MET IN REGULAR SESSION ON TUESDAY, NOVEMBER 27, 2018, AT 6:42 P.M. IN THE COUNCIL CHAMBERS, WEST VALLEY CITY HALL, 3600 CONSTITUTION BOULEVARD, WEST VALLEY CITY, UTAH. THE MEETING WAS CALLED TO ORDER AND CONDUCTED BY MAYOR BIGELOW. THE FOLLOWING MEMBERS WERE PRESENT: Ron Bigelow, Mayor Don Christensen, Councilmember At-Large Lars Nordfelt, Councilmember At-Large Tom Huynh, Councilmember District 1 Steve Buhler, Councilmember District 2 Karen Lang, Councilmember District 3 ABSENT: Jake Fitisemanu, Councilmember District 4 STAFF PRESENT: Wayne T Pyle, City Manager Angel Pezely, Deputy City Recorder Mark Nord, CED/ED Director Eric Bunderson, City Attorney Jim Welch, Finance Director Anita Schwimmer, Deputy Police Chief John Evans, Fire Chief Russell Willardson, Public Works Director Layne Morris, CPD Director Nancy Day, Parks and Recreation Director Jake Arslanian, Public Works Department OPENING CEREMONY Karen Lang conducted the Opening Ceremony. She requested that members of the audience, City Staff, and the Council rise and recite the Pledge of Allegiance. APPROVAL OF MINUTES OF REGULAR MEETING HELD NOVEMBER 20, 2018 The Council considered the Minutes of the Regular Meeting held November 20, 2018. There were no changes, corrections or deletions. MINUTES OF COUNCIL REGULAR MEETING – NOVEMBER 27, 2018 -2- Councilmember Don Christensen moved to approve the Minutes of the Regular Meeting held November 20, 2018. Councilmember Steve Buhler seconded the motion. A voice vote was taken and all members voted in favor of the motion. COMMENT PERIOD A. PUBLIC COMMENTS Jim Vesock came to discuss a proposed change to the pet ordinance. He’d like to change the ordinance to allow residents to adopt more animals. He put his idea out on several social media accounts and got a lot of feedback that other people would like the same thing. Vinh Nguyen is here to advocate for his dogs. He has 4 dogs and recently got a notice that he has to get rid of 2. He would like the Council to please issue him a variance until the Council is able to discuss the possibility of changing the ordinance. Thomas Jackson came to thank the Council for the addition of the bike lanes on 4100 S. Also, Jordan River Trail access is limited and he would propose connecting 4100 S. to Jordan River along with several other possible connections. B. CITY MANAGER COMMENTS Wayne Pyle, City Manager, reiterated the point that the pet ordinance will be placed on a future agenda. Also, he stated that he can approve a variance for this instance while the Council addresses the ordinance. B. CITY COUNCIL COMMENTS Councilman Buhler assured the public commenters that the pet ordinance is scheduled to be discussed soon and that they’re welcome to view agendas on our website. Mayor Bigelow wanted to address the comment made regarding the Animal Control Officers harassing residents. He stated that it’s not harassment and they’re just doing their jobs by enforcing the ordinance that the Council has put forth. PUBLIC HEARINGS A. ACCEPT PUBLIC INPUT REGARDING THE WEST VALLEY CITY POLICE DEPARTMENT'S APPLICATION FOR A JUSTICE MINUTES OF COUNCIL REGULAR MEETING – NOVEMBER 27, 2018 -3- ASSISTANCE GRANT (JAG) THROUGH THE U.S. DEPARTMENT OF JUSTICE PROGRAMS Mayor Bigelow informed a public hearing had been advertised for the Regular Council Meeting scheduled November 27, 2018, in order for the City Council to hear and consider public comments regarding the West Valley City Police Department's application for a Justice Assistance Grant (JAG) through the U.S. Department of Justice Programs. Written documentation previously provided to the City Council included information as follows: The U.S. Department of Justice Program is allowing the West Valley City Police Department to apply for the 2018 Edward Byrne Memorial Justice Assistance Grant (J.A.G.). The allowable expenses of the grant are the purchase of equipment, to fund training, to fund programs they approve through the application process, and in some cases, pay salaries for those programs. The funds are allocated to West Valley City based on a formula that considers among other things, the population of West Valley City and our part one crime statistics. There is separate funding allocated to each state to ensure fairness. The J.A.G. Program allows states and local governments implement otherwise unfunded programs designed to improve the criminal justice system. The Utah State Legislature passed legislation in 2014 and 2015 chai1ging how police SWAT teams operate. There have been significant changes in national best practices for tactical teams over the last five years. Our SWAT team has been implementing new, safer tactics using outdated equipment and without all the necessary training. The department would like to use the J.A.G. grant to provide our SWAT team with the training and equipment needed to keep our community and our officers safe. Mayor Bigelow opened the Public Hearing. There being no one to speak in favor or opposition, Mayor Bigelow closed the Public Hearing. ACTION: RESOLUTION NO. 18-225, AUTHORIZE THE WEST VALLEY CITY POLICE DEPARTMENT TO APPLY FOR JUSTICE ASSISTANT GRANT FUNDING FROM THE UNITED STATES DEPARTMENT OF JUSTICE The City Council previously held a public hearing regarding proposed Resolution 18-225 that would authorize the West Valley City Police Department to apply for Justice Assistant Grant funding from the United States Department of Justice. MINUTES OF COUNCIL REGULAR MEETING – NOVEMBER 27, 2018 -4- Upon inquiry by Mayor Bigelow there were no further questions from members of the City Council, and he called for a motion. Councilmember Tom Huynh moved to approve Resolution 18-225. Councilmember Don Christensen seconded the motion. A roll call vote was taken: Ms. Lang Yes Mr. Buhler Yes Mr. Huynh Yes Mr. Christensen Yes Mr. Nordfelt Yes Mayor Bigelow Yes Unanimous. RESOLUTION 18-226: APPROVE A PARTICIPATION AGREEMENT BETWEEN THE CITY AND THE GOVERNOR'S OFFICE OF ENERGY DEVELOPMENT FOR PARTICIPATION IN THE STATE C-PACE DISTRICT Mayor Bigelow discussed proposed Resolution 18-226 that would approve a Participation Agreement between the City and the Governor's Office of Energy Development for participation in the State C-Pace District. Written documentation previously provided to the City Council included information as follows: The Governor’s Office of Energy Development has created a CPACE district which is fully staffed and equipped to administer the C-PACE program and to assist property owners through the CPACE process without taking up valuable time and resources from municipal staff. The CPACE district is equipped to assist in the following areas: 1: Full administration of C-PACE projects 2: C-PACE education and outreach to property owners in our city 3: Connects property owner with capital providers and OED 4: Manages project development MINUTES OF COUNCIL REGULAR MEETING – NOVEMBER 27, 2018 -5- C-PACE charges the property owner a 1% fee up to $80,000 for participating in the service. As is usual with most projects, West Valley City secures a catalyst to ensure program viability and interest. Wheeler Machinery is the first company/property owner who is interested in pursuing a deal managed by the OED C-PACE district. C-PACE will continue to proactively reach out to and educate property owners within West Valley City to participate in C-PACE through new construction and or upgrades to existing infrastructure in order to reduce energy demands. C-PACE (Commercial Property Assessed Clean Energy) is a bill passed in Utah in 2013 that authorizes local governments to offer commercial property owners a unique mechanism for financing energy efficient, renewable energy, and water conservation improvements to their buildings. In 2017 an amendment was made to allow for the establishment of a statewide C-PACE district to simplify the establishment of C-PACE areas. Upon inquiry by Mayor Bigelow there were no further questions from members of the City Council, and he called for a motion. Councilmember Karen Lang moved to approve Resolution 18-226. Councilmember Steve Buhler seconded the motion. A roll call vote was taken: Ms. Lang Yes Mr. Buhler Yes Mr. Huynh Yes Mr. Christensen Yes Mr. Nordfelt Yes Mayor Bigelow Yes Unanimous. MOTION TO ADJOURN Upon motion by Councilmember Karen Lang voted in favor to adjourn.
