MINUTES OF COUNCIL STUDY MEETING – OCTOBER 26, 2021 -1- THE WEST VALLEY CITY COUNCIL MET IN ELECTRONIC STUDY SESSION ON TUESDAY, OCTOBER 26, 2021 AT 4:30 P.M. AT WEST VALLEY CITY HALL, MULTIPURPOSE ROOM, 3600 CONSTITUTION BOULEVARD, WEST VALLEY CITY, UTAH. THE MEETING WAS CALLED TO ORDER AND CONDUCTED BY MAYOR BIGELOW. THE MEETING WAS ALSO HELD ELECTRONICALLY VIA ZOOM. There were no changes, corrections or deletions. Councilmember Fitisemanu moved to approve the Minutes of the Study Meeting held October 19, 2021. Councilmember Nordfelt seconded the motion.  MINUTES OF COUNCIL STUDY MEETING – OCTOBER 26, 2021 -2- A voice vote was taken and all members voted in favor of the motion. REVIEW AGENDA FOR REGULAR CITY COUNCIL MEETING OF OCTOBER 26, 2021 Upon inquiry by Mayor Bigelow, members of the Council had no further questions or concerns regarding items listed on the Agenda for the Regular City Council meeting scheduled later this night. CONSIDER APPLICATION SMI-5-2021, FILED BY MIKE GARZA, REQUESTING FINAL PLAT APPROVAL FOR THE CREWE 2 LOT SUBDIVISION LOCATED AT 3588 SOUTH 5450 WEST Steve Lehman, CED, presented proposed application SMI-5-2021, Filed by Mike Garza, Requesting Final Plat Approval for the Crewe 2 Lot Subdivision Located at 3588 South 5450 West. Written documentation previously provided to the City Council included information as follows: Mr. Mark Garza, is requesting final plat approval for the Crewe 2 Lot Subdivision. The subject property currently has an existing dwelling that will be removed to accommodate two new single-family dwellings. The property is bordered on the north, east and south by existing residential uses along 5450 West and the Erin Hills PUD to the west. The applicant is the developer of the Erin Hills PUD and the owner of the lots proposed in this application. The subdivision will consist of 2 lots on .42 acres. Although zoned R-1-8, both lots are approximately 9,250 square feet in size. During the rezoning process for the Erin Hills project, the developer requested an exception to the frontage for these two lots. An exception was granted by the City Council that each lot would be approved with 66 feet of frontage. Access to the subdivision will be gained from 5450 West. At the present time, this street is dedicated and improved with asphalt only. Although there are a few sections with curb, gutter and sidewalk, the majority of this street is void of those improvements. Staff has discussed the long-term vision of this right-of-way with the City Engineering Division. Future discussions are planned for the vision of 5450 West and whether public improvements should be planned for this right-of- way. For the present time, the City will require a delay agreement for such improvements, but that could change based on discussions with the Public Works Department.  MINUTES OF COUNCIL STUDY MEETING – OCTOBER 26, 2021 -3- Mayor Bigelow asked if the frontage exception was granted for just these two lots. Steve replied yes. The City Council will consider Application SMI-5-2021 at the Regular Council Meeting scheduled November 9, 2021 at 6:30 P.M. COMMUNICATIONS A. JUSTICE COURT REPORT Nicole Cottle, Assistant City Manager, stated that the Justice Court cannot legally be operated under the Legal Department’s jurisdiction. She explained that the Justice Court is governed by the Supreme Court so the City has limited ability to govern various rules and regulations. Nicole relayed how the Justice Court functioned under COVID-19 protocol and how the Court system has changed since the onset of the pandemic. She detailed how jury trials were backed up during the height of the pandemic and how they were, and are currently, being handled. Nicole detailed how the court will be moved to the current location of the Juvenile Court that is connected to City Hall in the near future. She discussed case numbers, tickets being processed, etc. Councilmember Buhler asked what the judges are and what types of cases they can process. Nicole replied that they are Justice Court judges and they can process everything below a Class A, and sometimes some Class A’s as well as small claims and infractions. Councilmember Buhler asked if they process Code Enforcement cases. Nicole replied no and noted that these are processed by Jody Knapp, an ALJ judge. Councilmember Buhler asked if there are any other ALJ’s employed by the City. Nicole replied that there are. Councilmember Buhler clarified rights of a jury trial and Nicole detailed the rules and regulations. Councilmember Buhler asked if more judges are needed. Nicole replied she does not believe that is necessary at this time but noted that it may be in the future. She added that the judges and clerks are operating at a 100% pace and do a great job at being effective and efficient. Councilmember Buhler asked if the judges are appointed by a judicial nominating committee. Nicole replied yes. The Mayor and Council had no further questions or concerns. B. COUNCIL CALENDAR Mayor Bigelow referenced a Memorandum previously received from the City Manager that outlined upcoming meetings and events. Members of the City Council had no further questions regarding the Council Update. NEW BUSINESS A. POTENTIAL FUTURE AGENDA ITEMS  MINUTES OF COUNCIL STUDY MEETING – OCTOBER 26, 2021 -4- Councilmember Christensen expressed concern about traffic control during events at the Maverik Center. He indicated that he would like to discuss solutions. He noted that Wayne is aware of the problem and is looking at a solution but he would like this to be a communications update in the near future. Councilmember Lang stated that she recalls a significant problem at the Elton John concert and would like to know what was learned and implemented at that time. Councilmember Fitisemanu thanked Wayne for the detailed memorandum on the City’s perspective of HB411. He requested a communication item so that the issue could be discussed publicly and on the record so it is clear where the City stands. Councilmember Buhler, Councilmember Lang, and Councilmember Nordfelt agreed. Wayne stated that staff would get this on the agenda as soon as possible. Councilmember Huynh stated that there was loud music reported to him over the weekend around 1300 West and Parkway Avenue. Wayne replied that he will gather the information and provide to Tom. B. COUNCIL REPORTS N/A MOTION TO ADJOURN Upon motion by Councilmember Buhler all voted in favor to adjourn.
