ZT-5-2018 West Valley City An ordinance amendment to define and create standards for inland port uses. West Valley City Planning staff is requesting a zoning ordinance amendment to define and create standards for inland port uses. 3600 Constitution Blvd. West Valley City, UT 84119-3720 Phone (801) 966-3600 Fax (801) 963-3559 West Valley City Planning Commission October 10, 2018 Page 2 In the 2018 General Session, the Utah Legislature passed S.B. 234 Utah Inland Port Authority. This bill was amended during the 2018 second special session as H.B. 2001 Utah Inland Port Authority Amendments. H.B. 2001 includes the following under Section 11-58-205(5): (a) No later than December 31, 2018, the ordinances of a municipality with authority jurisdictional land within its boundary shall allow an inland port as a permitted or conditional use, subject to standards that are: i. determined by the municipality; and ii. consistent with the policies and objectives stated in Subsection 11-58-203(1). (b) A municipality whose ordinances do not comply with Subsection (5)(a) within the time prescribed in that subsection shall allow an inland port as a permitted use without regard to any contrary provision in the municipality’s land use ordinances. Section 11-58-102(8) defines an inland port as one or more sites that: (a) Contain multimodal transportation assets and other facilities that: i. are related but may be separately owned and managed; and ii. together are intended to: (A) allow global trade to be processed and altered by value-added services as goods move through the supply chain; (B) provide a regional merging point for transportation modes for the distribution of goods to and from ports and other locations in other regions; (C) provide cargo-handling services to allow freight consolidation and distribution, temporary storage, customs clearance, and connection between transport modes; and (D) provide international logistics and distribution services, including freight forwarding, customs brokerage, integrated logistics, and information systems; and (b) may include a satellite customs clearance terminal, an intermodal distribution facility, a customs pre-clearance for international trade, or other facilities that facilitate, encourage, and enhance regional, national, and international trade. Given the requirements in State law, staff is proposing to allow inland port uses on all properties that fall within the Inland Port Authority jurisdictional land boundary, which includes all property within the City that is west of 5600 West and north of the Riter Canal. There are four zones within the Inland Port Authority jurisdictional land boundary – M (manufacturing), (LI) light industrial, A (agricultural) and R-1-12 (single unit dwelling residential, minimum lot size 12,000 square feet). The proposed ordinance allows inland port uses as:  a conditional use in the A and R-1-12 zones if the property is within the Inland Port Authority jurisdictional land boundary and  a permitted use in the LI and M zones if the property is not adjacent to a residential use, residential zone, or agricultural zone and a conditional use when the property is adjacent to a residential use, residential zone, or agricultural zone. Where an inland port use is developed in the A or R-1-12 zone, it shall comply with the requirements applicable to developments in the M zone. Vote: Brent Fuller Yes Commissioner Lovato Yes Chair Meaders Yes Commissioner Porter Yes Commissioner Wood Yes Commissioner Woodruff Yes Unanimous – ZT-5-2018 – Approved S-12-2018 AFFCU 4100 South Subdivision - Amended 4100 South 5600 West C-1 Zone 2 Lots 1.8 Acres BACKGROUND Natalie Nichols, representing America First Credit Union, is requesting a plat amendment for the AFFCU 4100 South Subdivision. The proposed amendment will add an additional lot within the boundaries of the existing lot 1. The subject property is located on the northeast corner of 4100 South and 5600 West. ISSUES: The AFFCU 4100 South Subdivision was recorded with the Salt Lake County Recorder’s Office in March 2016. The original subdivision consisted of 2 lots on 2.8 acres. During the review of the original subdivision, it was suggested that a future potential amendment to lot 1 would be made simply because America First would not need such a large lot for their proposed use. America First recently submitted their application for a new credit union on the corner lot. A determination has been made to divide the original lot into two lots as America First does not need the additional .56 acres. The C-1 zone has a minimum lot size of 20,000 square feet. The newly created lot will be 24,613 square feet and will be located between the America First Credit Union and the Autozone store to the north. Existing utility easements are located on the periphery of these lots, but none exist internally. West Valley City Planning Commission October 10, 2018 Page 4 Access to the site will be gained from 4100 South and from 5600 West. An existing access already exists along 5600 West and will be a shared access for all three lots. Staff is presently processing the Credit Union site plan and will resolve issues related to access along 4100 South with the City Engineering Division. Because this application is a commercial subdivision, staff and agency comments will be better addressed through the conditional use and/or permitted use process. This application is simply to divide the existing lot into 2 lots. STAFF ALTERNATIVES: 1. Approve the AFFCU 4100 South Subdivision Amended Plat subject to a resolution of staff and agency comments. 2. Continue the application to address concerns raised during the Planning Commission hearing. Motion: Commissioner Woodruff moved to approve S-12-2018. Commissioner Porter seconded the motion.
