What is Plan Commission, Public Works, and Board position on requests for private sewer systems and land divisions within the Village and ETZ which are expected to be served by public sewer (and water) in the future? Background The nominal 40 acres (now approximately 33 acres) owned by a Trust of the Barnett family is located at the south end of Old Costa Lane with the Wandering Springs West Plat lying to the north and STH 29 to the south. Over the past year or more the property has been marketed for sale. Village staff has met or had brief discussions with developers interested in the property performing their due diligence to understand development costs. One uncertainty has been whether outlots at the southeast and southwest corners of the Wandering Springs Plat are explicitly dedicated to the Village for street R.O.W. This question also has held up the consideration of vacating the R.O.W. for the future extension of Dominika Street on an unrelated issue with a non-conforming building setback. One of the siblings who is, or has been, a part of the trust, Gary Barnett, has attended Plan Commission meetings over the course of the past 2 years asking for the street R.O.W. question to be resolved. When the property was on the market and during the last quarter of 2020 staff had shared correspondence with Gary Barnett regarding the cost to serve an existing home on the property with public sewer and water as there had been an inquiry as to whether the existing home could remain or another built in its place. The Administrator stopped short of explicitly saying the home needed to be served with public utilities but, in a September e-mail the perspective was stated that development as a subdivision would be the most sensible long-term use for the property. Staff is aware of continued developer interest in the property. Unexpectedly, in December, the Village was contacted by the Marathon County Zoning office regarding the request for a private wastewater system permit. Director Wodalski, after consultation with the Administrator, informed the County that public sewer service is available and, therefore, the request for the private wastewater system permit has been denied. This has prompted a return call and questions from the family member, Lori Vanney, who has proposed to purchase the property. I had a long telephone conversation with Gary Barnett on Friday morning and my understanding is Ms. Vanney plans to use the home as a weekend getaway for the time being until there is a better market for the land. The e-mail string that includes a 1/07 e-mail to Lori Vanney is attached which should frame the situation for Committee, Commission, and Board members. The two questions above should be addressed. There are similar ordinances in other communities in our area and in the state. I would guess that Minnesota would have similar requirements particularly in suburban and urban areas. There are no local ordinances that prohibit you from drilling a well as those permits are issued through the State Department of Natural Resources with the only stipulation that our ordinance says you must be connected to public water for all consumptive purposes when the property is served with public water. A private well can then only be used for lawn and garden watering and it must not be cross connected to interior plumbing.                 Yes, I left a message with your brother Gary today as up until hearing from you before the end of the year Gary had been in attendance at Village Planning Commission meetings with respect to the public right of way provisions to connect streets from the Wandering Springs West Plat (to the north) into the Barnett Trust property. As you can see from the prior e-mails to Gary, it had been our impression this property was being looked at for development as a subdivision and I had stated such. The property is currently zoned Single Family Small Lot. I apologize for not understanding the protocol on who represents the property at this stage.                 There is a need for housing in the Village, and in the central Wisconsin area in general, and your property is situated very well for development with utilities and existing street systems. I have been working toward getting the outlot dedications cleared up and am near the point of completing this. It has been an particularly long drawn out process for various reasons. Now you have proposed to put all that aside to make a single home on the property habitable when the highest and best use would seem to be to create a residential subdivision. Despite your immediate plans you indicate you still expect the Village to assure the R.O.W. is explicitly dedicated for street extensions for the future. This seems contradictory to me and even counterproductive in that there are investments being made to the home that will then add an obstacle to sale of the property for future development. I am curious as to how or why discussion may have broken down between any developers and the family as it was my understanding there was at least one developer talking with the Trust. If the Village could in some way mediate discussions with a developer we would be happy to do so. I would like to have a better understanding of how the thought of selling to a developer was abandoned now as compared to a few months ago or if there might be other options you would want to consider.                 I am not normally of the mind to prevent people from doing what they wish with their property but, by the same token, I am supposed to look out for what is in the Village’s best interests. Zoning, ordinances, and long term land use plans also play a role here.                 Without other background the Village is determining sewer service to be available for the house.    Here is the language from our ordinance as far as the sewer service availability determination. The following language comes from Chapter 86 of the Municipal Code, 86.4.105 Connections to Village Sewage Collection System (1) Connections Required: (a) Persons owning dwellings or other buildings used for manufacturing or trade within the jurisdiction of the Village, that generate domestic and/or industrial wastewater, shall cause such buildings to be connected to the Village Sewage Collection System within one year after the Sewage Collection System is accessible thereto, except as stated in paragraphs (b) and (c) below. (b) Persons owning dwellings or other buildings with pre-existing functioning private sewage systems fronted by a sewer main are not required to connect to the Village Sewage Collection System until 1) said system fails; or 2) upon sale of the property; or 3) 10 years after the property has been fronted by a main extension.. The persons owning and operating the failing private sewage system shall notify the Director of Utilities within 24 hours of system failure and abandon said system in accordance with State, Federal and local regulations and connect to the Village Sewage Collection System within 30 days of system failure. The Appeal Process is described in the copy of the ordinance language, attached. Without additional background I would not recommend the Village staff to take a different position. The next Public Works meeting at which an appeal could be taken up would be February 8, 2021. If we can talk by phone or via Zoom in the next few days that would be great. As I stated in an email to Mike Wodalski, with respect to city sewer and water, I'm simply looking for a written statement from the Village of Weston stating that a connection is not a feasible approach for this particular property. I am currently one of the owners of the property and want to buy out my siblings. In order for me to get a mortgage, I need the house to pass a septic/water test. I had France Sales & Service come out to do a septic evaluation and they determined a new sewer septic system was required. They had me hire Star Environmental to do a soil test to determine what type of sewer system would need to be installed. That cost me $750. After speaking with Dale Diamond last week, he said the Village of Weston requires me to hook up to city sewer if it is available. Apparently, the companies who do septic work locally didn't even know that the Village of Weston had this requirement. No one in my family was aware of this new requirement.   In your email below to my brother Gary, it appears the cost of hooking up to city sewer is $53k. The house on the property is only worth about $80k. What I am requesting is a variance from the Village of Weston that allows me to install an approved septic system on the property this spring so that our family can use the house that we currently own. Please remember that I am a co-owner of the property already. As we discussed on the phone, that means the Village of Weston does not need to be involved in anyway except to provide the variance.   In addition, I want to make sure that all of the issues with outlots are resolved so that should we decide to sell the property at some point, it will be possible to sell it to either an individual or a developer. This property has been owned by my family for over 50 years and we want the freedom to make our own decisions on to whom the property is sold and for what purpose. We want to keep all of our options open.   Can you please provide me with information on what formal steps I need to take to request a variance from the Village of Weston to install an approved septic system so that I may complete the purchase of the property from my siblings this spring? My apologies for letting this estimate sit in my inbox for the last month. This is the estimate to extend 8” water and 8” sewer mains to the existing farm house on your property off Costa Lane - $165,000. If the laterals for future services are taken off the estimate the cost drops by approximately $50,000. Extending smaller diameter service laterals would be in the range of $70,000. The Village does not view maintaining a single home on this property as an effective use of public infrastructure which is readily available to the site. I think you also agree with this assessment. As I indicated in our phone call, Joe Buska has agreed to sign a quit claim deed for the west ½ of outlot 1 on the southeast corner of the plat. Our attorney is following up with Gold Key investments for the other pieces of outlot 1. The Village is taking the position the outlots are dedicated for street extensions as noted on the plat based on legal interpretation as common law dedications. Please call with any other questions. I also have a map attached showing the route and proposed layout used. The existing house is mostly on what is shown as proposed Lot 14. If you look at the estimate, there is roughly $16,000 for sanitary laterals and $25,470 for water laterals as there would be 9 potential lots able to be served by these mains (with the existing house being one of those 9 lots). Also, this is based on connecting at the end of Old Costa. If the connection point were to be the end of Dominika next to the Muzynoski house, the extension would be about 100 ft shorter than connecting on Old Costa, but there would be less potential for future lots to connect using those mains. (d) The forgoing penalties are cumulative and not exclusive. Imposition of any penalty pursuant to this Section does not protect a violator from enforcement by any other unit of government. [Repealed, recreated and renumbered via Ord. No 17-021, 6/21/2017, Amended Ord. No 18-001, 1/20/2018] Section 86.4.116 Appeals. (1) Notice of Appeal. Any User directly aggrieved by any decision of the Village other than a decision arising out of a hearing to show cause under Section 86.4.116(5) may file a notice of appeal with the Public Works and Utility Committee. (a) The notice shall state the grounds upon which the aggrieved User contends the decision should be modified or reversed. (b) The notice shall be received by the Public Works and Utility Committee within thirty (30) days of the decision of the Village. (c) The filing of the notice of appeal shall stay enforcement of the decision pending resolution of the appeal. (d) A fee of $100 shall accompany any appeal. This fee may be refunded if the appeal is sustained in favor of the appellant. (2) Notice of Hearing. Upon receipt of a notice of appeal, the Village will schedule a hearing before the Public Works and Utility Committee and will serve notice of the hearing on the aggrieved User no less than ten (10) days before the hearing date. (a) The hearing notice shall specify the time and place of the hearing. (b) Service of the hearing notice may be made on any agent, officer, or authorized representative of the appellant User. Chapter 86 Utilities Page 70 (3) Authority of Property and Infrastructure Committee. The Public Works and Utility Committee shall have the authority to: (a) Issue notices of hearings requesting the attendance and testimony of witnesses and the production of evidence relevant to any matter involved in the hearings; (b) Take evidence; (c) Issue a decision based on its review of the hearing evidence provided. The Public Works and Utility Committee may set such terms and conditions in its decision as are necessary and appropriate to protect the Sewerage System. (4) Hearing Process. (a) The Public Works and Utility Committee shall preside over a hearing under this subsection and shall take evidence. (b) The User shall have the burden of proof as to why the challenged decision should not be upheld. (c) Any testimony taken must be under oath. A transcript will be made available to any member of the public or any party to the hearing upon request and payment of the usual chargers thereof. Such request must be made within ninety (90) days of the hearing. (5) Judicial Review. Any party to a proceeding under this Section resulting in a final determination may seek review thereof by certiorari within 30 days of receipt of the final determination. (6) Relation to Wis. Stat. Chapter. 68. The Village elects not to be governed by Wis. Stat. Chapter. 68 with respect to this Ordinance. Accordingly, the procedures set forth in this section apply in lieu of those in Wis. Phase New Development in a Manner that Advances Village Objectives The village will utilize the following factors in making growth phasing decisions for, among, and within proposals to develop land in a manner that is otherwise consistent with Map 3-1 and the other recommendations within this Comprehensive Plan: 1. The desire to promote an orderly, sequential pattern of land use and community development in order to ensure that the provision of public services, roads, and utilities keep pace with development. 4.5.3. Attract Families and Young Professionals to Weston Having an available supply of vacant residential lots on which to build a starter or move-up home is critical to attract and retain families. At the time of writing, the village had a dwindling supply of vacant lots, and no significant new subdivision activity in the prior several years. The village will work with residential developers and builders to expand the supply of attractive new home sites in a variety of neighborhood settings. These will include suburban settings common to newer developed areas in the village, along with smaller lots designed to attract young professionals to the community. The Future Land Use map in Chapter 3: Land Use identifies areas that are well-suited for new neighborhood development. Chapter 5 Housing and Neighborhoods 8.4 Policies 2. Promote utilization of existing utility capacity, such as by encouraging development that makes use of existing sewer, water, and road infrastructure (i.e., infill). 5. Except by intergovernmental agreement, extend village sewer and water services only to areas within the Village of Weston limits and Sewer Service Area. 6. Limit the placement of new holding tanks and private septic systems through Section 94.3.03(13) of the village’s Zoning Code. On August 17, 2020, the Weston Board of Trustees approved and awarded the Weston Wayfinding Sign project to Finishing Touch for the total amount of $68,368.00 (plus permits and fees). The preliminary estimated budget for this project was projected at $160,000. The Wayfinding signs were approved to be paid fully by the Weston Room Tax Fund, totaling $106,969.00. The signs were completed on January 8, 2021, with the exception of some minor sign straightening to be revisited in the spring when the ground thaws. During the installation process, there were several signs that needed to be repositioned or reprinted. These signs include the following: • Ross Ave/Fuller St – The arrow direction on the dog park signs were incorrectly approved going the wrong direction. Both signs on Ross Ave had to be reprinted. • Jelinek Ave/Alta Verde St – The sign was incorrectly approved to be positioned directly in front of a speed sign. This sign needed to be moved 15 feet back behind the speed sign. • Ross Ave/Camp Phillips Rd – The signs were incorrectly approved to have the arrow direction on the disk golf and canoe launch pointing down. The sign had to be reprinted to remove disk golf and both down arrows. • Mesker St/Municipal Court – The sign was incorrectly approved on the opposite side of the street. The sign had to be moved closer to the Municipal Court. • County Rd J/Weston Ave – The sign was incorrectly approved with the arrow direction for the Business Park South going the opposite direction. The sign had to be reprinted. • Jelinek Ave/Alderson St – The sign was incorrectly approved on the opposite side of Alderson St for the skate park direction arrow. The sign had to be moved. The Weston Wayfinding contract reads “Investments do not include permit fees or sales tax and are based on completing job in one trip.” Due to the minor changes and repositioning of the signs resulting in additional trips for Finishing Touch, the cost for the Wayfinding project installation increased by $3,075.00 Staff is bringing this item forward to authorize payment of the Wayfinding sign project at $71,443 instead of $68,368.
