Monday, February 6, 2023 Wetumpka City Council Chambers 6:00 p.m. Work Session: Citizen Comments: (Ordinance 2016-8) Reports of: Boards and Committees Agenda Items Council Meeting Monday, February 6, 2023 Wetumpka City Council Chambers 6:07 p.m. The Council of the City of Wetumpka held a work session prior to the 6:00 p.m. council meeting held on Monday, February 6, 2023. The meeting was called to order by Mayor Jerry Willis at 6:07 pm. Councilmember Robbins led the invocation and Councilmember Justiss led the Pledge of Allegiance. Upon a Roll Call the following were present: Mayor Jerry Willis and Councilmembers Cheryl Tucker, Kevin Robbins, Steve Gantt, Lynnes Justiss and Joe Brown were in attendance. Also present were City Clerk Tiffany Robinson and other staff members. Councilmember Justiss offered a motion to approve the minutes of the Council Meeting held on January 17, 2023 as presented. The motion was seconded by Councilmember Tucker with the Council voting unanimously in favor of the motion. Under old business, Public Hearing for Ordinance to amend the zoning ordinance 99-4 to rezone parcel lying and being situated in the East Half of Section 14, Township 18 North, Range 18 East, Elmore County, Alabama and contains 15.00 acres more or less from RH to B-2 was opened. No one spoke against. John Stanley spoke in favor. The public hearing was closed. Under old business, Councilmember Gantt made a motion to suspend second read of Ordinance 2023-1 to amend the zoning ordinance 99-4 to rezone parcel lying and being situated in the East Half of Section 14, Township 18 North, Range 18 East, Elmore County, Alabama and contains 15.00 acres more or less from RH to B-2. Councilmember Brown seconded the motion with the Council voting unanimously in favor. Under old business, Councilmember Justiss made a motion for Ordinance 2023-1 to amend the zoning ordinance 99-4 to rezone parcel lying and being situated in the East Half of Section 14, Township 18 North, Range 18 East, Elmore County, Alabama and contains 15.00 acres more or less from RH to B-2. Councilmember Robbins seconded the motion with the Council voting unanimously in favor.  Ordinance No. 2023-1 Amendment to Zoning Ordinance BE IT ORDAINED BY THE COUNCIL OF THE CITY OF WETUMPKA, ALABAMA, AS FOLLOWS: SECTION 1. That Zoning Ordinance No. 99-4 and Map of the City of Wetumpka adopted September 2, 1999, be and the same is hereby amended by rezoning the following described lands situated in the City of Wetumpka from R-H to B-2. STATE OF ALABAMA} ELMORE COUNTY} Commence at the Northeast Corner of Section 14 Township 18 North, Range 18 East, Elmore County, Alabama; thence South 1degree 15' 38" West a distance of 1829.97 feet to an iron pipe lying on the West right-of-way line of Coosa River Parkway, being the Southeast Corner of Chapel Lakes Plat No. 1, as recorded in the Office of the Judge of Probate of Elmore County, Alabama, in Plat Book 16, at Page 42, and being the Point-of-Beginning for the following described Parcel: From the Point-of-Beginning; thence continue along the West right-of-way line of Coosa River Parkway along a curve to the left (having a radius of 3399.04 feet, a chord bearing of South 00°12'41" West, a chord distance of 596.89 feet) an arc distance of 597.66 feet to an iron pipe; thence South 04°49'00" East a distance of 206.88 feet to an iron pipe; thence along a right-of- way taper South 43°06'22" West a distance of 134.06 feet to an iron pipe lying on the North right-of-way line of Gossum Switch Road; thence along North right-of-way line North 88°58'56" West a distance of 436.16 feet to an iron pipe; thence along a curve to the right (having a radius of 4053.53 feet, a chord bearing of North 87°28'40" West, a chord distance of 209.01 feet) an arc distance of 209.03 feet to an iron pipe; thence leaving said North right-of-way line of Gossum Switch Road North 01°30'19" West a distance of 411.05 feet to an iron pipe; thence continue North 01 °30'19" West a distance of 436.40 feet to an iron pipe lying on the South boundary line of Chapel Lakes Plat No. 1, as recorded in the Office of the Judge of Probate of Elmore County, Alabama, in Plat Book 16, at Page 42; thence along said South boundary line South 88°58'56" East a distance of 50.00 feet to an iron pipe; thence North 01°38'44" West a distance of 50 feet to an iron pipe; thence South 88°58'56" East a distance of 695.16 feet to an iron pipe lying on the West right-of-way line of Coosa River Parkway and the Point-of- Beginning. Lying in the East Half of Section 14, Township 18 North, Range 18 East, Elmore County, Alabama and containing 15.00 acres, more or less. The above foregoing description is based upon a survey dated July 14, 2008, prepared by Ronald L. Bell, Ala. Reg. No. 10689. Said property is owned by Alabama Home Builders Self Insurers Fund. Barrett. Councilmember Gantt seconded the motion with the Council voting unanimously in favor. Under new business, Ordinance 2023-2, adjusting the boundaries of Council Districts. This was read for the first time and will return to the next agenda. Under new business, Councilmember Tucker made a motion for permission to hire a part- time Cultural Museum Curator III for the Black History Museum. Councilmember Justiss seconded the motion with the Council voting unanimously in favor. Under new business, Councilmember Brown made a motion to suspend the rules and consider permission for the Police Department to renew the subscription to LEADS Online as presented by Chief Benton. Councilmember Gantt seconded the motion with the roll call vote as follows; Councilmember Robbins yes Councilmember Tucker yes Councilmember Justiss yes Councilmember Gantt yes Councilmember Brown yes Mayor Willis yes Under new business, Councilmember Robbins made a motion for permission for the Police Department to renew the subscription to LEADS Online as presented by Chief Benton. Councilmember Brown seconded the motion with the Council voting unanimously in favor.  Under new business, Councilmember Gantt made a motion for surplus equipment to be auctioned at JM Wood Auction Company during March 21-24, 2023 Auction in Montgomery with a minimum guarantee of $78,500 as presented by J. Barrett. Councilmember Brown seconded the motion with the Council voting unanimously in favor. Under new business, permission to purchase two John Deere Tractors from ALDOT Equipment Bureau ($120,600) as presented by J. Barrett. This was heard for the first time and will return to the next agenda. Under new business, purchase of 15-foot batwing rotary cutter from Sourcewell pricing ($25,425.70) as presented by J. Barrett. This was heard for the first time and will return to the next agenda. Under new business, permission to repair AC Unit at Elmore County Museum at a cost of $5489 as presented by C. Brown. This was heard for the first time and will return to the next agenda. Under new business, permission to repair AC Unit at Black History Museum at a cost of $5489 as presented by C. Brown. This was placed on hold to receive another quote for replacement. Under new business, Councilmember Gantt made a motion to reappoint Tucker Robinson 2/28 and Todd Ayers 2/26 and appoint Laurie Hutchinson 2/26, William Pierce 2/28 and special ex-officio Dennis Fain to the Downtown Redevelopment Authority. Councilmember Justiss seconded the motion with the Council voting unanimously in favor. Under new business, Councilmember Justiss made a motion to reappoint Bobby Barrett 2/28 and Johnny Cooper 2/28 and appoint Andrew McMichael 2/28, Rob Weighall 2/28 and Robert Hankins 2/28 to the Industrial Development Board. Councilmember Brown seconded the motion with the Council voting unanimously in favor. Upon a motion by Councilmember Gantt, the meeting was adjourned at 6:22 p.m. Approved by Council on the 21 day of February, 2023.
