Tuesday, February 21, 2023 Wetumpka Admin Building Noon Work Session: Citizen Comments: (Ordinance 2016-8) Reports of: Boards and Committees Agenda Items Council Meeting Tuesday, February 21, 2023 Wetumpka Admin Building Noon The Council of the City of Wetumpka held a work session prior to the 12:00 p.m. council meeting held on Tuesday, February 21, 2023. The meeting was called to order by Mayor Pro Tem Kevin Robbins at 12:23 pm. Councilmember Brown led the invocation and Councilmember Tucker led the Pledge of Allegiance. Upon a Roll Call the following were present: Councilmembers Cheryl Tucker, Kevin Robbins, Steve Gantt, and Joe Brown were in attendance. Mayor Jerry Willis and Councilmember Lynnes Justiss were absent. Also present were City Clerk Tiffany Robinson and other staff members. Councilmember Brown offered a motion to approve the minutes of the Council Meeting held on February 6, 2023 as presented. The motion was seconded by Councilmember Tucker with the Council voting unanimously in favor of the motion. Under old business, Councilmember Gantt made a motion to suspend the second reading of Ordinance 2023-2, an ordinance adjusting the boundaries of Council Districts. Councilmember Tucker seconded the motion with the Council voting unanimously in favor of the motion. Councilmember Tucker made a motion to approve Ordinance 2023-2, an ordinance adjusting the boundaries of Council Districts. Councilmember Brown seconded the motion with the Council voting unanimously in favor of the motion. ORDINANCE 2023-2 AMENDING ORDINANCE 2016-4 ADJUSTING THE BOUNDARIES OF COUNCIL DISTRICTS  WHEREAS, §11-44F-2 of the Code of Alabama, 1975, as amended, authorizes the City Council to establish the boundaries of the Council Districts; and WHEREAS, the City of Wetumpka is divided into five (5) Council Districts each District shall be formed of contiguous compact territory; and WHEREAS, the City Council, upon reviewing the 2020 Census data, has determined that changes in the population of each District warrant adjustments to the district boundaries to ensure equality in the voting process. NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WETUMPKA, ALABAMA, AS FOLLOWS: SECTION 1. Ordinance 2016-4 amending section 34-2 of the Wetumpka Code of Ordinances is deleted in its entirety and replaced as follows: C. Sec. 34-2. District Boundaries. Pursuant to the authority contained in 11-46-23, Code of Alabama 1975, the City Council of the City of Wetumpka, Alabama, does hereby readjust and reestablish the boundary lines of the five (5) Council Districts of the City and the territory composing each such District for purposes of City Council elections such that hereafter, said Districts shall be and are described using census blocks. The legal description for the five (5) Council Districts described in Ordinance 2016-4 is re-described from metes and bounds to now be described by the 2020 census blocks attached hereto as Exhibit A. SECTION 2. In accordance with the requirements of Section 11-46-23, Code of Alabama, 1975, the City Clerk is hereby directed to file a certified copy of this ordinance with the Judge of Probate of Elmore County, Alabama together with a map of the City depicting the Voting Districts as herein divided and described. SECTION 3. This Ordinance shall become effective upon its publication one (l) time in the Wetumpka Herald, a newspaper of general circulation published in Elmore County, Alabama. SECTION 4. All other sections or provisions of the Code of Ordinances of the City of Wetumpka, Alabama, not specifically amended herein remain in full force and effect. SECTION 5. Should any section or provision of this Ordinance or the Code of Ordinances of the City of Wetumpka, Alabama, be held invalid, such holding shall not affect the validity of any section or provision thereof which are not of themselves invalid. SECTION 6. This Ordinance shall become effective upon its adoption and publication as required by law. ADOPTED AND APPROVED THIS 21 DAY OF February, 2023.  Councilmember Gantt made a motion to approve the purchase of two John Deere Tractors from ALDOT Equipment Bureau at a cost of $120,600. Councilmember Brown seconded the motion with the Council voting unanimously in favor of the motion. Councilmember Tucker made a motion to approve the purchase of a 15-foot batwing rotary cutter from Sourcewell pricing at $25,425.70. Councilmember Brown seconded the motion with the Council voting unanimously in favor of the motion. Councilmember Gantt made a motion to approve repair AC Unit at Elmore County Museum at a cost of $5489. Councilmember Brown seconded the motion with the Council voting unanimously in favor. Under new business, Councilmember Brown made a motion to suspend the rules and consider the replacement of the AC Unit at the Black History Museum at a cost of $5489. Councilmember Tucker seconded the motion with the roll call vote as follows; Councilmember Robbins yes Councilmember Tucker yes Councilmember Gantt yes Councilmember Brown yes Councilmember Brown made a motion to the replace the AC Unit at the Black History Museum at a cost of $5489. Councilmember Tucker seconded the motion with the Council voting unanimously in favor. Councilmember Gantt made a motion to approve the 2022 Sage software upgrade. Councilmember Tucker seconded the motion with the Council voting unanimously in favor of the motion. The purchase of asphalt for pickleball courts was on the agenda for the first time and will return to the next agenda. The purchase of light poles for S. Main St. was on the agenda for the first time and will return to the next agenda. Under new business, Councilmember Gantt made a motion to approve Resolution 2023- 2-21-1, Lease Capitalization Policy. Councilmember Tucker seconded the motion with the Council voting unanimously in favor. RESOLUTION 2023-2-21-1  WHEREAS, The Governmental Accounting Standards Board (GASB) was organized to establish standards of financial accounting and reporting for state and local governmental entities; and WHEREAS, the mission of GASB is to establish and improve standards which will result in useful information for users of financial reports and guide and educate the public, auditors and users of those financial reports; and WHEREAS, the City of Wetumpka is currently in the process of implementing GASB 87 as required by the standard; and WHEREAS, a Lease Capitalization Policy is required; NOW, THEREFORE, BE IT RESOLVED that the Policy of the City of Wetumpka shall be as follows: 1. All lease liabilities with an initial, individual value of $50,000 or more shall be subject to capitalization. 2. All lease receivables with an initial, individual value of $50,000 or more shall be subject to capitalization. This policy shall be retroactive to October 1, 2021. Adopted and approved on this the 21st day of February, 2023. Under new business, Councilmember Brown made a motion to suspend the rules and consider the approval to enter into a roof consulting agreement with Roof Asset Management to bid the Administrative Building roof. Councilmember Gantt seconded the motion with the roll call vote as follows; Councilmember Robbins yes Councilmember Tucker yes Councilmember Gantt yes Councilmember Brown yes Councilmember Gantt made a motion to approve entering into a roof consulting agreement with Roof Asset Management to bid the Administrative Building roof at a cost of $5450. Councilmember Brown seconded the motion with the Council voting unanimously in favor of the motion. Councilmember Gantt made a motion to grant permission for Michael Proctor to host Beat the Streets at Gold Star Park on September 30, 2023. Councilmember Brown seconded the motion with the Council voting unanimously in favor of the motion.  Councilmember Brown made a motion to grant permission for the Elmore County Civic Improvement League to host the Annual Juneteenth Celebration on June 17, 2023. Councilmember Tucker seconded the motion with the Council voting unanimously in favor of the motion. Councilmember Gantt made a motion to add a fire station change order to the agenda. Councilmember Brown seconded the motion with the roll call vote as follows; Councilmember Robbins yes Councilmember Tucker yes Councilmember Gantt yes Councilmember Brown yes Councilmember Gantt made a motion to suspend the rules and consider the fire station change order for stormwater extension, waterline extension and underground power at a cost of $83,466.16. City Attorney, Justin Edwards, recommended entering into executive session for approximately 15 minutes to discuss potential litigation. Councilmember Brown made a motion to enter into executive session. Councilmember Gantt seconded the motion with the Council voting unanimously in favor of the motion. The meeting was called back to order at 12.55 p.m. Upon a motion by Councilmember Gantt, the meeting was adjourned at 12:55 p.m. Approved by Council on the 6th day of March, 2023.
