for a new three family dwelling. A review of drawings A-1 through A-4, dated
November 21,2016, prepared by DeVita Architects, indicates the proposed
construction of a three(3) family dwelling. The existing building lot is located in
the RM-2.5 Zone and is non-conforming with respect to minimum lot area of
5,000 square feet. The proposed construction will require the following area
variances:

for a new convenience store. A review of the drawings prepared by Norman
DiChiara Architect, dated June 6, 2017, indicates the construction of a new 990
square foot accessory convenience store building to replace the existing smaller
one. The premises are located in the B-3 Zone where a motor vehicle service
station is a special permit use per Section 5.1 Use Regulations. The approving
agency for such special permit is the Board of Appeals. The proposed
convenience store building accessory to the existing service station will require an
amendment to the special permit.

Application for an addition. A review of drawings A-1 and A-3 to A-6 prepared
by Jacob J. Goldberg, Architect, indicates a proposed two (2) story side yard
addition. The property is located in the R1-5 Zone and is legally existing non-
conforming with respect to one side yard, front and rear yard setbacks. Area

Application for a new parking garage. A review of drawings A1 to A5 dated
September 6, 2017 and SP-1 to SP-14 with revision date of September 8, 2017
indicates the proposed construction of a three (3) level parking garage with above
garage solar array and guard booths . The premises are located in the C-O Zone
where a parking garage is a permitted accessory use. The site is environmentally
sensitive and is subject to the regulations of Section 4.4.25. The approving
agency for this use, per Section 7.2 of the Zoning Ordinance, is the Common
Council. However, per Section 7.4.4 , the application is deemed incomplete since
it does not comply with all the Regulations of the Zoning Ordinance. The
application does not comply with All Building Coverage per Section 5.3 Schedule
of Dimensional Regulations. The height of the solar array is permitted per
Section 4.4.15.5 of the White Plains Zoning Ordinance. Therefore, the following
area variance is requested:

legalization of a deck. A review of deck design plans by Home Depot and a
survey dated August 22, 2017 indicates the construction of a 24" high side yard
deck. The premises are located in the R1-5 Zone. The deck was built without
benefit of a building permit and must be legalized. However, since the deck does
not comply with Section 4.4.14.3 of the White Plains Zoning Ordinance the
following area variance is required:
