Z-2017-13 Marianina Corp./ Frank Codella, 34 East Post Road, SBL 130.27-2-4. Application
for a new convenience store. A review of the drawings prepared by Norman
DiChiara Architect, dated June 6, 2017, indicates the construction of a new 990
square foot accessory convenience store building to replace the existing smaller
one. The premises are located in the B-3 Zone where a motor vehicle service
station is a special permit use per Section 5.1 Use Regulations. The approving
agency for such special permit is the Board of Appeals. The proposed
convenience store building accessory to the existing service station will require an
amendment to the special permit.
Z-2017-18 Mr. & Mrs. Adam Oliveri, 47 Ethelridge Road, SBL 138.06-5-8. Application
for an addition. A review of Drawings A-1 to A-5 with a received date of
August 11, 2017, prepared by John Scarlato Jr. R.A., indicates a one and two
story addition. The property is located in the R1-12.5 Zone and is legally existing
non-conforming with respect to lot area, lot frontage and side yard setbacks. The
proposed addition will require the following area variances:

Application for signage. A review of architectural drawings and sign package
renderings indicates the proposed installation of exterior wall signs for the above
referenced location. The proposed sign locations are not in compliance with the
City of White Plains Sign Ordinance and require the following variances: two (2)
wall signs proposed where the Ordinance permits only one (1) wall sign to be
permitted for each building on a public street frontage except in the case of a
multi-tenant retail building. In addition, the placement of signs that do not
comply with the Ordinance requiring wall sign to be located only on building
walls facing street frontage or a facing that has direct public access from a public
or quasi-public area.
Z-2018-1 Mr. & Mrs. Noah Estrin, 58 Winslow Road, SBL 130.15-2-5. Application for
an addition and alteration. A review of architectural drawings dated
November 17, 2017, prepared by Taylor-Viazzo Architects indicates a proposed
two (2) story rear yard addition. The property is located in the R1-12.5 Zone and
is legally non-conforming with respect to one (1) and combined two (2) side yard
setbacks. The proposed addition will increase the non-conformities and require
the following area variances:

Z-2018-2 Mr. Michael Verrelli, 41 Cleveland Street, SBL 125.72-9-4. Application for
reconstruction of front porch. A review of drawings T-1, SP-1, A-1 and A-2 dated
November 14, 2017, prepared by RFA & Associates, indicates the reconstruction
of the dimensionally non-conforming front porch. The two (2) family dwelling is
located in the R2-4 Zone and is legally non-conforming with respect to building
coverages, lot area per dwelling unit, lot frontage, front yard setback and side yard
setbacks. The applicant wishes to reconstruct the partially open front porch into a
fully open front porch to the same dimensions in accordance with Section 4.3.4.2
of the White Plains Zoning Ordinance. However, the drawings indicate that the
front stairs will be moved to the north to a dimension of 2'-0" off the northerly
side yard lot line. Since the stairs are proposed to be within 5'-0" of the side lot
line, the applicant requests a variance to Section 4.4.14.3 of the Zoning
Ordinance. The existing setbacks of the front porch structure are:

Application for a new building. A review of drawings C-000, C-010, C-100,
C-110 and C-220 dated December 15, 2017, prepared by JMC, PLLC, indicates a
proposed five (5) story Senior Living Apartment Residence with associated
parking garage. The property is located in the B-1 Zone where maximum building
height is four (4) stories and 50 feet. Therefore, the applicant requests the
following area variances:

Z-2018-4 Dr. Ira Kotler, 10 Old Mamaroneck Road, SBL 130.36-8-5. Application for
change of tenancy. A review of your building permit application and attached
floor plan indicates the present first floor suite is an office space for physician and
dentist under a Special Permit Use. The office suite is located in a Multi-Family
Residential Dwelling in the RM-0.35 Zone. Unable to sell the space to another
physician or dental practice, the applicant requests a use variance in order to offer
the space to be used as a Business or Professional Office of professional persons,
which is not a permitted use in this Zone.
Z-2018-6 CJ Developers LLC, 32 Independence Street, SBL 125.72-4-23. Application
for garage conversion. A review of Drawing A-1 dated January 3, 2018, prepared
by Stephen Marchesani, R.A., indictaes the proposed conversion of the existing
attached garage into habitable space. The conversion to a master bedroom will
eliminate one parking space and result in violation of Section 8.6.1.4 of the White
Plains Zoning Ordinance which limits parking in the front yard. Specifically,
parking is prohibited in the front yard unless it is immediately contiguous to and
an extension of a garage which is integral with the residence. The premises are
located in the R2-4 Zone and are legally existing non-conforming with respect to
main building coverage, lot area, frontage and side yard setbacks. The proposed
conversion will require the following area variances:

Z-2018-7 White Plains Healthcare Properties, 120 Church Street, SBL 125.67-3-1.
Appliation for a retaining wall. A review of drawings RW-1.0 to RW-6.0 dated
September 1, 2017 and SRW design calculations dated October 16, 2017,
prepared by ERS, indicate the construction of a segmented retaining wall (SRW)
along the easterly property line. The wall exceeds the height limits of Section
4.4.16 of the White Plains Zoning Ordinance for nearly half its length. In
addition, the vehicle guard constructed on top of the wall along the access
driveway of the neighboring property is solid and not of 3/4 open construction.
Therefore, the applicant requests a variance of Section 4.4.16 for the retaining
wall.
