A review of drawing A-100.00 dated August 8, 2019, prepared by Hammond Architecture, indicates the legalization of a non-conforming rear yard deck. The property is located in the R1-5 Zone and is legally existing non- conforming with respect to front yard and one side yard setback. A rear yard deck, built without benefit of a building permit, was constructed and joined to the existing side yard deck. A review of Drawing A-100, dated June 20, 2018, prepared by John Scavelli, P.E., indicates construction of a new side yard deck to replace existing. The property is located in the R1-5 Zone and is legally existing non- conforming with respect to side yard setbacks. The proposed deck will be larger than the existing and will increase the combined two side yard setback non-conformity. Section 4.3.3 of the White Plains Zoning Ordinance states that no permit shall be issued that will result in the increase of such dimensional non-conformity. In addition, Section 4.3.4.2 states that a non-conformity may be reconstructed provided it is in accordance with a plan approved by the Board of Appeals and further, where reasonable, it is reconstructed in greater conformity with the Zoning Ordinance. The proposed deck construction will not comply with the Zoning Ordinance regulations for a dimensionally non-conforming structure and will require a variance from those listed sections as well as the following area variance: Required Existing Proposed Variance 1.
