Application to construct an addition. A review of drawings A-1 through A-9 dated October
16, 2023, prepared by Jacob J. Goldberg, Architect, indicates a two (2) story rear yard
addition. The property is located in the R1-5 Zone and is legally existing, non-conforming
with respect to front yard, one (1) side yard, and combined two (2) side yard setbacks. The
proposed addition will increase the side yard non-conformities and will require the
following area variances:

1. One (1) Side Yard Setback 7’-0” 6.2’ 6.2’ 0.8’
2. Combined Two (2) Side

Architects, indicates a proposed one (1) story addition to the existing four (4) story building
located at 99 Church Street, and conversion of 6 Cottage Place and 99 Church Street to
residential uses. The property is located in the CB-3 Zone, and is legally existing, non-
conforming with respect to front yard setback. The proposed one (1) story addition will
increase this non-conformity and Section 5.5.3.1 of the White Plains Zoning Ordinance.
Therefore, the applicant requests the following area variance:

Application to erect a sign. A review of the survey dated August 29, 2023, prepared by
Gabriel Senor, P.C. and renderings 1 and 2 by Sign Design, indicate the proposed location
of a ground sign 0’-6” inside the front property line. Section 9-10-42 of the Sign Ordinance
requires ground signs to be set back six (6) feet from the property line(s). The Board of
Appeals is authorized by Section 9-10-19 to hear an appeal of the determination by the
Commissioner of Building. Therefore, the following variance is requested:

Application to legalize a deck. A review of drawings A-1 and A-2 dated August 30, 2023,
prepared by Gabrielle Salman Architect, indicates the legalization of a rear yard deck that
was rebuilt slightly larger than existed. The previous curved deck was granted a five (5)
foot rear yard variance on November 1, 1995. The property is located in the R1-7.5 Zone,
is an environmentally sensitive site, and is legally existing, non-conforming with respect
to one (1) side yard and rear yard setbacks. The deck reconstruction increased the rear yard
non-conformity and will require the following area variance:
