A Special Meeting of the Common Council held Monday, January 29, 2024, called for six thirty o’clock in the Common Council Chamber Mayor Roach presiding and the following members present: Mr. Brasch, Mr. Frei- Pearson, Mr. Martin, Mr Payne, Ms. Presser, Mrs. Puja. Council President Presser requested unanimous consent to add a motion to enter into executive session to the agenda. Mr. Martin seconded the motion. ROACH t: 914.422.1411 MAYOR f: 914.422.1395 TO THE HONORABLE MEMBERS OF THE COMMON COUNCIL In accordance with the authority granted to the Mayor as the Chief Executive Officer under the Taylor Law, Civil Service Law § 200 et seq., representatives of the City have conducted negotiations for a new labor contract with the Civil Service Employees Association, Inc., Local 1000, AFSCME, AFL‐CIO for the City of White Plains Unit. As a result of these negotiations, the parties have entered into a stipulation of agreement which extends the collective bargaining agreement that ends on June 30, 2024 for two years through June 30, 2026. Council President Presser asked unanimous consent to offer an ordinance entitled, “Ordinance of the Common Council of the City of White Plains approving and ratifying the December 13, 2023 Stipulation of Agreement between the negotiating representatives of the City of White Plains and the Civil Service Employees Association, Inc., Local 1000, AFSCME, AFL-CIO for the City Of White Plains Unit; and authorizing the Mayor to enter into a collective bargaining agreement containing the terms of the December 13, 2023 Stipulation of Agreement." Unanimous consent granted. Council President Presser moved adoption of the following Ordinance.  AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF WHITE PLAINS APPROVING AND RATIFYING THE DECEMBER 13, 2023 STIPULATION OF AGREEMENT BETWEEN THE NEGOTIATING REPRESENTATIVES OF THE CITY OF WHITE PLAINS AND THE CIVIL SERVICE EMPLOYEES ASSOCIATION, INC., LOCAL 1000, AFSCME, AFL-CIO FOR THE CITY OF WHITE PLAINS UNIT AND AUTHORIZING THE MAYOR TO ENTER INTO A COLLECTIVE BARGAINING AGREEMENT CONTAINING THE TERMS OF THE DECEMBER 13, 2023 STIPULATION OF AGREEMENT. WHEREAS, representatives of the City of White Plains (the "City") and the Civil Service Employees Association, Inc., Local 1000, AFSCME, AFL-CIO for the City of White Plains Unit (the "CSEA") have reached a tentative agreement to extend the prior collective bargaining agreement that covers the period July 1, 2021 through June 30, 2024, upon the same terms and conditions, except as specifically modified in the December 13, 2023 Stipulation of Agreement by and between the negotiating representatives of the City and the CSEA, for a period of two years from July 1, 2024, up to and including June 30, 2026; and WHEREAS, the CSEA, by a majority vote of its membership, ratified the tentative Agreement on January 25, 2024; and WHEREAS, the spirit of the Agreement calls for the City to implement the terms of the Agreement as soon as possible. NOW, THEREFORE, the Common Council of the City of White Plains hereby ordains and enacts as follows: Section 1. The Stipulation of Agreement entered into December 13, 2023, by and between the representatives of the City and the CSEA, and set forth below, is hereby approved and ratified by the Common Council:  STIPULATION OF AGREEMENT made and entered into this 13th day of December 2023, by and between the negotiating representatives for the City of White Plains and the White Plains Housing Authority ( collectively "the Employer") and the Civil Service Employees Association, Inc., Local 1000, AFSCME, AFL-CIO, City of White Plains Unit ("the Union"). WHEREAS, the parties have engaged in negotiations in good faith in an effort to arrive at a successor collective bargaining agreement to the one that expires on June 30, 2024; and WHEREAS, the parties have arrived at a tentative agreement; NOW, TIIBREFORE, in consideration of the mutual covenants contained herein, the parties hereby stipulate and agree as follows: 1. The provisions of this Stipulation are subject to ratification by the Union's membership by no later than 11:59 p.m. on January 25, 2024 and ratification and approval by the Common Council of the City of White Plains and the White Plains Housing Authority Board. 2. The respective negotiating committees' representatives agree to recommend this Stipulation for ratification/approval. 3. A copy of this original document has been furnished to representatives of the Employer and the Union. 4. All proposals not covered herein made by either party during the course of the negotiations will be deemed dropped. 5. Following the complete ratification and approval of this Agreement, the Employer will deliver to the Union's chief negotiator a typed draft of the new contract. The Union will have 30 calendar days from the chief negotiator's receipt of the draft within which to provide the Employer, in writing, with a completeilist of all objections to the draft.  6. Article (I)(A) Recognition). Effective July 1, 2024, add Legislative Aide to the list of excluded positions. 7. Article lll(l)(A)(l. 2). l(B). 2(A), (3. 4) (Wage Increases). Effective July 1, 2024, each step on the relevant salary schedule will be increased by 3%. Effective July I, 2025, each step on the relevant salary schedule will be increased by an additional 3%. 8. Article IV(2)(A)( I) (General Holidays). Effective January l, 2024, add Juneteenth and delete Lincoln's Birthday. 9. Article IV(2)(B) (Holidays: School Cros ing Guards). During only the period January I, 2024-June 30, 2024, delete Washington's Birthday and add Juneteenth. Effective July 1, 2024, maintain Juneteenth, restore Washington's Birthday and delete Election Day. 10. Article V(4) (Dental Insurance). Effective July 1, 2024, the dental contribution rate will be increased by $25 over the June 30, 2024 rate per unit member. Effective July 1, 2025, the dental contribution rate will be increased by $25 over the June 30, 2025 rate per unit member. 11. Article XIII (Tenn of the Agreement). Revise to read: "This Agreement will be  Section 2. Section 3. The Mayor is hereby authorized to enter into a collective bargaining agreement with the CSEA, which agreement shall be based upon the December 13, 2023 Stipulation of Agreement, as set forth above. The Mayor granted the pleasure of the floor to the Commissioner of Public Works, Stefania Mignone, to discuss the following Capital Projects Renovations to City Facilities FY24, Library LED Lighting Improvements, Transcenter Fire System Upgrade, Municipal Parking Structure Study, and Downtown Planters. ROACH MAYOR TO THE HONORABLE MEMBERS OF THE COMMON COUNCIL OF THE CITY OF WHITE PLAINS The Capital Projects Board has recommended a capital project for Renovations to City Facilities to correct structural problems and lower maintenance costs in the amount of $275,00, which was adopted at the August 7, 2023 council meeting. The Capital Project Board has recommended an additional $100,000, increasing the project to a total cost of $375,000. Submitted herewith is legislation which would authorize the Mayor to direct the Commissioner of Public Works to enter into various contracts to undertake the renovations at various City facilities. The legislation also authorizes the Mayor to direct the Budget Director to amend the Operating Budget and also to amend the Capital Projects Fund by amending Capital Project No. C5623, entitled “Renovations to City Facilities FY24,” as follows: INCREASE REVENUES A021-09999 Appropriated Fund Balance $100,000 INCREASE EXPENDITURES A022-9.401 Contribution to Capital Projects Fund $100,000 Original Revised Budget Amended Budget REVENUES C5623-09910 General Fund Contribution $275,000 $100,000 $375,000 EXPENDITURES C5623-8.106 Major Additions-Improvements $275,000 $100,000 $375,000 It is requested that the Mayor be authorized to direct the Commissioner of Finance to receive and disburse funds accordingly. The Library has received a grant from the New York State Education Department in the amount of $72,787 and the remaining cost of $77,213 will be funded by a contribution from the General Fund. Submitted herewith is legislation which would authorize the Mayor to direct the Commissioner of Public Works to enter into various contracts as required to complete the capital improvements. The attached legislation authorizes the Mayor to direct the Budget Director to amend the Operating budget and the Capital Projects Fund by establishing Capital Project No. C5635, entitled “Library LED Lighting Improvements” as follows: INCREASE REVENUES: A021-09999 Appropriated Fund Balance $77,213 INCREASE EXPENDITURES: A022-9.401 Contribution to Capital Projects Fund $77,213 REVENUES: C5635-02256 NYS Education Department $ 72,787 C5635-09910 General Fund Contribution 77,213 $150,000 EXPENDITURES: C5635-8.106 Major Additions/Improvements $150,000 It is further requested the Mayor be authorized to direct the Commissioner of Finance to advance funds from the General Fund to this project pending the receipt of the grant proceeds. ROACH MAYOR TO THE HONORABLE MEMBERS OF THE COMMON COUNCIL OF THE CITY OF WHITE PLAINS The Capital Projects Board has recommended the inclusion of Transcenter garage fire system upgrade, at an estimated cost of $350,000. This project includes replacement of the current fire alarm system and related equipment. Submitted herewith is legislation which would authorize the Mayor to direct the Commissioner of Public Works to enter into various contracts, as required, to complete these capital improvements. The attached legislation authorizes the Mayor to direct the Budget Director to amend the Capital Projects Fund by establishing Capital Project No. C5636 entitled “Transcenter Fire System Upgrade,” as follows: REVENUES C5636-08810 Serial Bonds $353,500 EXPENDITURES C5636-4.005 Finance and Auditing $ 3,500 C5636-8.106 Major Additions-Improvements 350,000 $353,500 It is further requested that issuance of $353,500 in serial bonds be authorized and that the Mayor be authorized to direct the Commissioner of Finance to advance funds to this project from the General Fund, pending the receipt of the bond proceeds.
