Smayda The Special Meeting of the Common Council called for Tuesday, July 22, 2014 at five thirty o'clock in the evening in the Common Council Chamber, Municipal Building. Mayor Roach presiding and the following Members present: Mrs. Hunt-Robinson, Mr. Martin, Mrs. Lecuona, and Mrs. Smayda. Absent: Mr. Kirkpatrick, Mr. Krolian and Mr. Martin. ________ The Special Meeting was called in relation to a petition submitted on behalf of Urstadt Biddle, Properties, Inc., to amend the Zoning Ordinance of the City of White Plains and the Zoning Map to reclassify 60 South Broadway (currently the Westchester Pavilion), from B-6 Enclosed Mall Zoning District to the CB-3 Central Business 3 District, and to extend the Central Parking Area to include the site, and to chedule a public hearing for August 4, 2014. ________ Communication from Corporation Counsel. Mrs. Smayda moved that it/they be filed and spread in full upon the minutes. Mrs. Hunt-Robinson seconded the motion. Carried. TO THE HONORABLE MAYOR AND MEMBERS OF THE COMMON COUNCIL OF THE CITY OF WHITE PLAINS At its June 3, 2013 meeting, the Common Council received and referred a petition on behalf of Urstadt Biddle Properties, Inc. ("Applicant") to amend the Zoning Ordinance of the City of White Plains ("Zoning Ordinance") to the Law Department, Planning Board and Environmental Officer pursuant to Section 12 of the Zoning Ordinance. The Zoning Ordinance amendment, as initially proposed, would rezone and remap 60 South Broadway (Section 125.84, Block 3, Lot 1) from the B-6 (Enclosed Mall) Zoning District to the CB-3 (Core Business-3) Zoning District, extend and remap the boundaries of the Central Parking Area (CPA) to include said property within the CPA, and make certain text changes to the Zoning Ordinance to increase the maximum allowable height in the CB-3 Zoning District with other provisions. The Planning Board, in a communication dated June 19, 2013, which is annexed hereto, determined that the proposed amendment is in appropriate form. The Common Council, at a meeting held on September 3, 2013, received a communication from the Commissioner of Building, dated August 28, 2013, forwarding a letter from Applicant's counsel, William S. Null, Esq of Cuddy and Feder, LLP, withdrawing that portion of the petition proposing to make certain text changes to the Zoning Ordinance to increase the maximum allowable height in the CB-3 Zoning District with other provisions, as well as an earlier petition submitted by the Applicant on April 17, 2013. Submitted for your consideration is a resolution scheduling a public hearing for the proposed amendment to the Zoning Ordinance for the August 4, 2014 meeting of the Common Council. ____ John G. June 19, 2013 TO THE HONORABLE MAYOR AND MEMBERS OF THE COMMON COUNCIL SUBJECT: PETITION TO AMEND THE ZONING MAP TO RECLASSIFY THE CURRENT WESTCHESTER PAVILION SITE, 60 SOUTH BROADWAY, FROM THE B-6, ENCLOSED MALL ZONING DISTRICT, TO THE CB-3, CENTRAL BUSINESS 3 DISTRICT, TO EXTEND THE CENTRAL PARKING AREA TO INCLUDE THE PAVILION SITE, AND TO MAKE CERTAIN TEXT CHANGES TO THE ZONING ORDINANCE TO INCREASE THE MAXIMUM ALLOWABLE HEIGHT IN THE CB-3 DISTRICT At its meeting of June 18, 2013, the Planning Board reviewed the petition of Urstadt Biddle Properties, Inc., to amend the Zoning Map to reclassify the current Westchester Pavilion site at 60 South Broadway from the B-6 (Enclosed Mall) zoning district, to the CB-3, (Central Business-3 District) and to extend ALLOWABLE HEIGHT IN THE CB-3 DISTRICT At its meeting of June 18, 2013, the Planning Board reviewed the petition of Urstadt Biddle Properties, Inc., to amend the Zoning Map to reclassify the current Westchester Pavilion site at 60 South Broadway from the B-6 (Enclosed Mall) zoning district, to the CB-3, (Central Business-3 District) and to extend the Central Parking Area to include the Pavilion site, and to make certain text changes to the Zoning Ordinance to increase the maximum allowable height in the CB-3 district with other provisions. The Planning Board determined that the proposed amendment is in appropriate form and recommends that the Common Council schedule a public hearing on the petition. The Board will review the substance and advisability of the proposed amendment at its July 16, 2013 meeting. Planning Board members voting in favor of the motion to recommend approval were: M. Quinn, J. Durante, J. Ioris, L. Oliva, R. Stackpole, and J. Westlund (6); Opposed: None (0); Absent: A. Cabrera, (1). TO THE HONORABLE MAYOR AND MEMBERS OF THE COMMON COUNCIL: Attached is a proposed Zoning Ordinance and Zoning Map Amendment in relation to a petition submitted on behalf of Urstadt Biddle, Properties, Inc., to amend the Zoning Ordinance of the City of White and the Zoning Map to reclassify 60 South Broadway (currently the Westchester Pavilion), from B-6 Enclosed Mall Zoning District to the CB-3 Central Business 3 District, and to extend the Central Parking Area to include the site. This is being forwarded for your information, and referral at this time to appropriate City Departments, Boards and Commissions. The Common Council of The City of White Plains hereby ordains and enacts as follows: CITY OF WHITE PLAINS" WITH RESPECT TO REZONING 60 SOUTH BROADWAY FROM THE B-6 ENCLOSED MALL DISTRICT TO THE CB-3 CORE BUSINESS-3 DISTRICT AND EXTENDING THE BOUNDARIES OF THE CENTRAL PARKING AREA TO INCLUDE SAID PROPERTY WITHIN THE CENTRAL PARKING AREA. The Common Council of The City of White Plains hereby ordains and enacts as follows: Section 1. The Zoning Ordinance of the City of White Plains, adopted June 1, 1981, and amended to date, be, and it hereby is, further amended by amending the Zoning Map to rezone and remap 60 South Broadway (also known as Map No 125.84, Block 3, Lot 1 on the tax assessment maps of the City of White Plains) from the B-6 zoning district to the CB-3 zoning district. §2. The Zoning Ordinance of the City of White Plains, adopted June 1, 1981, and amended to date, be, and it hereby is, further amended by amending the Zoning Map to extend and remap the Central Parking Area to include within the Central Parking Area 60 South Broadway (also known as Map No 125.84, Block 3, Lot 1 on the tax assessment maps of the City of White Plains). §3. This ordinance shall take effect immediately. ________ Mrs. Smayda offered the following resolution and moved its adoption. RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF WHITE PLAINS SCHEDULING A PUBLIC HEARING FOR AUGUST 4, 2014 IN RELATION TO THE PETITION SUBMITTED ON BEHALF OF APPLICANT URSTADT BIDDLE PROPERTIES, INC. FOR A PROPOSED AMENDMENT TO THE ZONING ORDINANCE OF THE CITY OF WHITE PLAINS TO REZONE AND REMAP 60 SOUTH BROADWAY (SECTION 125.84, BLOCK 3, LOT 1) FROM THE B-6 (ENCLOSED MALL) ZONING DISTRICT TO THE CB-3 (CORE BUSINESS-3) ZONING DISTRICT AND REMAPPING AND EXTENDING THE BOUNDARIES OF THE CENTRAL PARKING AREA (CPA) TO INCLUDE SAID PROPERTY WITHIN THE CPA. RESOLVED, that a public hearing in relation to the petition, submitted on behalf of Urstadt Biddle Properties, Inc. ("Applicant"), for a proposed amendment to the Zoning Ordinance of the City of White Plains ("Zoning Ordinance") to rezone and remap 60 South Broadway (Section 125.84, Block 3, Lot 1) from the B-6 (Enclosed Mall) Zoning District to CB-3 (Core Business-3) Zoning District and remapping and extending the boundaries of the Central Parking Area (CPA) to include said property within the CPA will be held before the Common Council of the City of White Plains on August 4, 2014 at 7:30 p.m. in the Common Council Chamber, Municipal Building, 255 Main Street, White Plains, New York; and be it further RESOLVED, that the Applicant is directed to give notice of said public hearing pursuant to and in accordance with Section 12 of the Zoning Ordinance; and be it further RESOLVED, that the City Clerk is hereby directed to forward a certified copy of this resolution to the Applicant's counsel; and be it further RESOLVED, that the City Clerk is hereby further directed to refer the aforementioned proposed Zoning Ordinance amendment to the appropriate City agencies, departments, boards, commissions, and officers and the Westchester County Planning Board for review, comments and recommendations in accordance with Section12.5 of the Zoning Ordinance.
