TO THE HONORABLE MAYOR AND MEMBERS OF THE COMMON COUNCIL OF THE CITY
OF WHITE PLAINS
At its June 3, 2013 meeting, the Common Council received and referred a petition on behalf of Urstadt
Biddle Properties, Inc. ("Applicant") to amend the Zoning Ordinance of the City of White Plains
("Zoning Ordinance") to the Law Department, Planning Board and Environmental Officer pursuant to
Section 12 of the Zoning Ordinance. The Zoning Ordinance amendment, as initially proposed, would
rezone and remap 60 South Broadway (Section 125.84, Block 3, Lot 1) from the B-6 (Enclosed Mall)
Zoning District to the CB-3 (Core Business-3) Zoning District, extend and remap the boundaries of the
Central Parking Area (CPA) to include said property within the CPA, and make certain text changes to
the Zoning Ordinance to increase the maximum allowable height in the CB-3 Zoning District with other
provisions.
The Planning Board, in a communication dated June 19, 2013, which is annexed hereto, determined that
the proposed amendment is in appropriate form. The Common Council, at a meeting held on September
3, 2013, received a communication from the Commissioner of Building, dated August 28, 2013,
forwarding a letter from Applicant's counsel, William S. Null, Esq of Cuddy and Feder, LLP,
withdrawing that portion of the petition proposing to make certain text changes to the Zoning Ordinance
to increase the maximum allowable height in the CB-3 Zoning District with other provisions, as well as
an earlier petition submitted by the Applicant on April 17, 2013.
Submitted for your consideration is a resolution scheduling a public hearing for the proposed
amendment to the Zoning Ordinance for the August 4, 2014 meeting of the Common Council.
