Smayda A Special Meeting of the Common Council held Wednesday, March 8, 2017, called for six o'clock in the evening in the Common Council Chamber, Mayor Roach presiding and the following members present: Mrs. Hunt Robinson, Mr. Kirkpatrick, Mr. Krolian, Mrs. Lecuona, Mr. Martin and Mrs. Smayda. This Special Meeting was for the purpose of discussing to the proposed establishment of a community residence facility at 22 New York Avenue South. The Mayor announced a public hearing in relation to the proposed establish- ment of a community residence facility at 22 New York Avenue South by the Institute of Applied Human Dynamics, Inc., pursuant to New York State Mental Hygiene Law Section 41.34. Mr. Kirkpatrick moved that the hearing be opened. Mr. Martin seconded the motion. Carried. 790 COMMON COUNCIL MINUTES March 8, 2017 The Mayor declared the hearing opened and asked if anyone wished to be heard. Mr. Kirkpatrick moved that the hearing be closed. Mr. Martin seconded the motion. Carried. Council President Kirkpatrick asked unanimous to add to the evenings agenda a resolution entitled, "Resolution of the Common Council of the City of White Plains in relation to the intention of IAHD to establish a Community Residence at 22 New York Avenue South." Councilman Martin seconded the motion. Motion defeated by the following roll call vote: Mrs. Hunt-Robinson, Mr. Kirkpatrick, Mr. Krolian, Mrs. Lecuona, Mr. Martin, and the Mayor - 6 - 1. Nay: Mrs. Smayda. After discussion, Mr. Martin asked that the matter be reconsidered. Mr. Martin asked unanimous to add to the evenings agenda a resolution entitled, "Resolution of the Common Council of the City of White Plains in relation to the intention of IAHD to establish a Community Residence at 22 New York Avenue South." Mr. Kirkpatrick seconded the motion. Approved by the following role call vote: Mrs. Hunt-Robinson, Mr. Kirkpat- rick, Mr. Krolian, Mrs. Lecuona, Mr. Martin, Mrs. Smayda and the Mayor - 7 - 0. Mrs. Smayda moved to amend the resolution by adding the language such as: ...which proposed agreement being reached with IAHD, regarding operation of the residence, to accept conditions, that the Common Council would reconvene to take another vote on the proposed resolution." There was no second to the proposal to amend. Mr. Kirkpatrick moved adoption of the following resolution. RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF WHITE PLAINS IN RELATION TO THE INTENTION OF IAHD TO ESTABLISH A COMMUNITY RESIDENCE AT 22 NEW YORK AVENUE SOUTH. Whereas notification dated December 9, 2016 was received on December 15 2016 from IAHD indicated its intention to establish a community residence site at 22 New York Avenue South in White Plains; and Whereas IAHD granted several extensions of the 40 day time limit for a response by the City to establishment of a group home at the proposed site of which the last extension expires on March 10, 2017; and March 8, 2017 COMMON COUNCIL MINUTES 791 Whereas the Common Council held public meetings on February 15 and March 7, 2017 at which IAHD made presentations and all who wished to be heard were heard; Now therefore be it resolved that the Common Council hereby directs the Corporation Counsel to file with appropriate agencies a formal objection to the location of this Community Residence, on the grounds that establishment of the proposed Residence will result in such a concentration of community residential facilities that the nature and character of the area in which the facility is to be located will be altered, and will fail to address the needs of the municipality. Mr. Martin seconded the motion. Adopted by the following role call vote: Mrs. Hunt-Robinson, Mr. Kirkpat- rick, Mr. Krolian, Mrs. Lecuona, Mr. Martin, and the Mayor - 6 - 0. Nay: Mrs. Smayda.
