BOARD OF ALDERMEN
REGULAR MEETING
JUNE 7, 2010
Board present: Aldermen Richard Simpson, Aldermen David Hemphill, Aldermen Pat
Lloyd, Aldermen Doug Johnson, Aldermen Tim Magee, and Aldermen Bryan Vincent.
Mayor Jamie Schoolcraft was not in attendance.
Also present: City Clerk, Dale Duvall; Deputy City Clerk, Kate Gould; CFO, Karen
Robson; Director of Development, Randy Brown; Public Works Director, Justin Reaves;
Parks and Recreation Director, Kevin McDonald; Chief of Police, Tom McClain; Willard
Reserve Officer, Bill Lingenfielser; and City Attorney, Sativa Boatman-Sloan.
Also in attendance: Gene Thomas, Darrell Biellier, Blaine Kennard, Anthony Smith,
Becky Miller, Richard East, and Brandon Beck, and Braden Beck.
Sarah Overstreet with the Willard Cross Country Times was also in attendance.
President Elect Lead the Pledge of Allegiance.
Call to Order
Board President, Richard Simpson called the meeting to order.
Roll Call
City Clerk, Dale Duvall called the roll call. Aldermen Simpson-present, Aldermen
Hemphill-present, Aldermen Lloyd-present, Mayor Schoolcraft----------, Aldermen
Johnson-present, Aldermen Magee-present, Aldermen Vincent-present.
Agenda Amendments/Approval of Agenda
City Clerk, Dale Duvall informed the Board that item # 16 would need to have
item (b) discussion removed. The issue needed to be researched and brought
back to the Board.
Motion made by Aldermen Johnson and seconded by Aldermen Magee to
approve the agenda with the change. Aldermen Simpson-Aye, Aldermen
Hemphill-Aye, Aldermen Lloyd-Aye, Aldermen Johnson-Aye, Aldermen Magee-
Aye, Aldermen Vincent-Aye. All votes aye. Motion carried.
Approve the Minutes of the Regular Meeting on May 24, 2010
Motion made by Aldermen Vincent and seconded by Aldermen Magee to
approve the minutes. Aldermen Simpson-Aye, Aldermen Hemphill-Aye,
Aldermen Lloyd-Aye, Aldermen Johnson-Abstained, Aldermen Magee-Aye,
Aldermen Vincent-Aye. Five votes aye. One abstention due to absence. Motion
carried.

Citizen Input
Darrell Biellier spoke to the Board asking for budgeting in 2011 for improvements
in storm water runoff.
Financial Report-CFO Karen Robson
April Financial Statements Motion made by Aldermen Lloyd and seconded by
Aldermen Hemphill to approve the April financial statements. Aldermen Simpson-
Aye, Aldermen Hemphill-Aye, Aldermen Lloyd-Aye, Aldermen Johnson-Aye,
Aldermen Magee-Aye, Aldermen Vincent-Aye. All votes aye. Motion carried.
May Unpaid Bills Karen Robson answered questions that Aldermen Hemphill
had regarding the bills. Motion made by Aldermen Vincent and seconded by
Aldermen Magee to pay the outstanding bills. Aldermen Simpson-Aye, Aldermen
Hemphill-Aye, Aldermen Lloyd-Aye, Aldermen Johnson-Aye, Aldermen Magee-
Aye, Aldermen Vincent-Aye. All votes aye. Motion carried.
Police Department Report-Chief Tom McClain
Police Chief Tom McClain gave his monthly report to the Board.
Emergency Management Report-Stacy Winters
Stacy Winters was not present. Karen Robson made a comment to the Board
regarding the storm shelter grant that was reported on in the Emergency
Management Report.
Public Works Report-Justin Reaves
Justin Reaves gave his monthly report to the Board.
Justin spoke to the Board regarding the opportunity to replace the boom mower.
There are many repairs that need to be done. Justin had spoken with the
company, Victor Phillips, who had done work on the mower in the past and they
stated that to repair the mower would cost $1,000 minimum and that the mower
had been discontinued. Justin also spoke with Bob White of Potter Equipment
and Mr. White stated that the City could trade in the backhoe that is at the Public
Works shop for $50,000-$60,000. The Potter representative stated that he can
look for a tractor that would be appropriate for the City’s mowing needs. This is
the company that sold the City the original machinery and it would be an equal
trade or monies coming back to us. Justin stated that he had also spoken with
other companies regarding doing a trade out. Justin also told the Board that a
new tractor would cost around $105,000.
Karen Robson asked the Board if they would vote to allow one of the Aldermen
to meet with Justin and the representative from Potter to make a decision on the
tractor and the terms. Motion made by Aldermen Vincent and seconded by

Aldermen Hemphill to allow Doug Johnson to represent the Board in the
decision. Aldermen Simpson-Aye, Aldermen Hemphill-Aye, Aldermen Lloyd-Aye,
Aldermen Johnson-Aye, Aldermen Magee-Aye, Aldermen Vincent-Aye. All votes
aye. Motion carried.
Development Report-Randy Brown
Randy Brown gave his monthly report to the Board.
Parks and Recreation Report-Kevin McDonald
Kevin McDonald gave his monthly report to the Board.
Community Relations Report –Kate Gould
Kate Gould gave her monthly report to the Board.

Staff will also be destroying the following records series: ’02-05’ Park Rental
Agreements. Kate informed the board that staff had reviewed all the records and
checked the records retention schedule from the Secretary of State to insure that
all the records could legally be destroyed.
*Note all of the above records were shredded and disposed of on June 22, 2010.
Appointment of Becky Miller to the Park Board Advisory Committee

Aldermen Vincent and seconded by Aldermen Magee to accept the appointment.

Johnson-Aye, Aldermen Magee-Aye, Aldermen Vincent-Aye. All votes aye.
Motion carried.
Appointment of Louie Amodeo to the Board of Adjustments

b. Discussion There were no comments from the Board. Motion made by
Aldermen Vincent and seconded by Aldermen Magee to accept the appointment.
Aldermen Simpson-Aye, Aldermen Hemphill-Aye, Aldermen Lloyd-Aye, Aldermen
Johnson-Aye, Aldermen Magee-Aye, Aldermen Vincent-Aye. All votes aye.
Motion carried.
Fireworks Ordinance 1ST Reading
BILL NO. 10-12 ORDINANCE NO. 100607
AN ORDINANCE APPROVING A MUNICIPAL CODE AMENDMENT TO SECTION
210.027 OF THE MUNICIPAL CODE OF THE MUNICIPAL CODE OF THE CITY OF
WILLARD PERTAINING TO THE SALE OF FIREWORKS.
Citizen Input for Bill NO. 10-12
Brandon Beck spoke to the Board stating that he would ask the Board to
consider changing the hours that were proposed on the ordinance to match those
that are allowed on New Year’s Eve. Darrell Biellier stated that he is fine with the
selling of fireworks but is not satisfied that the portion of the ordinance regarding
the setting off of fireworks due to safety concerns.

Discussion for Bill NO 10-12
The Board discussed in length the safety factors surrounding the ordinance.
First reading by title was conducted by City Clerk, Dale Duvall. Motion by
Aldermen Johnson and seconded by Aldermen Magee to accept the first reading.
Aldermen Simpson-Nay; Aldermen Hemphill-Aye, Aldermen Lloyd-Nay;
Aldermen Johnson-Aye; Aldermen Magee-Aye; and Aldermen Vincent-Nay.
Three (3) votes aye. Three (3) votes nay. Tie vote. Aldermen Simpson as the
President Elect broke the tie with a nay vote. Three (3) votes aye. Four (4) votes
nay. Motion denied.
The Board asked that the ordinance be changed to include more restrictions on
safety measures and bring it back to the Board at a special meeting on June 9,
2010 at 6:00p.m.
103 Grand Prairie Storm Water Discussion
a. Citizen Input Darrell Biellier spoke to the Board regarding the storm water issue
that is caused by the ditch that is in front of his house at 103 Grand Prairie. He
would like the City to fix the problem.
Old Business
Aldermen Hemphill made a motion to terminate the services of the City’s
representative law firm, Baird, Lightner, Millsap, and Harpool PC. He made the
motion that Mr. Harpool’s services be terminated as of 6/7/2010 and the firm’s
services be terminated as of 6/11/2010. Aldermen Lloyd asked that it be noted
for the record that it be stated that, “due to a complete absence of information, he
does not feel qualified to make a decision to terminate the services of the City
Attorney and his law firm.” Aldermen Johnson asked that his vote reflect the
same reason as Aldermen Lloyd’s.
Motion made by Aldermen Hemphill and seconded by Aldermen Magee to
terminate the services of the City Attorney on 6/7/2010 and the rest of the firm of
Baird, Lightner, Millsap and Harpool on 6/11/10. Aldermen Simpson-Aye,
Aldermen Hemphill-Aye, Aldermen Lloyd-Nay, Aldermen Johnson-Nay, Aldermen
Magee-Aye, and Aldermen Vincent-Aye. Four (4) votes aye. Two (2) votes nay.
Motion carried.
Motion made by Aldermen Lloyd and seconded by Aldermen Johnson to adjourn
the meeting. Aldermen Simpson-Aye, Aldermen Hemphill-Aye, Aldermen Lloyd-
Aye, Aldermen Johnson-Aye, Aldermen Magee-Aye, Aldermen Vincent-Aye. All
votes aye. Motion carried.
