CITY OF WILLARD BOARD OF ALDERMAN REGULAR MEETING March 12, 2012 Board present: Alderman Trapp-present, Alderman Roggensees-present, Alderman Hemphill- present, Mayor Keltner-present, Alderman Vincent-present and Alderman Simmons-present. Alderman Magee- not present. Staff present: City Clerk, Dale Duvall; CFO, Karen Robson; City Administrator; Nicholas Heatherly; Parks Director, Kevin McDonald and Willard Reserve Officer, Bill Lingenfielser. City Attorney Ken Reynolds was also present. Citizens in attendance: Lucille Murray, Carl Montgomery, Mindy Latham, Robert Latham, Sam Baird, Doug Johnson and Kevin Spaulding from the Greene County Sheriff’s office. Mayor Tom Keltner led the Pledge of Allegiance. Call to Order Mayor Tom Keltner called the meeting to order at 7:00 pm. Attorney Ken Reynolds opened the PUBLIC HEARING TO CONSIDER AND RECOMMEND TO THE BOARD OF ALDERMEN, CHANGES TO THE CITY OF WILLARD MUNICIPAL CODE BOOK, TITLE IV. LAND USE, CHAPTER 400: LAND DEVELOPMENT REGULATIONS. There was no citizen input and so the public hearing was closed. Roll Call The City Clerk called the roll call. Alderman Trapp-present, Alderman Roggensees-present, Alderman Hemphill-present, Mayor Keltner-present, Alderman Magee---, Alderman Vincent- present and Alderman Simmons-present. Agenda Amendments/Approval of Agenda Motion made by Alderman Simmons and seconded by Alderman Hemphill to approve the agenda. Alderman Vincent-Aye, Alderman Magee--, Alderman Simmons-Aye, Alderman Trapp- Aye, Alderman Roggensees-Aye and Alderman Hemphill-Aye. All votes aye. Motion carried. Approve the Minutes of the Regular Meeting on February 13, 2012 Alderman Hemphill asked that a change be made to read ”non-residents” replacing “non- citizens”, regarding the Tree Board membership. Motion made by Alderman Simmons and seconded by Alderman Roggensees. Alderman Vincent-Aye, Alderman Magee--, Alderman Simmons-Aye, Alderman Trapp-Aye, Alderman Roggensees-Aye and Alderman Hemphill-Aye. All votes aye. Motion carried. Ceremonial Matters None 03-12-12 BOA Minutes Page 1 of 7 Citizen Input None Presentation of public safety initiative ballot issue by the Greene County Sheriff’s office Major Kevin Spaulding of the Greene County Sheriff’s office Ryan presented information explaining why Greene County is asking for the public safety initiative tax to pass in April. Financial Report February Outstanding Invoices- Motion made by Alderman Simmons and seconded by Alderman Vincent to approve the invoices. Alderman Vincent-Aye, Alderman Magee------, Alderman Simmons-Aye, Alderman Trapp-Aye, Alderman Roggensees-Aye and Alderman Hemphill-Aye. All votes aye. Motion carried. February Utility Adjustment Report- Motion made by Alderman Vincent and seconded by Alderman Trapp to approve the adjustment report. Alderman Vincent-Aye, Alderman Magee---, Alderman Simmons-Aye, Alderman Trapp-Aye, Alderman Roggensees-Aye and Alderman Hemphill-Aye. All votes aye. Motion carried. Report from the City Administrator The City Administrator spoke to the Board about various projects that City staff is currently working on. Alderman Roggensees asked about and the topic was discussed regarding the sign for the entrance at Fox Creek Subdivision that the homeowners want to install. There will be a license agreement drawn up for the homeowners association to sign so that the sign may be put into the City right of way. Motion made by Alderman Simmons and seconded by Alderman Vincent to approve staff to bring proposals for changes regarding signs and the right of way’s. Land O’ Frost/City of Willard Ordinance (2nd Reading) AUTHORIZING the Mayor on behalf of the City of Willard, to execute an agreement between the City of Willard and Land O’ Frost, Inc. to accept Land O’ Frost as the exclusive jersey sponsor for the Willard Parks and Recreation 2012 sports programs Second read was conducted by the City Clerk. Commerce Bank/Willard Sports Complex Ordinance (2nd Reading) AUTHORIZING the City of Willard to renew the Lease Agreement between Commerce Bank, as trustee, and the City of Willard, Missouri, originally dated April 1, 2001 and renewed thereafter, annually, and as now renewed for one (1) year period as specified in Section otherwise known as the Recreation Center. 03-12-12 BOA Minutes Page 2 of 7 Second read was conducted by the City Clerk. Ordinance to transfer surplus equipment to Willard R-II school district from the City of Willard (2nd Reading) AUTHORIZING the disposal of a 2004 Dodge Intrepid, VIN 2B3HD46V74H70Z210, from the inventory of vehicles owned by the City of Willard (hereinafter referred to as “City”, and selling said vehicle to the Willard R-II School District, hereinafter referred to as “District”. Second read was conducted by the City Clerk. Citizens Input –None Discussion/Vote-None/Motion was made by Alderman Vincent and seconded by Alderman Roggensees to approve the second read. Alderman Simmons-Aye, Alderman Trapp-Aye, Alderman Roggensees-Aye, Alderman Hemphill-Aye, Alderman Vincent-Aye and Alderman Magee----. All votes aye. Motion carried. HDR Engineering and the City of Willard Ordinance (1st and 2nd Reading) AUTHORIZING the Mayor, on behalf of the City of Willard, to execute an agreement between the City of Willard and HDR Engineering, Inc. to provide technical and professional services, and declaring an emergency. First read was conducted by the City Clerk. Citizens Input-None Discussion/Vote- The City Administrator explained that HDR Engineering would be providing services to the City in regard to the lift stations in order to evaluate options to prevent future sanitary sewer overflows at Lift Station “D” and the Regional Lift Station. Motion was made by Alderman Roggensees and seconded by Alderman Simmons to approve the first read. Alderman Simmons-Aye, Alderman Trapp-Aye, Alderman Roggensees-Aye, Alderman Hemphill-Aye, Alderman Vincent-Nay and Alderman Magee----. Four votes aye. One vote nay. Motion carried. Ordinance Amending the City of Willard Employee Manual Ordinance (1st Reading) ADOPTING amendments to the City of Willard Employee Manual. First read was conducted by the City Clerk. Ordinance declaring the 2012 February Election results (1st Reading) DECLARING the results of a Special Election held on the 7th day of February 2012, in the City of Willard, Missouri First read was conducted by the City Clerk. Ordinance Amending Section 400.170 (Guarantees for Lift Stations and Force Mains) (1st Reading) AN ORDINANCE approving municipal code amendments to Title IV, Land Use Regulations, Article XVI, Guarantees for Public Improvements, Section 400.1470, Guarantees for Lift Stations and Force Mains, by adding a new paragraph H, of the Municipal Code of the City of Willard. First read was conducted by the City Clerk. Citizens Input-None. Discussion/Vote-The City Administrator informed the Board that these changes were to the uniform allowance payout procedure and unpaid leave./Motion made by Alderman Vincent and seconded by Alderman Simmons to accept first reading. Ordinance repealing Section 400.1420(Park in Lieu of fee) (1st Reading) AN ORDINANCE approving municipal code amendments to Title IV, Land Use Regulations, Article XV, Required Public Improvements, Section 400.1420, Park/Recreational Development, Dedication or Fee in Lieu Of, by repealing Section 400.1420 in its entirety and reserving the Section for future amendments, additions and modifications, of the Municipal Code of the City of Willard. First read was conducted by the City Clerk. Old Business- Alderman Hemphill asked to discuss the verbiage of the ordinance that deals with the number of dogs and cats allowed in an R-1 zoning district. Motion by Alderman Hemphill with a second by Alderman Simmons to present the Board with a new ordinance at the next meeting. Alderman also asked to discuss the tree board membership ordinance and the sign ordinance at the next Board meeting. The Mayor asked for the enforcement of the recently passed fowl ordinance to be discussed at the next Board meeting. After discussion it was decided to hold the public meetings on projects for the Capital Improvement tax money, prior to the May, June and July Board meetings.
