CITY OF WILLARD BOARD OF ALDERMAN SPECIAL MEETING MARCH 28, 2012 Board present: Alderman Trapp-present, Alderman Hemphill-present, Mayor Keltner-present, Alderman Vincent-present, Alderman Simmons-present and Alderman Magee- present. Alderman Roggensees was not present. Staff present: City Clerk, Dale Duvall and Chief of Police, Tom McClain. City Attorney Ken Reynolds was also present. Citizens in attendance: David and Helen Wicka, Justin and Amber Hatcher. Mayor Tom Keltner led the Pledge of Allegiance. Call to Order Mayor Tom Keltner called the meeting to order at 7:00 pm. Roll Call The City Clerk called the roll call. Alderman Trapp-present, Alderman Roggensees----, Alderman Hemphill-present, Mayor Keltner-present, Alderman Magee---present, Alderman Vincent-present and Alderman Simmons-present. Attorney Ken Reynolds called Mr. Hatcher to testify first. Ms. Wicka was called to testify after Mr. Hatcher. Police Chief McClain then read the police incident report that was written by Officer Turner, the officer who responded to the call.. The Mayor then asked each of the Board members if they had individual questions for either party. After discussion Alderman Simmons made a motion declaring the dog “a dangerous dog”. Alderman Simmons-Aye, Alderman Trapp-Aye, Alderman Roggensees---, Alderman Hemphill- Nay, Alderman Vincent-Aye and Alderman Magee--Nay. Three votes aye. Two votes Nay. Motion carried. A motion was made by Alderman Vincent with a second by Alderman Simmons to declare the dog attack as unprovoked. Alderman Simmons-Aye, Alderman Trapp-Aye, Alderman Roggensees---, Alderman Hemphill-Nay, Alderman Vincent-Aye and Alderman Magee--Nay. Three votes aye. Two votes Nay. Motion carried. Mr. Hatcher was informed by Mr. Reynolds that he would be receiving a letter from the City and that the dog needed to be put down immediately. 03-28-12 BOA Minutes Page 1 of 2 Adjourn - Motion made by Alderman Simmons and seconded by Alderman Hemphill to adjourn the open session. Alderman Simmons-Aye, Alderman Trapp-Aye, Alderman Roggensees---, Alderman Hemphill-Aye, Alderman Vincent-Aye and Alderman Magee--Aye. All votes aye. Motion carried.
