Planning and Zoning Meeting

CITY OF WILLARD, MISSOURI PLANNING AND ZONING REGULAR MEETING May 27, 2014 7:00 P.M. Staff present: City Administrator, J. Everett Mitchell; Director of Development, Randy Brown; and City Clerk, Dale Duvall. City Attorney Ken Reynolds was also present. Guest Present: Casey Wray of Good Samaritan Boys Ranch, Gaytha Yates, Jerry Hill, Emma Myers, Jim Myers, Dwayne Waterworth, Brian Waterworth, Barbara Pine, Richard and Betsy DeKneght, Lee McLean and Doug McDaris. Meeting opened by Chairman Robert Taylor at 7:00 pm. Pledge of Allegiance The Pledge of Allegiance was led by Chairman Robert Taylor. Roll Call Present: Lucille Murray, David Helton, Alderman Bradley Mowell, Adam Shelledy, Mayor Forshee and Robert Taylor. Valorie Simpson was absent. Approval of Agenda Motion was made by Mayor Forshee with a second by Lucille Murray to approve the agenda. Motion carried with a vote of 6-0. Voting Aye: Lucille Murray, David Helton, Robert Taylor, Adam Shelledy, Mayor Forshee and Bradley Mowell. Approval of minutes from April 22, 2014 regular meeting Motion made by Adam Shelledy to approve the minutes, with a second by David Helton. Motion carried with a vote of 6-0. Voting Aye: Lucille Murray, David Helton, Adam Shelledy, Mayor Forshee and Bradley Mowell. Robert Taylor abstained due to absence. Citizens Input Don McClintock, Colette Long Mr. DeKnegt spoke in favor of the project. Gaytha Yates spoke for several of the neighbors in the area and stated that they were against the project. Emma Myers of 101 E. Robberson spoke against the project. Public Hearing to consider citizens comments on the rezoning request for Doug McDaris from R-1 to R-4 for 5537 W.Farm Rd 94. Ken Reynolds opened the public hearing for comments. Hearing no comments, Ken Reynolds closed the public hearing. Discussion/vote for recommendation to the Board of Aldermen the request for a rezoning request for Doug McDaris form R-1 to R-4 for 5537 W. Farm Rd. The City Administrator explained that this change needed to be made due to an oversight when the zoning map for the City was adopted. Motion made by Bradley Mowell with a second by Robert Taylor. Motion carried with a vote of 6-0. Voting Aye: Lucille Murray, David Helton, Robert Taylor, Adam Shelledy, Mayor Forshee and Bradley Mowell. 05-27-2014 P&Z Minutes Public Hearing to consider and recommend to the Board of Aldermen, the conditional use permit request for the Good Samaritan Boys Club for 300 S. Main St. The Director of Development addressed sewer and water concerns and believes that there will not be any issues there. He also stated that he believes that the grease trap will work fine. Discussion/vote for recommendation to the Board of Aldermen the conditional use permit request for the Good Samaritan Boys Club for 300 S. Main St. The City Attorney stated that he believes that this use does fall under conditional use permit category. There was discussion among the Commission with Bradley Mowell questioning the legality of the permit under the definitions in the Willard Municipal Code Book. Motion made by David Helton with a second by Robert Taylor to deny recommendation of the permit to the Board of Aldermen. Voting Aye: Lucille Murray, David Helton, Robert Taylor, and Bradley Mowell. Adam Shelledy and Mayor Forshee voted nay to the rejection of the recommendation. Motion carried to deny recommendations to the Board of Aldermen. Old Business. None. New Business. No new business. Adjourn Meeting Lucille Murray made the motion to adjourn the meeting with a second by Robert Taylor. Motion carried with a vote of 6-0. Voting Aye: Lucille Murray, David Helton, Robert Taylor, Adam Shelledy, Mayor Forshee and Bradley Mowell.
