Pledge of Allegiance
Chairman Terry Kathcart led the Pledge of Allegiance.
Call the Meeting to Order
Chairman Terry Kathcart called the meeting to order at 6:00 p.m.
Roll Call:
The Roll Call was conducted by the City Clerk.

Mike Ruesch welcomed the two new P&Z Board Members Marianne Hill & Sam Baird. He
stated it’s nice to have new faces and opinions and thanked them for coming on board. He
also thanked Chairman Terry Kathcart as well.
There was a brief discussion about the length of terms for the board members and when
members need to be re-elected. Consensus of the commission is to re-elect members next
month and in May. The r-elections will be discussed at the next meeting and presented to
the Board of Aldermen for final approval.
Planning Assistant Tammy Nephew asked everyone to bring their books next month and she
will add the updates to them.
Agenda Amendments/Agenda Approval
The agenda is to be amended to correct the mistake of Item #14 being numbered as Item #13
and there is already an Item #13. Motion was made by Sam Baird and seconded by Burnis
Coleman to correct Item #14 to be numbered as Item #14 instead of Item #13. Motion carried
with an 11-0 vote. Voting aye: Terry Kathcart, David Keene, Valorie Simpson, Sam Baird, Josh
Breeze, Steve Cobb, Burnis Coleman, Marianne Hill, David Kinsman, Jeff LaMontia, Gary

Approval of the Minutes from the Meeting on June 4, 2024
There were no amendments to the Meeting Minutes from June 4, 2024. Motion was made by
Sam Baird and seconded by Gary Walker to approve the Meeting Minutes from June 4, 2024.
Motion carried with an 11-0 vote. Voting aye: Terry Kathcart, David Keene, Valorie Simpson,

Final Plat for Hoffman Hills Phase 2
Mike Ruesch explained the details for the Final Plat for Hoffman Hills Phase 2 which includes
that the warranty bond is in place, the sidewalks are in and meet standard, all infrastructure
is there, and compliance and quality have been met. Mike stated that Planning & Zoning
needs to make the recommendation and then approval from the Board of Aldermen will
follow. Motion was made by Valorie Simpson and seconded by Jeff LaMontia to accept the
Hoffman Hills Phase 2 and present the approval recommendation to the Board of Aldermen.
Motion passed with an 11-0 vote. Voting aye: Terry Kathcart, David Keene, Valorie Simpson,

Addition of Personal Storage to the M-1 Zone
Mike Ruesch stated there is a hole in the book because there is no provision for storage units
because storage units previously were not wanted in the commercial zone. Mike wants to
re-install personal storage units (not commercial) and put in manufacturing (although not
commercial). Chairman Terry Kathcart didn’t want storage units facing 160 and Mike agrees
that he doesn’t want them in the front. Mike is proposing a manufacturing zone. Terry asked
Mike to get a large map and point out the M-1 Zone. Mr. Ruesch got the map and pointed out
specifics and reiterated that what he was pointing out shows future use. Valorie Simpson
wants Item #29 of Section A of Ordinance No. 020227 that is in yellow to be included. Motion
was made by Valorie Simpson and seconded by Sam Baird to accept the Addition of Personal
Storage to the M-1 Zone and present the approval recommendation to the Board of
Aldermen. Motion carried with an 11-0 vote. Voting aye: Terry Kathcart, David Keene, Valorie

Revision of the Variance Code for School Signage
Included in the next discussion.
Revision of the Signage Requirements for the R-1 Zone
Mike Ruesch explained that Revision of the Variance Code for School Signage and
Revision of the Signage Requirements for the R-1 Zone are tied together. The code states
we want to grant them a variance: landscaping, off street parking, height, setbacks, etc. The
new proposal to edit the R-1 zone includes not to exceed 40 square feet, if it is over, then a
variance will be needed. Mike stated he doesn’t want to make them have to ask every time,
but in the past, we couldn’t grant variances because the ordinance was so tight, and the
Board of Adjustments are too tight. Mr. Ruesch prefers to have the code be the rule and not
the exception and would like to keep it tight except for schools. Motion was made by Sam
Baird and seconded by Terry Kathcart to accept the new changes to the Revision of the
Variance Code for School Signage and present the approval recommendation to the Board
of Aldermen. Motion carried with an 11-0 vote. Voting aye: Terry Kathcart, David Keene,
Valorie Simpson, Sam Baird, Josh Breeze, Steve Cobb, Burnis Coleman, Marianne Hill, David

Burnis Coleman to accept the new changes to the Revision of the Signage Requirements
for the R-1 Zone and to present the approval recommendation to the Board of Aldermen.

Mixed-Use Code
Mike Ruesch explained in detail that the changes include defining open space, and that no
more than 60% of property will be developed. It defines what can count toward the open
space and that the open space doesn’t mean it’s undisturbed. It can include trails, parks,
etc. There was a lot of discussion about the 7,000 square foot lots and Mike said this is
applicable to downtown and residences. Mike wants this to be to be addressed as a true
mixed-use zone explaining that mixed use can include houses and, for example, a grocery
store in the same neighborhood. Currently there are three houses allowed per acre and with
this change, there could be more houses added per acre with walking trails, etc. This change
has taken sidewalks out of the mixed-use codes. Section J still includes a landscaping strip
of 25 feet of 70% of the development. Nothing changed there. The landscape must be
maintained. Now we have a scale that includes the possibility of an increase of one half to
one dwelling increase per acre. The Planning & Zoning Commission has the option to say
they like the idea and give more credit. Tree lined streets have stayed the same and remain
as a sliding scale. Sliding scale is what Willard deems is important to us. If you feel
something needs more emphasis, we can make changes, but this is just a place to start.
Steve Cobb said section C built trails at 12 feet. Mike Ruesch said that a difference between
a 10- and 12-foot trail is a safety concern and makes a big difference. The trail is a 12-foot
trail, but there will be a 30-foot easement. It will start at one acre and must be part of the
master trail plan/master park plan. Due to the cost, Mike said he started at one acre because
he wants to improve connectivity. Mike stated that sidewalks are not included because they
will be standard now; however, there are subdivisions coming into older parts of town, and
the developer will charge to add sidewalks in the older parts. With a mixed-use development
there will be an HOA. The city won’t take on their open space development. A true mixed-
use includes multiple zones. We will give developers credit to mix zones. This ordinance
gives you the flexibility not to deal with two different ordinances. Mike stated that we need
people to come in with new plans that are approved beforehand. Mike said that when this
gets passed you will see a lot more of this than regular zoning and under the old ordinance,
the developer gets everything, and the city gets nothing. This will include increased
recreational facilities and will increase their density. One important thing that was included
is architectural design was added in to mixed-use. Mike said we want structures that look
like what we think they should look like and we’re asking the Board of Aldermen for approval
for an architectural designer. He stated that the tentative approval from the City
Administrator is to look at two house designs per year that will be automatically approved.
We will have up to ten house plans for anywhere in Willard with design, cost, etc. Only the
first buyer usually benefits, there will be diversity in the structures because not all of them
will be the same. Mike will correct some double mentions in the papers. Developers will
receive some credit for mixed-uses and a bonus credit for stacking zones and mixed-uses.
Mike said this is a game changer in a lot of ways with the interpretation at the Planning &
Zoning Commission level and how we want Willard to look. Planning &Zoning Commission
Board Members need to figure out what Willard needs and what’s important to them. There
will be no manufacturing in the shopping districts. Mike said this doesn’t have to be
approved tonight. Mike stated that on set setbacks, the side yard is going to be the same as
the front yard. Mike also said that mixed-use will allow them to encroach on the side yards.
Setbacks differing from the standards can be changed by the Board of Aldermen.
Animal Codes
Animal ordinance is currently in two different sections and Mike is proposing to take it out of
those and put it in its own section. The only recourse now is ordinance and the police
department. Proposing a time limit for keeping your dog quiet. Currently in the police
ordinance but will mention where to find it in this ordinance. David suggests a survey.
Tammy will put a survey online.
New Business
HOA’s: Will be establishing an HOA Advisory Board. 4 members on board currently. Tammy
has their names. Not regulatory, advisory board. The city mandates it so we’re putting
together mandates for them. Terry wants calls vetted and directed so the planning phone #
will go into the paperwork. There is no Missouri law governing HOA’s. Mike said that property
value in an HOA subdivision is much higher due to having better and more responsible
neighbors.
Unfinished Business
Mr. Ruesch said that the Board of Aldermen approved the updated building codes and chose
Option C (there were three options: A, B, C). Option C is the higher option and best choice
and includes fees for the Police Department and doubles the fees for the Parks Department.
The 2018 Fees will make things safer. The Board of Aldermen also approved the ATM Square.
The next meeting date was discussed, and it was decided to not have a meeting on the first
Tuesday of August (6th), but to have the next Planning & Zoning Commission meeting on the
second Tuesday of August which will be August 20th.
