(“Charter”), a limited liability company organized and existing in good standing under the laws of State of Delaware doing business at 2604 Seneca Avenue, Niagara Falls, NY 14305, for the approval of a renewal agreement for Charter's cable television franchise for fifteen (15) years commencing with the date of approval by the Public Service Commission; and WHEREAS, the franchise renewal agreement would bring the franchise into conformity with certain provisions of the Federal Cable Communications Policy Act of 1984, as amended, and certain court rulings; and WHEREAS, a public hearing, duly noticed by publication in the Amherst Bee on June 22, 2022, was held in the Village of Williamsville, New York on June 27, 2022 at 7:30 P.M., at which all interested persons were allowed to comment; and WHEREAS, the Board of Trustees of the Village of Williamsville finds that: 1. Spectrum Northeast, LLC has substantially complied with the material terms and conditions of its existing franchise and with applicable law; and 2. Spectrum Northeast, LLC has the financial, legal and technical ability to provide these services, facilities and equipment as set forth in its proposal attached; and 3. Spectrum Northeast, LLC can reasonably meet the future cable-related community needs and interests, taking into account the cost of meeting such needs and interests. NOW THEREFORE BE IT RESOLVED that the Board of Trustees of the Village of Williamsville hereby grants the cable television franchise of Spectrum Northeast, LLC and the Village of Williamsville for fifteen (15) years commencing with the date of approval by the Public Service Commission and expiring fifteen (15) years hence; and BE IT FURTHER RESOLVED that the Board of Trustees the Village of Williamsville hereby confirms acceptance of this franchise renewal agreement and authorizes and directs the Mayor to sign the franchise agreement on behalf of the Village. ROGERS #4 RESOLVED, to adopt Local Law #3 of 2022 to amend Chapter 11 (Brush, Grass & Weeds) to suspend the enforcement of the height of grass for a specified period of time in the spring of each year ROGERS #5 RESOLVED, that the Administrator is hereby authorized to publish legal notice for sealed bids for Contract #44 – 2022 Street Paving Project of designated Village roads; and BE IT FURTHER RESOLVED, that bids will be received at the Village Clerk’s Office, 5565 Main Street, Williamsville, New York, until 10:00am on Thursday, August 3, 2022, at which time they will be opened publicly. ROGERS #6 WHEREAS, the Village Board desires to pursue funding opportunities for the Garrison Park Wading Pool and Bath House Project WHEREAS, the Village Board desires to provide this type of facility to residents at the lowest possible cost to the Village and Village taxpayers; and WHEREAS, the Village Board desires to apply for financial assistance from the New York State Office of Parks, Recreation and Historic Preservation: Environmental Protection Fund Grant through the CFA (Consolidated Funding Application); and WHEREAS, the Village Board commits to providing the required local matching funds to insure the timely implementation of the proposed project; NOW, THEREFORE BE IT RESOLVED, that Deborah L. Rogers, as Mayor of the Village of Williamsville, is hereby authorized and directed to accept funds from the New York State Office of Parks, Recreation and Historic Preservation in accordance with the provisions of Title 9 of the Environmental Protection Act of 1993, in an amount not to exceed $300,000 (50% of the total project cost of $600,000), and enter into and execute a project agreement with the State for such financial assistance for the Garrison Park Wading Pool and Bath House Project; and, RESOLVED, that upon approval of the application for financial assistance that the Village make available at least $300,000 (50%) in matching funds to satisfy the requirements of the funding program; and BE IT FURTHER RESOLVED, that the Village Board authorizes the Mayor to sign all documents and agreements related to the New York State Office of Parks, Recreation and Historic Preservation: Environmental Protection Fund Grant Program application. DELANO #1 WHEREAS, The Village of Williamsville, herein called the "Municipality", after thorough consideration of the various aspects of the problem and study of available data, has hereby determined that certain work, as described in its application and attachments, herein called the "Project", is desirable, is in the public interest, and is required in order to implement the Project; and WHEREAS, the authorizes State assistance to municipalities for water quality improvement projects by means of a contract and the Municipality deems it to be in the public interest and benefit under this law to enter into a contract therewith; NOW, THEREFORE, BE IT RESOLVED BY Village of Williamsville Village Board 1. That Mayor Deborah Rogers or such person’s successor in office, is the representative authorized to act in behalf of the Municipality's governing body in all matters related to State assistance under ECL Articles 17, 51 and 56 and/or any applicable federal grant provisions. The representative is also authorized to make application, execute the State Assistance Contract, submit Project documentation, and otherwise act for the Municipality's governing body in all matters related to the Project and to State assistance; 2. That the Municipality agrees that it will fund its portion of the cost of the Project and that funds will be available to initiate the Project's field work within twelve (12) months of written approval of its application by the Department of Environmental Conservation; Total project cost of $7,561,731.00 of which the required match is 25% or $1,890,432.00 (grant request of $5,671,298.00) 3. That one (1) certified copy of this Resolution be prepared and sent to the Albany office of the New York State Department of Environmental Conservation 4. That this Resolution take effect immediately.
