WHEREAS, Section 15-9(E) of the Code of the Village of Williamsville authorizes the Village Board of
Trustees, following a report and recommendation from the Code Enforcement Official, to order the
completion or demolition of an unfinished structure, as defined in Section 15-2 of the Code, under such terms
as the Board of Trustees may direct; and
WHEREAS, a building permit was issued for the construction of a multi-story building on the property
located at 20 South Long Street in the Village of Williamsville (S.B.L. 80.08-5-76.1) (a/k/a 8 South Long
Street) (“Property”) was issued on or about August 9, 2018 and construction of the approved building
(“Structure”) commenced thereafter; and
WHEREAS, the Village Code Enforcement Officer inspected the Property and the Structure on multiple
occasions and, on October 1, 2022, issued a report to the Village Board, pursuant to Section 15-9(E)(1),
finding that the Structure qualified as an unfinished structure due to fact that no construction activity had
occurred for an extended period of time and no certificate of occupancy issued within two (2) years since the
issuance of the building permit; and
WHEREAS, by letter dated November 15, 2022, the Village Code Enforcement Officer notified the owner of
the Property, 20 South Long Street Associates, LLC (“Owner”) that the Property and Structure were in
violation of Section 15-9(E) of the Village Code and requested that the Owner submit, within thirty (30) days
from receipt of said letter, a detailed plan for completion or demolition of the Structure within a reasonable
time frame (“Plan”); and
WHEREAS, the Owner requested, and was granted, a number of extensions to submit the requested Plan,
but, to date, no such Plan has been provided to the Village, nor has construction on the Structure resumed; and

WHEREAS, the Owner was notified in the November 15, 2022 letter and thereafter that failure to submit the
requested Plan or complete the structure within a reasonable timeframe would result in the Village Board
issuing an order to complete or demolish the Structure pursuant to Section 15-9(E) of the Village Code;
NOW THEREFORE BE IT RESOLVED, that the Board of Trustees of the Village of Williamsville,
pursuant to the authority vested in it pursuant to Section 15-9(E)(2) of the Village Code, hereby issues to the
Owner the Order annexed hereto as Appendix A (“Order”); and
BE IT FURTHER RESOLVED, that upon the failure of the Owner to comply with any of the deadlines set
forth in the Order, the Owner shall be assessed a penalty in the amount of $1,000 per day of continued
violation; and
BE IT FURTHER RESOLVED, that the Village Clerk is hereby instructed to cause the Order and certified
copy of this resolution to be delivered to the Owner by certified mail, return receipt requested, or such other
means as to ensure receipt by the Owner; and
BE IT FURTHER RESOLVED, that, in issuing the Order, the Village Board reserves all rights to impose
further penalties or take additional enforcement actions with respect to the Property and the Structure as may
be authorized by law.
APPENDIX A
BOARD OF TRUSTEES OF THE VILLAGE OF WILLIAMSVILLE
COMPLIANCE ORDER
Issued to: 20 South Long Street Associates, LLC

Regarding: Unfinished Structure (“Structure”) located at 20 South Long Street, Williamsville, New York
14221 (S.B.L. 80.08-5-76.1) (“Property”).
Date: November 12, 2024
Order: Based on the continued violation of Village Code Section 15-9(E), as documented in the
accompanying resolution and the documents referenced therein, regarding the Structure
located on the Property you are hereby Ordered pursuant to Village Code Section 15-9(E)(2)
as follows:
1. Within 15 days of receipt of this Order, submit either (a) an application to the Village
Building Department pursuant to Section 15-4(J) of the Village Code to renew the
building permit previously issued for the Structure to complete construction of the
Structure or (b) an application to demolish the structure pursuant to Section 15-5 of the
Village Code.
2. Within 30 days of the issuance of either the renewed building permit or the demolition
permit, commence the work authorized pursuant to such permit.

3. In the case of work undertaken to complete the Structure pursuant to a building permit,
complete such work to the satisfaction of the Code Enforcement Officer within 365 days
of the issuance of said permit.
4. In the case of work undertaken to demolish the structure pursuant to a demolition permit,
complete all such work required pursuant to such permit to the satisfaction of the Code
Enforcement Officer within 90 days of issuance of said permit.
5. Pursuant to Village Code Sections 15-9(E)(3) and 15-15, the Owner shall be assessed a
fine and/or civil penalty in the amount of $1000 per day for each day the Property and/or
the Structure continues to be in violation of any term of this Order.
TORRE #1
WHEREAS, the Village Administrator has returned her warrant and tax roll and has delivered to the Board
of Trustees an account of taxes remaining due, amounting to $129,506.46 containing a description of the land
upon which taxes are unpaid, the person whose name is assessed, together with the amount of unpaid tax; and
WHEREAS, the Village Administrator has filed a verified statement that the taxes mentioned in such
account remain unpaid, and that after diligent efforts she has been unable to collect same; and
WHEREAS, upon receiving such account from the Village Administrator, the Board of Trustees
compared the same with the original tax roll of the Village; and
WHEREAS, said Board of Trustees find such account to be a true transcript and has certified to the effect
that they have compared it with the original tax roll and find it to be correct.
NOW, THEREFORE, BE IT RESOLVED, that the Administrator of the Village of Williamsville is
hereby credited by this Board of Trustees with the amount of said account in said return; and
BE IT FURTHER RESOLVED, that a Certificate executed by each member of the Village Board be
attached to the account of unpaid taxes stating a total of unpaid taxes in the amount of $129,506.46 and
reciting that the account has been compared and found to be correct; and that the Administrator transmit said
account and certificate to the appropriate officer of the County of Erie by November 15, 2024, to enforce
collection pursuant to Section 1442 of the Real Property Tax Law.
HAHN #1
WHEREAS, until 2024, cities, villages and towns had not received an increase in unrestricted state aid (AIM
funding) in 15 years, significantly impacting their ability to provide essential services to their residents; and
WHEREAS, after a prolonged period without financial support, local governments finally received an
increase of $50 million in unrestricted state aid; and

WHEREAS, local officials express their gratitude for the $50 million increase in unrestricted state aid,
recognizing it as a positive step towards addressing long-standing funding challenges; and
WHEREAS, the State has referred to this new aid as Temporary Municipal Assistance, suggesting that such
increase may not continue, jeopardizing the sustainability of crucial municipal programs and services; and
WHEREAS, the property tax cap further limits the ability of local governments to properly fund the
programs and services their residents need; and
WHEREAS, increased and ongoing state aid for local governments is vital for maintaining infrastructure,
public safety, housing and other municipal services; and
WHEREAS, the challenges of inflation, the increasing costs of labor and supplies, and the end of
extraordinary federal aid only accentuate the need for consistent and predictable funding to effectively plan
for the future and meet the growing needs of their residents;
NOW, THEREFORE, BE IT RESOLVED, that the Village of Williamsville calls upon the Governor and
the State Legislature to commit to continuing the additional $50 million in unrestricted state aid in the 2025-
26 State Budget and beyond, and
BE IT FURTHER RESOLVED, that the Village of Williamsville urges state officials to recognize the need
for a long-term plan that ensures consistent and predictable increases in financial support for local
governments that keep pace with inflation.
A copy of this resolution shall be sent to Governor Kathy Hochul, Senate Majority Leader Andrea Stewart-
Cousins, Assembly Speaker Carl Heastie, Senator Sean Ryan, Assemblymember Karen McMahon, and the
New York State Conference of Mayors (NYCOM).

RESOLVED, that the Village Clerk is hereby authorized an instructed to publish an advertisement for bids for
the Drainage Improvement Project (Contract No. 849) to Orchard Street and Park Drive. Bids for the
construction of the Project are to be received at the office of the Village Clerk until Tuesday, December 3,
2024, at 10:00am local time.
