ABSENT City ManagerGreg Dirks CITIZEN COMMENTS (NON. AGENDA ITEMS) None. PUBLICSAFETYREPORT Lt Stewart presented the public safety report. There were 291 calls for service last month, on par with the previous month and year. There were two stolen vehicles reported. A patrol operations mission occurred on December19thinWoodVillageandTroutdalethatencompassedsometrafficenforcementandgeneral pedestrian violations. A total of 22 traffic/pedestrian stops were made with two arrests, seven traffic citationsandfourteentrafficwarnings. A shoplifterwitha handgunwasapprehendedby FredMeyer securityon December4th. Noshotswerefired andtherewereno injuries. Earlymorningon December22nd there was a shooting incident at Madeira Court Apartments. There were no injuries, and four bullet strikes werefoundonthesouthfacingapartmentsandeightshell casingswere located atthe intersectionof Halseyand Birch.Thatcasehasbeen referredto detectivesforinvestigation.Earlymorningon December 24th there was another shots fired call at 23330 NE Halsey across from the Bottle Drop. There were no injuriesbuttherewasa suspectvehicle.Therewasanothershooting incidentatthesamelocation mid-day on the25th.Noonewasreported missingor injured andten shell casingswerefoundattheentranceof FlairApartments. We'renotsure ifthese incidentsareconnectedbuttheyhavebeen referredto detectives forinvestigationandthere is no concernforpublicsafetyatthis point. Miner asked ifthe person involved in the shooting incidents had been found or arrested. Lt. Stewart responded that the incidents were still under investigation. Shell casings are entered into a shareddatabaseand iftheweaponwasused in anothercrimeorshootingincidentthat canhelp the investigation. It'smorethanjusta lawenforcement issue, it's also the responsibility of the community to make sure that it's safe for everyone. Rios-Camposcommentedthatit'spositivenoonewasinjured. Wasit a violentattackorwassomeonejust beingirresponsible?Isthere a deeperproblem? Lt. Stewartrespondedthatoutsidethe investigation,theyhavebeentryingto engagein as muchtargeted enforcementand makingcommunitycontactsinthisareaaspossible. He appreciatedallthe cityevents he was able to attend over the last month and the ability to connect with the community. Minerappreciatesthe reportandthework, especiallythe effortsto engagewiththecommunity. Heasked about the increased assaults listed on the report. Lt. Stewartrespondedthathewouldgetadditionalinformationon thatforthe nextmeeting, not prepared but will have for the next meeting. Rios-CamposthankedLt. City Events . 3rdAnnual HolidayDrive Debrief . Toy Drive Debrief Rios-Campos noted that our residents didn't really benefit from the recent holiday meal drives and questioned what should be done moving forward. Minersuggestedremovingthe holidaydrivedebrieffromthe consentcalendarfordiscussionata future meetingandCouncilconcurred. Upon motion by Rios-Campos,secondedbyAmendandpassing5-0,theConsentCalendarexcludingthe holidaydrivewasapproved. ORDINANCE01-2024:STATESHAREREVENUESHARINGPROGRAM Reeserpresentedthe backgroundon thestaterevenuesharingprogram.Thecity mustelect byordinance to participate in the program to receive the revenue share. Lastyear thiswas about$60, 000 in revenue and will probably be around $63, 000to $64, 000for FY24-25. Upon motion byAmend, secondedby Rios-Camposand passing5-0, Ordinance01-2024wasapproved. RESOLUTION01-2024:ANNUALSYSTEMDEVELOPMENTCHARGESREPORT Reeserpresentedthe backgroundon theannualSDCreport, ThewaterSDCfund beganwitha balanceof $408, 625. There was little revenue received last yearand $166, 000was used to payforthe master plan CityCouncil MinutesJanuary9, 2024 | Page 2 update. There is $259, 017 left in thefund forfuture SDCeligible projects. The sewer SDCfund had a low beginning balance because most of the revenue for three years was used to pay for the additional wastewatertreatmentcapacity. The remainingfundsofaround$29,000wereusedto coverpartofthe masterplan cost. The ParkSDCfundswereusedto payoffthewetlandpark purchaseandthefund is now accumulating resources with a balance ofjust over $100, 000. Rios-Camposaskedifthe ParkSDCfundscanonly beusedforpurchasinglandoriftheycanbe usedfor parkimprovements. Reeser responded that the funds cannot be used for replacement, but they can be used for adding a new amenity or anything that increases the system capacity such as a new playground or skatepark. The same restrictionsapplytowaterandsewer.Asan example,thefundscannotbe usedto replacean existingpipe, buttheycan beusedto payforthe partthatexpandssystem capacityifthe pipewasbeingupsized. Miner asked ifthe SDCs have to be used for the associated utility. ReeserrespondedthattheSDCfundsare restrictedto the correspondingutility. Upon motion by Tan, seconded by dark and passing 5-0, Resolution 01-2024 was approved. RESOLUTION 02-2024: GRESHAM BUILDINGINSPECTIONIGA Niiyama presented the updated Gresham Building Inspection IGA. The current IGAwas established in 2019 and was a 3-year agreement. Gresham updated the IGAto provide consistent language for all three cities and to update the hourly rate that will be updated annually on July 1st. The rate methodology did not change. Other changes include a 180-day termination notice and the ability to share resources such as permit techs. So, if our permit tech was out on an extended leave, we would be able to borrow a permit techfrom Gresham.This IGAexpiresJune30, 2026andsupportstheoperatingplanthat isfiledwiththe StateofOregon'sbuildingcodesdivision.The Citycould seekalternatemethodsforinspectionsbutcannot contract with private entities for these services. Tan askedwhatthe Citydidforbuildinginspectionservices before2019. Niiyama responded that we had an agreement with Gresham prior to the current IGA and before that the Citycontractedwitha privatecompanyuntilthe regulationswerechanged. Rios-Campos asked if there is a cap on the annual rate increases. Reeserrespondedthatthere are restrictionson buildingfund revenuesand Greshamcan'trecovermore than it costs to provide the services. darknotedthatpriorto contractingwithGresham,WoodVillagewasknownforpromptinspectionsand it seemstheservicesnowprovidedbyGreshamhavegreatlyimprovedsincethe Cityinitiallycontractedwith them. NiiyamarespondedthatGreshambuildinghas beena goodpartnerthroughsome large projects and have providedcosteffectiveandefficientservices. Reeser added that they analyze how long their permitting and inspection process takes and we are receivingcomparableservice. RESOLUTION03-2024:ODOTLANDACQUISITIONAGREEMENT NiiyamapresentedtheODOTpropertyacquisitionagreement, Theagreementisfora parceloff238th,just southofSandy,byJackinthe Box. ODOTacquiredthe propertyduringthe 184interchangeproject. There havebeenseveral issuesrelatedto the parcel suchasparkedvehicles,graffiti,andlitterthatwewouldlike to respondsoonerthan ODOTdoes. ODOTaskedifwewantedthe propertyandstafffoundsome deficiencies. Staffcameupwitha recommendationforneededimprovements beforewewouldconsider acquiringthe property, includingnewasphalt. ODOThasagreedto theconditions.Therewouldbe minimal cost to maintain the parcel, two additional storm drains, signs, and general pavement maintenance. Acquiring the property would enable the City to respond to issues in a more efficient manner. Rios-Camposclarifiedthatnoactualfundsarebeingtransferred. Niiyama confirmed there is no cost associated with the property transfer and that the overlay would be completed beforetheactualtransfer. Upon motion by Tan, seconded by Rios-Campos and passing 5-0, Resolution 03-2024 was approved. PORTLANDAIRPORTUPDATE dark presented an update and photos of the Portland Airport renovation. He has served on the citizen noise advisory committee since 2010 and recently attended a tour ofthe renovation project. The new ceilingis composedofWesternred cedarselectedfromall the Indiantribesin Oregonandeachairscape (hole) isfora specifictribe.The buildingis supportedfromthetopdown andeventheflooris held up bythe ceiling becausethe airportis builton unstableground.Thepillarsweredriven 165ft intothesoilto support thestructure. Thisdesignwill permitthe buildingto moveasmuchas2 feetin anydirectionduringan earthquake. The open public area includes a stage area, and the ticketing and security areas will be set up differentlyforbetterflow. Themainareawill becompleted bythe endoftheyearandthe remainderby Marchof2025. DIRECTOROFPUBLICWORKSREPORT Niiyamapresentedthe publicworksreport. Onestaffmemberaccepteda positionat Greshamand resigned. Kyler and Garrett celebrated their 4-year anniversary. Mary is working on her permit tech cert. Erikacompleted a 12-weeksupervisorcourseand her1stsemesterin the Bachelordegreeprogram in Public Administration at Eastern Oregon. Tany's and Chipotle opened, and the Park restroom design is at 50%. The main sewer trunk line CCTV was completed by RH2 Engineering along with their initial assessmentandweare movingtowardsa 6-monthflowmonitoring projectto determinethecontribution from Fairview and Wood Village. Three big belly solar compacting garbage containers were installed along Halsey, and they will alert staffwhen they need to be emptied. Staffare evaluating other locations for the remaining two. CityCouncilMinutesJanuary9, 2024 | Page 4 DIRECTOROFFINANCEREPORT Reeser presented the finance director report. Property tax revenues were released in November and staff have reached out to the County with some questions to clarify their calculations. Minernotedthatwe collected substantiallymorethan budgeted. Reeser responded that the budget number is prorated over the whole year and the funds are typically receivedin Novemberand December.Webudgetedconservativelythisyear, andthetaxassessedvalue onlywentup 2.5%thisyear. It hadbeen increasingabout4 to4.5%forthe pastseveralyearsandthat's whywe contacted them. Minernotedwearestill getting 5%in LGPIinterest. Reeser added that we would be bringing an update on the investment policies to Council since the interest rate hasincreasedso quickly.TheCityhasboughtbondspreviouslyand it mightbea goodtimeto invest before the interest rate decreases. Staffwill look at cash flow over the next three to five years to see what's available for investment. Interest revenue this year looks like it will be about Vzmillion dollars. MAYOR& COUNCILCOMMENTS Miner noted he will be out of town most of February and March and will be attending meetings remotely. Thoughtsand prayersarewithGregand KirstinandCouncilhasfaithin staffto handleeverything. Rios-Camposcommentedthatthe Natural Leadersheldtheireventlastweek.
