END MEETING Page 2 of 27 MINUTES Park Board 4:00 PM - Wednesday, June 14, 2023 200 East Scott Avenue - Woodland, Washington The Park Board of the City of Woodland was called to order by Brad Hammons on Wednesday, June 14, 2023, at 4:10 PM, at the Police Station 200 East Scott Avenue - Woodland, Washington. Roll was taken. Scott Hill Park and Sports Complex Update • Sandy Larson shared with the committee that the road will be paved, sidewalks, curbs and gutters to be completed. • Planter's Day the Rotary will have a booth to share with the public the progress of the park and what is planned, since the public can't see it. Last year everyone was very excited. • Gold Leaf event will be held on October 21, 2023 at Summit Grove Lodge with a table sponsorship of $500.00 for 8 which includes dinner. Page Page31ofof27 4 • Tracy Coleman shared with the committee that we received an RCO grant for one field of artificial turf for Scott Hill Park. C. Horseshoe Lake Update • We have added additional cleaning of the porta potties for the summer months of 3 times per week instead of 2 times. Summer cleaning are scheduled for Monday, Wednesday and Friday. D. Horseshoe Lake Water Testing • Tracy Coleman shared with the committee that the lake testing contractor rates more than doubled so we took back the lake testing to be done in house. E. Horseshoe Lake Tracking Log • Kathy Morrison shared with the committee that the lake is down to -8" this summer. Last year the lake was still full at this time. Kathy has been in contact with WSDOT to confirm that the pump has been running. F. Park Hours • The Park Board continued to discussed the City park hours, which are currently from 6:00 am to 10:00 pm. Moved by Park Board, Vice Chair Adonica Simpson, seconded by Park Board Pat Rychel, to change the current code from dusk to dawn. NEW BUSINESS G. 2023-Draft Park Plan • Tracy Coleman shared that the Park Plan was adopted and approved in the May 15, 2023 Council meeting. H. Quit Claim Deed and Agreement for Land Donation From Dobbe Family • Tracy Coleman shared that Benno Dobbe would like to donate land to the City of Woodland for Park use. I. Park Graffiti • Tracy Coleman spoke to the committee concerning the continued daily struggles that we have with vandalism and graffiti in our parks. J. Horseshoe Lake Park Extension Page Page42ofof27 4 • The Horseshoe Lake Park extension is the property across the street from the Public Works Shop at 38404 Lakeshore Drive. Tracy Coleman shared with the committee that this property was recently fenced off and hoping to add a parking area soon. • Arbor Day was celebrated at our new pocket park with the planting of 2 new trees. K. Local Parks Maintenance Grant • Tracy Coleman shared with the committee that there is a new RCO grant coming up for Park Maintenance that has never been offered before. Tracy shared we have lots of ideas for this grant and planning to apply. L. Park Donation • Tracy Coleman spoke to the Park Board concerning the confusion of the signage that was put up at the parks requesting donations. The initial signage was incorrect and was taken down immediately on Tuesday after Memorial Day and replaced. The donations that came in over that weekend for a total of $130.00 $15.00 came from Woodland residence the rest was from out of town. M. Park Impact Fees Moved by Park Board, Vice Chair Adonica Simpson, seconded by Park Board Pat Rychel, to update the park impact fees. Updated Street Tree List • Tracy Coleman shared that the street tree planting list has been updated. O. Horseshoe Lake Park - Life Jacket Donation • Kathy Morrison shared with the committee that she was contacted by a Girl Scout Troop #41125 Brownies that would like to donate 10 life jackets to Horseshoe Lake Park. Kathy put the scout leader in contact with Donny which overseas the life jackets in our parks. We greatly appreciate this donation, VI. OTHER P. (First Reading) Summary Statement: Upon recommendation of the Woodland Police Department and discussion with the Park Board Committee, we propose changing the following Woodland Municipal Code 9.52.150 - Acts prohibited in parks from city parks hours of 10:00PM and 6:00AM, to read dusk to dawn. Current Municipal Code Reads: A. The following acts within the parks of the city are prohibited: 1. Overnight camping and occupying or frequenting of the city parks between the hours of 10:00 p.m. and 6:00 a.m.; (Ord. 825 § 2 (part), 1996) Propose changing it to the following language: A. The following acts within the parks of the city are prohibited: 1. Overnight camping and occupying or frequenting of the city parks between dusk to dawn; Recommend changing WMC to update Park Hours from Dusk to Dawn. WHEREAS Title 9 of the Woodland Municipal Code has not been updated since 1996 and, WHEREAS, during the ensuing period, the Washington State Legislature has modified several of the misdemeanor and gross misdemeanor crime provisions applicable state-wide and in the unincorporated areas of the state; and, WHEREAS, RCW 35.21.163 requires that the penalties attaching to municipal criminal code previsions provide the same penalties as are prescribed by state law. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF WOODLAND, STATE OF WASHINGTON, DOES ORDAIN AS FOLLOWS: REDACT 9.52.150 Acts prohibited in parks. The workshop was requested for July 3rd, 2203, with the accompanying ordinance and resolution to be returned to the council on July 17th, 2023. Staff will discuss the legal basis for impact fees, how fees are calculated, and limitations for how impact fees can be spent. (Final Reading) Summary Statement: The city recently adopted a new Park Plan this year. Park Impact Fees (PIF) have not been recalculated since 2005. The Revised Cost Per Household in 2005 was 2.85 for Single Family Residence and 2.12 for Multi-Family residence. We recommend changing the variable "D" in the formula to 2.71 for Single Family and Multi-Family residence based on the 2020 Census Data. This would make Park Impact Fees the same for Single Family Residence and Multi-Family Residential construction. Public Works Committee and Park Board Committee recommend approval of modification of the "D" variable in the formula for determining park, recreation, open space or trail impact fees. WHEREAS, development of single family, multi-family residential development, condominiums and all multi-family structures, office, commercial, manufacturing, and industrial buildings are deemed to have a direct impact on park, recreation, open space or trail facilities in as much as an increased population and density thereof strains these city resources; and, WHEREAS, it is necessary to assess certain fees which are proportionate to the impact of development in order to accommodate rapid growth in the city and the attendant strains on city capital assets of the park, recreation, open space or trail facilities; and, WHEREAS, the state legislature has specifically authorized the imposition of impact fees under RCW 82.02.050, 82.02.090; and, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF WOODLAND, STATE OF WASHINGTON, DOES ORDAIN AS FOLLOWS: REDACT 3.41.160 5. “D = The average number of occupants per dwelling unit, or 2.85 occupants for a single-family/duplex dwelling unit, and 2.12 occupants for any other multi- family dwelling unit.” ADOPT 3.41.160 5. “D = The average number of occupants per dwelling unit, or 2.71 occupants for a single-family/duplex dwelling unit, and 2.71 occupants for any other multi-family dwelling unit.” This ordinance shall become effective five days after passage, approval, and publication as provided by law. Randolph, City Attorney Page 16 of 27 Agenda Item Report Meeting Date: City Council Regular Meeting - 3rd Monday - 19 Jun 2023 Department: Public Works Staff Contact: Tracy Coleman, Public Works Director Subject: Authorize Mayor to sign Memorandum of Understanding between Mr. Benno A.P. Dobbe and the City of Woodland Summary Statement: On October 3, 2022 city council agreed to accept Benno Dobbe's land for the City of Woodland park use. This parcel will be adjacent to Horse Shoe Lake park and the city will endeavor to create a splash pad with restrooms with this land donation. The city will seek charitable contributions and solicit grant funding for the design and development of the facility to compliment Horseshoe Lake Park. The city has already received $82,000 in Legislative Funds to put towards a Splash Pad. The attached MOU has been reviewed by the City Attorney and staff and executed by Mr. Benno Dobbe for donation of the parcels. Part of this agreement includes the city compensation to Benno Dobbe’s attorney fees and other related expenses, this is estimated at approximately $10,000. These parcels will go towards projected overall land needs and capital projects as identified in the 2023 Park Plan. Public Works Committee and Park Board Committee recommend authorization of Mayor to sign MOU for land donation of parcels 508000100 and 50007. Financial Impact: Cost of Item: $10000 Bars Code: 352-000-000-508-31-00-00 Amount Budgeted: $0 Bars Code description: Unexpended Balance: $10000 Impact Fees: Park Attachments: Memorandum of Understanding Page 17 of 27 MEMORANDUM OF UNDERSTANDING This Memorandum of Understanding ("MOU”) is made this day of May 2023 between Mr. Benno Dobbe ("BAPD") and the City of Woodland (”the City”), a political subdivision in the State of Washington, with BAPD and the City jointly hereafter referred to as the ”Parties." WHEREAS,the Parties have had various informal discussions about BAPD’sintention to donate parcels of land adjacent to Horseshoe Lake Park owned by BAPD and KlazinaDobbe (”the Parcels”) to the City; and WHEREAS, an unexecuted Agreement for the Benefit of the City of Woodland Parks (”Agreement”) and Quit Claim Deed ("QCD”) were prepared about the Parcel and dated September 7, 2022; and WHEREAS,the Parties wish to begin the transfer of the Parcels to the City by mutually agreeing to the key conditions for BAPD to proceed with the transfer of the Parcel’s title to the City; and WHEREAS,the Parties acknowledge that the Parcels, No. 50007 and 508000100, will be used for a project where funding is fully obtained by the City to construct a parkwith a tulip theme and water feature and to be continuously operated by reasonable financing provided by the City (”the Park”); NOW, THEREFORE,the Parties mutually agree to the following: 1. The Parties fully rescind the Agreement and QCD dated September 7, 2022. 2. The City accepts the Parcels "as is" with appropriate documentation mutually agreed upon by legal counsel of both BAPD and the City. 3. The City agrees to indemnify, defend and hold harmless BAPD, his wife and his heirs from any and all future claims, arising out of the BAPD’sownership said parcels. Mr. Dobbe warrants that he presently is not aware of any such claims or potential liabilities. 4, The City is fully responsible for all r e a s o n a b I e costs incurred to complete the transfer of title and the acceptance by the City, including but not limited to any transaction closing costs, legal fees ofthe Parties forthe documentation preparation, environmental assessments, appraisal, survey, taxing district modifications, escrow and title costs, and other related items. 5. The City agrees to pay BAPD reasonable attorneys’ fees and other related expenses. 6. The City agrees to create and maintain a city recreational facility which will enhance the City's park portfolio, consisting of a water feature, outdoor restroom, adequate parking, and will be permanently named "Benno and Klazina Dobbe Memorial Park.” The City agrees that, in good faith, it will build, install and maintain a splash pad as the main park feature. BAPD agrees that if maintaining the splash pad becomes unduly burdensome to the City, the splash pad may be replaced by some other, attractive water feature, but continue to exist with a tulip theme. Page 18 of 27 7. The parties agree that these covenants, conditions and restrictions will be included and recorded In the conveyance document. IN WITNESSWHEREOF, the Parties have executed and delivered this MOU effective May 2023.
