Financial Impact: Cost of Item: $0 Amount Budgeted: $0 Bars Code description: Unexpended Balance: $0 Attachments: Ord 1372-Establishing Salary Commission Page 2 of 11  ORDINANCE N0._1372 AN ORDINANCE OF THE CITY OF WOODLAND, WASHINGTON ESTABLISHING A SALARY COMMISSION WHEREAS, the Revised Code of Washington (RCW) 35.21.015 authorizes council to establish a salary commission; and WHEREAS, the RCW 35.21.015 provides for the duties and responsibilities of salary commission members; and WHEREAS, the setting of salaries for elected officials should be transparent, open and accountable to the electorate; and WHEREAS, the City recognizes the need for equitable, adequate and fair compensation for those working for the benefit of the citizens. NOW THEREFORE, the City Council of the City of Woodland, Wa shington does hereby ordain as follows with the creation of a new chapter until Title 2, Administration and Personnel. SECTION 1. Chapter 2.84- SALARY COMMISSION 2.84.010 Membership, appointment, compensation, term. (1) There is created a salary commission for the city of Woodland. The commission shall consist offive members who are residents and registered voters of the city, to be appointed by the mayor with the approval of the city council. (2) A member of the commis sion shall serve for a four-year term without compensation. The initial membership shall be appointed for staggered terms with one member serving a two-year term, two members serving three-year terms and two members serving four-year terms. (3) No member of the commission shall be appointed for more than two terms. (4) A member of the commission shall not be an officer, official, or employee of the city or an immediate family member of an officer, official, or employee of the city. For purposes of th is section, "immediate family member" means the parents, spouse, siblings, children, or dependent relatives of an officer, official, or employee oft he city, whether or not living in the household of the officer, official, or employee. 2.84.020 Definitions. (1) "Salary" or "salaries," as used in this chapter, means a total cost of compensation provided to any elected official, specifically including any fixed compensation paid periodically for work or services and the total cost of any benefits provided. (2) This definition expressly excludes any expenses paid or reimbursed on behalf of any elected official in compliance with city council policy and procedure for travel and business expense reimbursements. 2.84.030 Vacancies. In the event of a vacancy in office of commissioner, the mayor shall appoint, subject to approval ofthe city council, a person to serve the unexpired portion of the term of the expired position. Page 3 of 11 2.84.040 Removal. Commission members may only be removed during their terms of office for cause of incapacity, incompetency, neglect of duty, malfeasance in office, or for a disqualifying change in residence or voter status. 2.84.050 Duties. (1) The commission shall have the duty to review the salaries paid by the city to each elected city official. If after such review the commission determines that the salary paid to any elected city official should be increased or decreased, the commission shall file a written salary schedule with the city clerk indicating the increase or decrease in salary. (2) Any increase or decrease in salary established by the commission shall become effective and incorporated in the city budget without further action of the city council or the commission. (3) New salaries shall be timed to be effective simultaneously and equally to all city council members. The commission shall file its salaries for elected city officials no later than September 1. The commission shall file subsequent schedules on a bi-yearly basis following the effective date of the ordinance codified in this subsection. Each schedule shall be prepared in a form approved by the city attorney. The signature of the commission chair shall be affixed to each schedule submitted to the city clerk. The commission chair shall certify in writing that the schedule has been adopted in compliance with: (a) the rules and procedures, if any, of the commission; (b) the provisions of this chapter; and (c) other applicable laws including the State Constitution. (4) The decision to raise or lower salaries shall be by the decision ofthe majority of the commission. (5) Salary increases established by the commission shall be effective as to all city-elected officials regardless oftheir terms of office and shall be_effective_January 1st ofthe_adopted budget. (6) Salary decreases established by the commission shall become effective as to an incumbent city- elected official at the commencement oftheir next subsequent term of office. 2.84.060 Meetings, operations and expenses. The meetings and operations of the commission shall be conducted as follows: (1) All meetings, actions, and business of the salary commission shall be subject to the Open Public Meetings Act, Chapter 42.30 RCW, and the Public Records Act. Prior to filing of any salary schedule : (a) The commission shall first develop a proposed schedule; then (b) Publish notices in the same manner as the city council agendas; and (c) Hold at least one public meeting to accept public comments thereon, within one month immediately proceeding the filing of the salary schedule. (2) Operations. Except as provided hereinafter, the salary commission shall be solely responsible for its own organization, operation and action, and shall receive the fullest cooperation of all elected and appointed city officials and employees, departments and agencies of the City of Woodland. Staff support shall be provided as determined in the city budget and by the city manager. The members of the commission shall select a chair from among their number. Page 4 of 11 2.84.070 Referendum. Any salary increase or decrease established by the commission pursuant to this chapter shall be subject to referendum petition by the voters of the city, in the same manner as a city ordinance, by filing of a referendum petition with the city clerk within 30 days after filing of a salary schedule by the commission. In the event of filing of a valid referendum petition, the salary increase or decrease shall not go into effect until approved by a vote of the people. Referendum measures under this section shall be submitted to the voters of the city at the next following general or municipal election occurring 30 days or more after a petition is filed, and shall otherwise be governed by the provision of the State Constitution and the laws generally applicable to referendum measures. Section 2. Severability. If any section, sentence, clause or phrase of this ordinance shall be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this ordinance . Section 3. Regulatory Conflicts. All other Ordinances and parts of other Ordinances inconsistent or conflicting with any part of this Ordinance are hereby repealed to the extent of the inconsistency or conflict. Section 4. Corrections. The City Clerk and the codifiers of this ordinance are authorized to make necessary clerical corrections to this ordinance including, but not limited to, the correction of scrivener's/clerical errors, references, ordinance numbering, section/subsection numbers and any references thereto. Section 5. Effective date. This ordinance shall be in full force and effective thirty (30) days from the passage and published in accordance with law. Financial Impact: Cost of Item: $0 Amount Budgeted: $0 Bars Code description: Unexpended Balance: $0 Attachments: Decision 2023-01_Salary Commission Mayor / Councilmember Salary Survey Page 7 of 11  CITY OF WOODLAND, WASHINGTON SALARY COMMISSION DECISION NO. 2023-01 A 2024 SALARY SCHEDULE FOR ELECTED OFFICIALS WHEREAS, The Salary Commission of the City of Woodland received public comments on August 14, 2023; and WHEREAS, The Salary Commission at its meeting on August 14, 2023 adopted a salary schedule for elected officials. NOW, THEREFORE, THE SALARY COMMISSION OF THE CITY OF WOODLAND, WASHINGTON, HAS SET CITY OF WOODLAND ELECTED OFFICIAL SALARIES BY A MAJORITY VOTE AS FOLLOWS: Section 1: • City Council: (effective January 1, 2024) o Base pay of $150 per month plus; o $50 per attendance at a City Council meeting with a maximum of four (4) meetings per month plus; o $25 per attendance at a city membership meeting with a maximum of two (2) meetings per month. • The Salary Commission defines the membership meeting as a meeting in which the City Councilor is representing the City of Woodland and voting on issues that come before the group. Examples include Association of Washington Cities meetings or Cowlitz-Wahkiakum Council of Governments meetings. The Commission also includes speaking engagements where the City Councilor is listed on an agenda as a speaker for a meeting. • Mayor: (effective January 1, 2024) • $550 per month Section 2: The Commission Chairperson certifies that the above salary schedule has been adopted in compliance with the rules and procedures of the Salary Commission, the provisions of Chapter 2.84 of the Woodland Municipal Code and other applicable laws including the State Constitution.
