Mr. Haderlie that said he wanted to nominate Bonnie Craig for Council Kudos, for bringing to his attention a strong wind event that was forecast to happen in the area. Mr. Haderlie said Bonnie had asked if there were special preparations being taken for the high wind alert that was forecast in Davis County and she was concerned because of a similar event had previously taken place in the city a few years ago causing damage and concerns. He said he appreciated her bringing this to his attention and that it enabled him to communicate with the departments to ensure the city was prepared for the event. Bonnie also came in on Friday to help Sonia with phones in case there was a need for extra help that day. He appreciated her willingness to see where extra help might be needed and take that opportunity to help. The Council thanked Bonnie for her good work and Council Member Checketts said she would be given a gift card as a thank you for her efforts. OFFICIAL MINUTES WOODS CROSS CITY COUNCIL MEETING APRIL 2, 2024 PAGE 2 YOUTH CITY COUNCIL REPORT Mayor Protem Larrabee gave the floor to LaCee Bartholomew, Community Services manager, who reported that the YCC had just held their annual Egg-stravagana and it was a great success; they had raised $2000 for their Sub for Santa service activity with their silent auction and Easter Baskets. She said it was a great event and had a great turnout. She also reported the YCC had gone to their leadership conference in Logan and had a good time at that activity. It was also noted they are accepting applications for new YCC members for next year. CONSIDERATION TO APPROVE MINUTES The Mayor Protem called for the review of the minutes for the City Council meetings held 03/07/24, 03/19/24, and 03/20/24. Following the review by the City Council, Council Member Terry made a motion to approve the minutes as written with Council Member Checketts seconding the motion and all voted in favor of the motion through a roll call vote. RATIFY CASH DISBURSEMENTS The Mayor Protem called for the review of the cash disbursements for the time period of 03/07/24-03/28/24. Following the review by the City Council, Council Member Checketts made a motion to ratify the cash disbursements for the time period of 03/07/24-03/28/24. Council Member Kelemen seconded the motion, and all voted in favor of the motion through a roll call vote. CONSIDERATION TO APPROVE RESOLUTION 2024-854 APPOINTING CHIEF OF POLICE The Mayor Protem gave the floor to the City Administrator who asked for the Council’s approval of the appointment of the new Police Chief for Woods Cross. The City Administrator introduced James Bigelow. Mr. Bigelow brings many years of experience to Woods Cross City. He said everyone was excited to welcome him to the city and are looking forward to working with him. Chief Bigelow will start on April 29th and will be sworn in at a future City Council meeting. The Mayor also thanked Chief Bigelow for his willingness to serve the community of Woods Cross. Chief Bigelow thanked the Mayor and Council for this opportunity and said he was looking forward to getting to know everyone at the city and being able to start taking on his new responsibilities. Council Member Sharp then made a motion to approve resolution 2024-854, a resolution appointing James Bigelow as Chief of Police for Woods Cross City. Council Member Checketts seconded the motion, and all voted in favor of the motion through a roll call vote. CONSIDERATION TO APPROVE RESOLUTION 2024-853 APPOINTING HUMAN RESOURCE/RISK MANAGEMENT DIRECTOR The City Administrator continued with the floor and noted he would be asking for the Council’s approval for the appointment of Cassandra Hart as the new HR/Risk Management Director for Woods Cross. He said she had 20 years of experience in this area and would be a great asset to Woods Cross City. OFFICIAL MINUTES WOODS CROSS CITY COUNCIL MEETING APRIL 2, 2024 PAGE 3 The City Administrator introduced Ms. Cassandra Hart to the Council. They said they were also looking forward to working with her and thanked her for accepting this new job to work with Woods Cross City. Council Member Checketts then made a motion to approve resolution 2024-853, a resolution appointing Cassandra Hart as human resource/ risk management director. Council Member Terry seconded the motion, and all voted in favor of the motion through a roll call vote. PUBLIC COMMENT The Mayor Protem then opened the meeting to public. There were no public comments, and the Mayor Protem closed the public comment portion of the meeting. CONSIDERATION TO APPROVE SITE PLAN FOR THE CHOICE LEARNING CENTER LOCATED AT 1475 W 500 S The Mayor Protem gave the floor to the Community Development Director who noted the following for the City Council: “During the last City Council meeting, the Council approved a Master Development Plan for The Choice Learning Center. Mr. Paul Tanner has followed up with the final site plan for the project. It has been reviewed by the staff including the city engineer and the fire marshal. Given to the Council is the final site plan and architectural drawings for the site. “Given to the Council is a final landscape plan. During the staff and Planning Commission review, Mr. Tanner’s landscape architect had not specified the exact location, number, and type of ground cover and shrubs for the project. As Mr. Tanner has a short timeline to construct the project, the Commission required Mr. Tanner to submit a revised plan with the required detail prior to the City Council review. Given to the Council is that landscape plan which now includes not only tree specifications but also shrubs and ground cover. In addition, Mr. Tanner also needed to submit an updated utility profile and civil plans for an existing storm water culvert. This was completed and reviewed and approved by the city engineer. “The storm water drainage for this project will be channeled to an existing drainage channel which crosses adjacent property to access the A-2 Drain. Mr. Tanner has been required to obtain a signed, notarized document from the adjacent property owner authorizing permission to utilize this drainage across the property. Mr. Tanner has now submitted a copy of the drainage easement agreement. “During the Planning Commission meeting, it was noted that Mr. Tanner had submitted a UDOT email to the staff which indicated that a 500 South access permit had been obtained. The Planning Commission required that Mr. Tanner submit a copy of the actual UDOT access permit which has now been done. The Planning Commission has forwarded to the City Council a recommendation to approve a site plan for The Choice Learning Center with the following conditions: 1. The applicant, city attorney, and staff shall draft a development agreement for the City Council’s review and approval. The development agreement shall be signed and recorded prior to construction of the project. OFFICIAL MINUTES WOODS CROSS CITY COUNCIL MEETING APRIL 2, 2024 PAGE 4 2. Project construction shall comply at all times with city ordinances including but not limited to those relating to noise and dust control. 3. Prior to construction the applicant and his contractor shall participate in a pre-construction meeting with the city engineer and the public works director 4. The applicant shall submit a signed, notarized document of permission to utilize the private storm drain on adjacent property east of the subject property. (COMPLETED) 5. A final landscape plan shall be submitted for staff review and approval. (COMPLETED) 6. Applicant shall submit a copy of the actual UDOT access permit to the City. 7. The utility profile of the civil plan shall be corrected showing the existing collard in the current location and elevation in addition to looping of the collard/storm drain at the water line location. This information shall be submitted to the city engineer for review and approval. (COMPLETED) 8. Staff shall be required to brief the City Council regarding the incomplete landscape plan, letting the Council know there needs to be a thorough review of the plan. Following the information given by Mr. Stephens, the Mayor Protem asked Mr. Stephens what the intention was as far as beginning the project and also when the project is projected to be finished and opened. Mr. Stephens said Mr. Tanner has an ambitious schedule, wanting to have the school up and operational by the start of school in August. Mr. Stephens said this is a tall order, but the city has worked with Mr. Tanner to help facilitate the project and to get this project approved so Mr. Tanner could move ahead as quickly as possible. The Mayor Protem asked if there would be any negative issues for the city if the project were not to be able to be completed by the August date. Mr. Stephens said he did not see anything that might negatively impact the city. He said Mr. Tanner did need to get completed plans and permits and to get the finalized development agreement for the half street that will be constructed and dedicated to the city in the future. There were no further questions and Council Member Checketts made a motion to approve the site plan for The Choice Learning Center with the conditions as listed above. Council Member Sharp seconded the motion, and all voted in favor of the motion through a roll call vote. CONSIDERATION TO ADOPT RESOLUTION 2024-852 APPROVING AMENDMENTS TO EMPLOYEE MANUAL RELATED TO POLICE DEPARTMENT SUPPLEMENTAL PAY-AMENDMENTS TO WXC EMPLOYEE POLICY MANUAL, SECTION XII The Mayor Protem gave the floor to Chief Buchanan who noted proposed amendments to the employee manual associated with supplemental compensation in the police department. Following the information given, Council Member Sharp thanked Chief Buchanan for his time and effort on this matter, as well as all that Chief Buchanan had done for the city in the past months as he had served as the Interim Police Chief. There were no further questions or comments, and Council Member Checketts made a motion to adopt resolution 2024-852, a resolution approving amendments to the employee manual. Council Member Kelemen seconded the motion, and all voted in favor of the motion through a roll call vote. OFFICIAL MINUTES WOODS CROSS CITY COUNCIL MEETING APRIL 2, 2024 PAGE 5 AMENITIES SEASONAL OPENINGS AND CLOSINGS The Mayor Protem gave the floor to the Public Works Director. He noted the following for the City Council: “Over the last 3.5 years, I have noticed that there has not been a policy on when certain park amenities are closed for the winter and reopened in the spring. This unclear direction has caused confusion and issues between Staff and the public as the use increases. Creating a policy with consistent dates will help reduce the confusion and help with the planning for reservations, events, and overall use. Your input is vital for me to create this policy as we work to balance the use and protection of our amenities to help keep costs low. A clear, consistent, well-communicated policy that is not deviated from and will help reduce confusion and set expectations for Staff. After this discussion, I will prepare a policy and will bring it back to the Council for formal approval. From what I have found: • There is no formal policy other than “that’s what we have always done.” • There is pressure to deviate from what has been done in the past. • No City code dictating restrictions • Prior to 2020, parks staff informed me that the restrooms, nets, Pavilion reservations, and drinking fountains would open on April 15 and close on October 15 every year. o Restrooms have no heat, and to winterize, Staff has to blow out all the water based on 20+ years of repairing frozen pipes. City staff remove certain waterlines and fixtures to save time and money when they are prepared for reopening. o Without proper precautions, pipes will freeze under concrete/brick, and repairs are very costly in the restrooms and drinking fountains. Staff cannot start putting the restrooms back together until temperatures allow, and it usually takes 2-3 days to reopen all if there are no frozen/broken parts. o The City Council has asked that the Leagues pay for the porta-potty rentals when scheduling games when the restrooms are closed. o Nets are removed to have a longer life span and help preserve court surfacing. o Pavilion reservations and soccer/baseball field uses are allowed starting March 15 and ending October 19 for pavilions and October 31 for the fields. I need to create a policy that I will bring back to the Council is decisions on the following: • Restroom availability dates o Hard closure for any use from October 15 to April 1. It may close early or open late if cold temperatures are forecasted. o Installing heat in restrooms costs around $20,000 to 30,000 dollars. Portable heaters are not an option to keep restrooms open as they are easily stolen or turned off. o Other Cities are now putting porta potties (even if they have heated restrooms) for the shoulder seasons. NSL puts porta-potties out all winter long to help prevent transients from sleeping in them. • Drinking fountains o These are the most exposed to freezing as they are standalone or on the outside of the restroom buildings. o We recommend following the restroom availability dates OFFICIAL MINUTES WOODS CROSS CITY COUNCIL MEETING APRIL 2, 2024 PAGE 6 • Pavilion rentals o Reservations are allowed from March 15 to October 31 o Pavilion cleaning ▪ Pavilions will be cleaned, and full garbage cans will be addressed prior to reservations and city events. They will be cleaned a minimum of once a week, and garbage will be emptied/checked every weekday during the growing season. They will be checked weekly in the off-season. ▪ No water is available at the pavilions outside the secondary water timeframes, so we cannot pressure wash if the irrigation water is off. ▪ Can purchase a pressure washer with a water tank that fits in a pickup to pressure wash the tables and cement ahead of reservations and city events in the shoulder water seasons ($4,000-5,000). Many cities utilize this. ▪ I will provide Standard Operating Procedures (SOP) in the Council meeting that the parks department follows when cleaning the pavilions for reservations and city events. • Nets o Pickleball ▪ Keep current dates and policy that was decided in Council 2 years ago • Remove 3 of the 6 nets on November 1 • Lock gates during snowstorms and when snow is on the courts to prevent surface damage from shoveling • All nets back up the first week of March, depending on the snow o Volleyball and Tennis ▪ Take down nets on November 1 ▪ Reinstall Nets on March 15 o Basketball ▪ Open year-round o Frisbee Golf ▪ Open year-round • Turf oriented fields o Follow the guidelines in the Athletic Use policy o LaCee and Staff will meet to discuss timelines for opening and closing ▪ Weekly in the late winter and spring until fields are available ▪ Monthly in the growing season ▪ Weekly in the fall until fields are closed o 1 Soccer field will be rested at all times for repairs/maintenance and recovery. A formalized policy is needed so that plans can be made, and restrooms can be open for reservations and planned sports events. It was also noted bathrooms could be opened for planned city events and spring break when people are taking advantage of the parks. There was discussion of having the restrooms open April 1st and having porta johns placed prior to any planned city events. The Public Works Director noted that the city Halloween activity has been moved to the first part of October which has been good because the restrooms are still open as long as weather allows. He said Easter is a little trickier since it comes a little earlier and there is still a chance that things could freeze. He said he felt like it would still be a good idea to have a policy as to when amenities would be open and closed so there could be a plan and an a OFFICIAL MINUTES WOODS CROSS CITY COUNCIL MEETING APRIL 2, 2024 PAGE 7 expectation for the staff and for the public. He said if restrooms were opened before April 1st there would need to be consideration to place heat in the restrooms. Council Member Checketts asked why the pavilions are being opened before April 1 st. The Community Services Manager noted that there had not been reservations before April 1 st until this year, which there had been an error in allowing that, and it had been fixed. She noted that the system does not allow reservations until April 1st. The Public Works Director said there was a reservation last year before April 1st. The City Administrator said he would like to propose putting porta potties in some of the higher use parks during the winter since people are still using the trails for walking during that time. He said he would like the cost for the portable restrooms to be added to the city budget and the city bear the cost of that and then if there are leagues wanting to rent the fields, there could be more portable bathrooms for those occasions. Council Member Sharp noted he liked the idea of putting in the portable bathrooms. He said he would like to make sure there are enough facilities for the demands. He also said he thought it was a good idea to have a firm date for opening and closing the restrooms so staff could plan around those dates. He said he does know that weather fluctuates here often in the spring. The Community Services Manager said the state contracting cost for portable restrooms is $165 for a month and there is one weekly cleaning included for the portable restrooms. She said it is a more significant cost if they are rented from a private company. Council Member Checketts asked if we are opening up the city to problems for vandalism and for tipping the restrooms over. The Public Works Director noted that some cities have put a restroom right next to an existing building and anchor them next to the building so they cannot be tipped over. The Community Services Manager said they have had portable restrooms in the parks for 3 years and have not had any problems with them. The Public Works Director said there was concern about the large trucks coming to have the portable restrooms cleaned at Mills Park if they were to be located near the upper bathrooms. The Community Services Manager said they have only put them down by the snack bar and the west end of the park so that has not been an issue. The Public Works Director said they could put one up in the upper parking lot at Mills Park to avoid that issue. There was discussion on how many of the portable restrooms would be needed during the wintertime and when they could be placed. Council Member Checketts said she would like to have the restrooms open on April 1 st. Council Member Terry asked if the restrooms were open on March 15th, would it not be too cold if the restrooms could be locked, and a propane heater put inside so the pipes would not freeze for an event. The Public Works Director said the building could be protected itself, but they were not sure if the small heaters they would use would be able to keep up with heating the bathrooms since there is no insulation in the buildings at all. The Public Works Director said he would do what the Council would like but he wanted to make sure the information was given so they were aware of the possibility of freezing pipes. Council Member Terry said he likes the idea of having a portable restroom during the early spring and it was a minimal cost to rent them and clean them. He said the weekly cleaning could be done by staff OFFICIAL MINUTES WOODS CROSS CITY COUNCIL MEETING APRIL 2, 2024 PAGE 8 instead of paying the state to do the weekly cleaning, and then the restrooms could be pumped when they got full. He said he did not feel like they would be full in a week in early spring unless they were used for a city function, then they may be used more if that were to be the case. The Public Works Director said he wanted to know if the Council wanted the portable restrooms to be year around or just during the shoulder season of spring and fall to start out with. Council Member Terry said he felt like the shoulder seasons would be sufficient, but they could see how things go and if they are needed more, they could bring them in sooner for use. There was also discussion on winterizing early if there is potential for freezing weather. Council Member Sharp said he would support either date and it could be amended if there are problems with the decision. There was discussion about league play and how that could be affected by the weather and making sure there are bathrooms available for the needs. Council Member Terry said he would like to keep heating devices that are portable on the back burner so that could be an option for a day or so and would like to have some of those on hand. The Public Works Director said he would look into getting larger heaters to work in the restrooms. He said he would like to be able to open the restrooms on April 1st and use the heaters if possible. The Public Works Director said that having a policy in place is important so there are dates to work with and as well as having clear information to give to residents and for staff. Council Member Checketts said she would like to have the Public Works Director look into getting a pressure washer with the portable tank. The Public Works Director said he would look into that as budget allows. The Mayor said he would suggest putting the pressure washer on the budget list and look at the priorities to see where that fits into the priorities for the limited budget. The City Administrator said the Public Works Director could put together a Park Restrooms budget and that could include portable restrooms, pressure washer, and the additional heaters with the anticipation of an April 1st opening date and an October 15 closing date, and if there is any city events held before April 1st, the staff can provide rented portable restrooms to accommodate those activities. He said once April 1st comes, the staff can be prepared with heaters if there is cold weather problems. Council Member Checketts said she would like to recommend that no reservations be taken before April 1st because there will be no bathroom facilities available. Council Member Terry said there are some places that people go and there are no restrooms available. There was discussion that people could still use the areas in the park, but it would be understood there was no official rentals, and those areas would be on a first come first served basis and there would be no bathroom facilities available. There was also discussion on cleaning protocol and how that should be taken care of. The Public Works Director said he would work on making sure those things are taken care of. OFFICIAL MINUTES WOODS CROSS CITY COUNCIL MEETING APRIL 2, 2024 PAGE 9 There was also discussion on how things might be handled with the Christmas Tree Lighting activity with restroom facilities. It was noted that could be discussed further. Discussion continued on how pickleball courts are handled as weather changes and putting up the nets. Council Member Checketts suggested putting the ball fields on the policy as well. The Public Works Director said they are also working on baiting for gophers and overseeding the fields to make sure the fields are in good shape for sports activity. (Not abnormal) o Widdison came back in March and cleaned the well casing column and reinspected and found a hole in the well screen and cracks causing the well to release sand. Repair Options • To repair/rehabilitate the Well Casing o Demo the building and reline the well o Replace the building and pump controls • Drill a new Well and build a new building on the existing Well 3 property • Drill a new well at Well #1 site on the corner of 1500 S and 200 W with a treatment plant on site (Current casing too small and drilled in 1935). We still have redundancy in the other 2 wells that feed the treatment plant. • We have asked JUB to prepare an opinion and costs of all 3 options and Staff will look at funding options for the Council to make a decision. PROJECTS NOT LISTED ON PREVIOUS SLIDES • Argyle Acres Playground needs replacement soon based on safety inspections. Staff is pricing options for the next council meeting. • Prepping Street Mill/Overlay and Preservation Projects for Bid • Traffic Light at 1500 S and 800 W o Working its way through UDOT's bidding process. • 1100 W 2100 S to 2600 S Widening o In environmental plan phase. Working with property owners. o Was awarded Davis County Prop 1 Money. • Parks and Recreation Master Plan Update o Is at the Planning Commission level. • Met with the South Davis Water Users and kicked off the planning grant application. We asked for commitments and financial commitments from the other cities and refineries. Council Member Checketts said there are many faded stop signs, and they need to be replaced. The Public Works Director said he is starting a blanket replacement program so all signs and particularly the faded stops signs are routinely replaced. The City Administrator said there was one last thing he wanted to make the Council aware of and he said that he had spoken with Waste Management about the possibility of getting a price of allowing the city to purchase the garbage cans for the city and for them to take over the maintenance of the cans. He said during the process of receiving quotes for both of those, he was told that if that were to take place that would mean that garbage fees would go up immediately to be able to cover those costs. He said because of that they are proposing to keep things as they are right now. There was a question about getting a bulk order of cans possibly a with surrounding city and it was noted none of the cities were interested in doing that at this time. The Public Works Director said he would continue to keep looking into the matter. The Mayor, Mayor Protem and the Council thanked the Public Works Director and his staff for all of their hard work in maintaining the city. Wrapping up Fleet Lease Purchase documents with Brian Passey and Zions Bank. 5. Sam and I attended the Weber Basin Water’s annual meeting. We were informed that most reservoirs are anticipated to be near capacity this year with the current moisture content. The City is also conducting interviews for the Community Development Director.
