1 April 22, 2024 CITY OF WYANDOTTE REGULAR CITY COUNCIL MEETING A Regular Session of the Wyandotte City Council was held in Council Chambers and via Virtual Telecommunication methods, due to COVID-19 in accordance with Wayne County Local Public Health Department “Guidance for Meetings of Governmental Bodies” and PA228 of 2020, using the Zoom Audio platform, on Monday, April 22, 2024 and was called to order at 7:00pm with Honorable Mayor Robert A. DeSana presiding. The meeting began with the Pledge of Allegiance followed by roll call. Present: Mayor Robert A. DeSana, Councilpersons Robert Alderman, Christopher Calvin, Kaylyn Crayne, Todd Hanna, Rosemary Shuryan, Kelly Stec ABSENT: Theodore Galeski, City Assessor Also Present: Todd Browning, City Treasurer; William R. Look, City Attorney; Jesus Plasencia, City Engineer; and Lawrence Stec, City Clerk PRESENTATIONS • Plante & Moran - 2023 Fiscal year Audited Financial Statements **6:30pm** • Proclamation – Shoppers Valley Market PRESENTATION OF PETITIONS PUBLIC HEARING UNFINISHED BUSINESS 2024-118 LEASE AGREEMENT – WYANDOTTE FAMILY CHURCH By Councilperson Crayne, supported by Councilperson Alderman BE IT RESOLVED, that the City Council hereby approves the lease agreement between the City of Wyandotte and Wyandotte Family Church for a lease agreement for fenced in community gardens space at the corner of Grove Street and Biddle Avenue (Green Belt Park) for a period beginning April 23, 2024 through April 22, 2025, and BE IT FURTHER RESOLVED, that the City Council hereby authorizes the Mayor and City Clerk to sign the term lease agreement with Wyandotte Family Church. Motion unanimously carried. CALL TO THE PUBLIC CONSENT AGENDA 2024-119 MINUTES By Councilperson Crayne, supported by Councilperson Alderman RESOLVED that the minutes of the meeting held under the date of April 8, 2024, be approved as recorded without objection. Motion unanimously carried. 2024-120 SPECIAL EVENT REQUEST: FIXIN TO FISH By Councilperson Crayne, supported by Councilperson Alderman BE IT RESOLVED that the City Council concurs with the recommendation of the Special Events Coordinator to approve the use of city property for the event held May 25th 2024. a. Permission to utilize a portion of the Bishop Park Fishing Pier for May 25th 2024 starting at 8 am to 12 pm. b. To ask the Wyandotte Police Department to assist in the clearing of the pier for that date and time. 2 April 22, 2024 c. Permission to utilize a portion of the park near the concession stand to have a tent and tables, with a banner to serve as check-in and an eating area for their lunch. If there are any costs over stated amount in agreement for any city staff/material/property for said event, We Fixin' to Fish will be responsible for those fees no later than 30 days after said event date. Any tents on city property must be weighted (no stakes are allowed to be used to anchor tents) to prevent collapse. Clean up before/during and after the event must be done by We Fixin' to Fish. This event has been reviewed and approved by the Superintendent of Recreation, Superintendent of Public Service, Police Chief and Fire Chief. It is recommended that there is a hold harmless agreement created by the Department of Legal Affairs, the City of Wyandotte added as additional insured to their insurance policy and that the group follow all City of Wyandotte ordinances. Motion unanimously carried. 2024-121 SPECIAL EVENT REQUEST: COMMUNITY CHOICE CREDIT UNION By Councilperson Crayne, supported by Councilperson Alderman BE IT RESOLVED that the City Council concurs with the recommendation of the Special Event Coordinator to approve the use of city property for Community Choice Credit Union: August 8th 2024 - 4 pm to 7 pm, Estimated Attendance - 1,000 The northwest side of the Yack Arena Parking Lot to leave space to allow parking for Family Dollar customers along with the full South side of the lot for vehicles for the Touch - A - Truck. They request the use of barricades and parking closure from the Department of Public Service. If there are any costs over stated amount in agreement for any city staff/material/property for said event, Community Choice Credit Union will be responsible for those fees no later than 30 days after said event date. Motion unanimously carried. 2024-122 2024 ROWING REGATTAS By Councilperson Crayne, supported by Councilperson Alderman BE IT RESOLVED that Council approves the application of the Wyandotte Boat Club to hold the 2024 Rowing Regattas. • April 27th 2024: Hebda Cup 6 am to 5 pm • BASF Waterfront Park • Biddle Avenue from Pine to Plum Street • May 4th 2024: WY-HI Rowing Regatta 6 am to 6 pm • BASF Waterfront Park • Biddle Avenue from Pine to Plum Street (If there is bad weather, the events will run the following days.) BE IT FURTHER RESOLVED that the organization is required to sign a hold harmless agreement as well as add the City of Wyandotte as additional insured as well as pay the $50 special events fee and any and all fees associated with the use of city property and staff time. Motion unanimously carried. 2024-123 WELLNESS WEDNESDAYS: OUTDOOR SUMMER YOGA By Councilperson Crayne, supported by Councilperson Alderman BE IT RESOLVED that the City Council approves the request of the DDA Director for use of city property located at the Theater Lot at 1st Street and Elm Street for Wellness Wednesdays: Outdoor Summer Yoga to be held each Wednesday evening from 6:30 PM to 7:30 PM from Wednesday, June 5th, 2024 through Wednesday, August 28th, 2024 in partnership with 359 Yoga and Henry Ford Health. There will not be any Yoga on Wednesday July 3rd, 2024 or Wednesday, July 10th, 2024. Set up to 3 April 22, 2024 begin at 5:30 PM on the day of each session. All participants will be required to register and sign hold harmless agreements prior to participation in Wellness Wednesdays: Outdoor Summer Yoga. Henry Ford Health and 359 Yoga shall add the City of Wyandotte as additional insured on their insurance policy. Motion unanimously carried. NEW BUSINESS 2024-124 APPOINTMENT TO PLANNING COMMISSION – M. BEAUBIEN By Councilperson Crayne, supported by Councilperson Alderman WHEREAS, Megan Jalbert has resigned from the Planning Commission, and we extend our thanks and appreciation for the years of service she has given to the City of Wyandotte. BE IT RESOLVED that City Council hereby CONCURS with the recommendation of Mayor DeSana to appoint Michael Beaubien of 155 Biddle Ave., Wyandotte, MI to the Planning Commission to fill the unexpired term of Megan Jalbert. Term to expire April 2026. Motion unanimously carried. 2024-125 2024 BISHOP PARK CONCESSION LEASE By Councilperson Crayne, supported by Councilperson Alderman BE IT RESOLVED that the City Council concurs in the recommendation of the Superintendent of Recreation to award a one-year extension to operate the Bishop Park Concession Stand for the 2024 season to Mohammed Motahhar, in the amount of $1,000 provided the proper insurance is placed on file in the City Clerk's Office and all stipulations are adhered to as outlined in said lease; AND BE IT FURTHER RESOLVED that the Council authorizes the Mayor and City Clerk to sign said lease agreement on behalf of the City of Wyandotte Motion unanimously carried. 2024-126 FOOD SAFETY CULTURE: WYANDOTTE FARM STAND By Councilperson Crayne, supported by Councilperson Alderman BE IT RESOLVED, that the City Council approves the request of the DDA Director for use of city property located at the front of Wyandotte City Hall 3200 Biddle Avenue for the Wyandotte Farm Stand to be held each Thursday from 12:00 PM to 6:00 PM from Thursday, June 6th, 2024 through Thursday, September 26th, 2024. There will not be any Wyandotte Farm Stand on Thursday, July 4th, 2024 or Thursday, July 11th, 2024. Set up to begin at 8:00 AM on the day of each program. All participants will be required to register and sign hold harmless agreements prior to participation in Wyandotte Farm Stand. Food Safety Culture LLC shall add the City of Wyandotte as additional insured on their insurance policy. Motion unanimously carried. 2024-127 FILE #4810: EXTENSION OF AED MAINTENANCE & INSPECTION By Councilperson Crayne, supported by Councilperson Alderman BE IT RESOLVED that the City Council concurs with the recommendation of the City Engineer and approves the contract extension for File #4810 Inspection and Maintenance of Automated External Defibrillators with Boynton Fire Services, Lansing, Michigan, for the period of June 1, 2024, thru May 30, 2025, which shall be paid from Account No. 101-448-750-270 Building Maintenance, and further authorizes the Mayor and Clerk to sign the contract extension for File #4810 Inspection and Maintenance of Automated External Defibrillators. Motion unanimously carried. 2024-128 FIRST & FINAL READING #1542: SALARY- DEPT. OF LEGAL AFFAIRS By Councilperson Crayne, supported by Councilperson Alderman FIRST & FINAL #1542 AN ORDINANCE ENTITLED AN ORDINANCE SETTING THE SALARY FOR THE DEPARTMENT OF LEGAL AFFAIRS 4 April 22, 2024 THE CITY OF WYANDOTTE ORDAINS: Section 1. Salary for Department of Legal Affairs. The salary for the law firm of William R. Look, P.C. as the Department of Legal Affairs for the City of Wyandotte shall be at a yearly salary of seventy-five thousand ($75,000.00) dollars to cover the period from April 20, 2024 to April 19, 2026. In addition, the law firm shall be reimbursed for miscellaneous costs and expenses incurred when acting as legal counsel for the City of Wyandotte. Section 2. Severability. All Ordinances or parts of Ordinances in conflict herein are hereby repealed, only to the extent necessary to give this Ordinance full force and effect. Section 3. Effective Date. This ordinance shall take immediate effect. This ordinance is deemed necessary for the immediate preservation of the public peace, property, health, safety and for providing for the usual daily operation of the city. This ordinance shall be published in a newspaper generally circulated in the City of Wyandotte within ten (10) days after adoption. The ordinance shall designate the location in the city where a true copy of the ordinance can be inspected or obtained. Motion unanimously carried. 2024-129 FINAL READING #1541: AMEND CODE OF ORDINANCE CH. 172 – ELECTRICAL CODE AND INSPECTION By Councilperson Crayne, supported by Councilperson Alderman FINAL READING #1541 AN ORDINANCE ENTITLED AN ORDINANCE TO AMEND CHAPTER 172 OF THE CODE OF ORDINANCES “ELECTRIC CODE AND INSPECTIONS” BY AMENDING ARTICLE § 172.052 “ADOPTION OF ELECTRICAL CODE” AND ARTICLE § 172.072 “QUALIFICATIONS”, BY ADOPTING BY REFERENCE THE 2023 NATIONAL ELECTRICAL CODE AND THE MICHIGAN DEPARTMENT OF LICENSING AND REGULATORY AFFAIRS CONSTRUCTION CODE – PART 8. ELECTRICAL CODE The City of Wyandotte Ordains: Section 1. Amend Chapter 172 “Electric Code and Inspections”, by amending the following sections: § 172.052 ADOPTION OF ELECTRICAL CODE. (A) A certain document, one copy of which is on file in the City Clerk’s office, being marked and designated as the 2023 National Electrical Code, is hereby referred to, adopted by the city and made a part hereof, as if fully set out in this chapter, with the additions, insertions, deletions and changes, if any, prescribed herein. (B) A certain document, one copy of which is on file in the City Clerk’s office, being marked and designated as the Michigan Department of Licensing and Regulatory Affairs Construction Code Part 8 Electrical Code, is hereby referred to, adopted by the city and made a part hereof, as if fully set out in this chapter, with the additions, insertions, deletions and changes, if any, prescribed herein. (C) The purpose of these codes are the practical safeguarding of persons and property from hazards arising from the use of electricity. (D) This adoption of the 2023 National Electric Code and the Michigan Department of Licensing and Regulatory Affairs Construction Code Part 8 Electrical Code is done in accordance with M.C.L.A. § 117.3(k). § 172.072 QUALIFICATIONS. The person chosen to fill the office of Electrical Inspector shall be a competent, licensed electrician, of good moral character and shall have at least four years’ experience as a journeyman in the practice of his or her trade, or two years’ training in a recognized college of electrical engineering, and in addition thereto two years of practical experience in electrical construction, shall be well versed in approved methods of electrical construction for safety to life and property, and the rules and regulations issued by the city’s Board of Electrical Examiners and Review. He or she shall be familiar with the National Electrical Code, as approved by the National Fire Protection Association, Inc., and other installation and safety rules and standards approved by the 2023 Edition of the National Electrical Code, as approved by 5 April 22, 2024 the National Fire Protection Association, Inc., and other installation and safety regulations approved by the Reciprocal Electrical Council, Inc., RECI Manual, including technical amendments to the 2023 Edition of the National Electric Code. The Inspector shall also maintain a file of listed inspected electrical appliance cards issued by or for the Underwriters Laboratories, Incorporated. The Electrical Inspector shall be the electrical inspection authority as described in this chapter. Section 2. Interpretation. Nothing in this Ordinance or in the Code hereby adopted shall be construed to affect any suit or proceeding in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance hereby repealed; nor shall any just or legal right or remedy or any character be lost, impaired or affected by this Ordinance. Section 3. Severability. Severability. Should any word, sentence, phrase or any portion of this Ordinance be held in a manner invalid by any court of competent jurisdiction or by any state agency having authority to do so for any reason whatsoever, such holdings shall be construed and limited to such word, sentence, phrase or any portion of the Ordinance held to be so invalid and shall not be construed as affecting the validity of any of the remaining words, sentences, phrases or portions of this Ordinance. Section 4. Conflicting Ordinance. Conflicting Ordinances. All prior existing ordinances adopted by the City of Wyandotte inconsistent or in conflict with the provisions of this Ordinance are, to the extent of such conflict or inconsistency, hereby expressly repealed. Section 5. Effective Date. This Ordinance shall take effect fifteen (15) days from the date of its passage by the Wyandotte City Council and a copy of the Ordinance or a summary of said Ordinance shall be published in a newspaper generally circulated in the City of Wyandotte within ten (10) days after adoption. A copy of this ordinance may be inspected or obtained at the City of Wyandotte Clerk’s Office, 3200 Biddle Avenue, Wyandotte, Michigan. On the question, “SHALL THIS ORDINANCE NOW PASS?” the following vote was recorded.
