1 May 6, 2024 CITY OF WYANDOTTE REGULAR CITY COUNCIL MEETING A Regular Session of the Wyandotte City Council was held in Council Chambers and via Virtual Telecommunication methods, due to COVID-19 in accordance with Wayne County Local Public Health Department “Guidance for Meetings of Governmental Bodies” and PA228 of 2020, using the Zoom Audio platform, on Monday, May 6, 2024 and was called to order at 7:00pm with Honorable Mayor Robert A. DeSana presiding. The meeting began with the Pledge of Allegiance followed by roll call. Present: Mayor Robert A. Motion unanimously carried. 2024-133 QUARTERLY INVESTMENT REPORT – 2023 2ND & 3RD QUARTERS By Councilperson Shuryan, supported by Councilperson Stec RESOLVED BY CITY COUNCIL that Council hereby receives and places on file the 2023 2nd and 3rd Quarter Quarterly Investment Reports as outlined in this communication. Motion unanimously carried. 2024-134 PLANNED DEVELOPMENT APPLICATION FOR 640 PLUM By Councilperson Shuryan, supported by Councilperson Stec BE IT RESOLVED that the PD Planned Development Application submitted by 640 Plum, LLC for the property known as 640 Plum, Wyandotte, is hereby referred to the Planning Commission for the required public hearing. Motion unanimously carried. 2024-135 PLANNED DEVELOPMENT APPLICATION FOR 1788-1794 OAK By Councilperson Shuryan, supported by Councilperson Stec BE IT RESOLVED that the Council that the communication from the Planning Commission and the City Engineer regarding the proposed art classes at 1788 Oak and retail sales at 1792-1794 Oak Street, is hereby received and placed on file; AND 2 May 6, 2024 WHEREAS the Planning Commission held a public hearing on April 18, 2024, and after said public hearing the Planning Commission determined that said uses are in compliance with the planned development representations made at the time of approval of the Stage I Site Plan and, with the recommendation of the City Engineer, approved the plan as a final plan, meeting the requirements set forth in §190.279 of the Zoning Ordinance. BE IT FURTHER RESOLVED that the Council hereby APPROVES the uses for paint classes at 1788 Oak and retail sales at 1792-1794 Oak and will now become an integral part of the PD District, and for purposes of recordation shall be referred to as Planned Development No. 2024-94. Approval of the final site plan shall be effective for a period of three (3) years, providing that development is commenced within one (1) year as evidenced, at a minimum, by issuance of a building permit. If development is not commenced within one (1) year or not completed within three (3) years, the Planning Commission shall review progress to date and make a recommendation to the City Council as to action relative to permitting continuation under the original approval; AND BE IT RESOLVED that the Owner/Applicant meets all the requirements of Section 132.071 of the Code of Ordinance prior to occupancy. NEW BUSINESS 2024-136 REAPPOINTMENTS TO ZONING BOARD OF APPEALS By Councilperson Shuryan, supported by Councilperson Stec RESOLVED that the City Council hereby CONCURS with the recommendation of Mayor DeSana to reappoint Barbara Duran, Keith Trupiano, and Ted Wienclaw to the Zoning Board of Appeals. Terms to expire May 2027. Motion unanimously carried. 2024-137 APPOINTMENT TO PLANNING COMMISSION By Councilperson Shuryan, supported by Councilperson Stec WHEREAS, Jay Sarnacki has resigned from the Planning Commission, and we extend our thanks and appreciation for the years of service he has given to the City of Wyandotte. BE IT RESOLVED that City Council hereby CONCURS with the recommendation of Mayor DeSana to appoint Gregory Mayhew of 1237 Poplar, Wyandotte, MI to the Planning Commission to fill the unexpired term of Jay Sarnacki. Term to expire April 2026. YEAS: Alderman, Calvin, Shuryan, Stec NAYS: Crayne ABSENT: Hanna 2024-138 HIRING: FULL-TIME ANIMAL CONTROL OFFICER By Councilperson Shuryan, supported by Councilperson Stec RESOLVED that the Council acknowledges receipt of the communication from the Human Resource Specialist regarding the Full Time Animal Control Officer vacancy within the Downriver Central Animal Control Consortium (DCAC) and concurs with the recommendation therein and hereby declares said position vacant and authorizes the filling of such vacancy and BE IT FURTHER RESOLVED that the Council approve the hiring of Brian Daugherty at Class Code 31E -$22.38/hourly plus additional funds coming from the DCAC ($2.00/hour premium as a participating member of the DCAC and an additional $1.00/hour education/training premium (Mr. Daugherty is currently a State certified ACO). The total hourly rate for Brian Daugherty will be $25.38. Brian Daugherty's start date is contingent upon successful completion of a pre-employment physical, drug screen and background check. Motion unanimously carried. 2024-139 DANGEROUS STRUCTURE AT 905 6TH STREET By Councilperson Shuryan, supported by Councilperson Stec WHEREAS, hearings have been held in the Office of the city Engineer in the Department of Engineering and building, 3200 Biddle Avenue, Wyandotte, Michigan on February 21, 2024, and the 3 May 6, 2024 property owner or other interested parties have been given the opportunity to show cause, if any they had, why the structure at 905 6th Street, has not been demolished in accordance with the City's Property Maintenance Ordinance; AND WHEREAS, the City Engineer has filed a report of the findings with the Council; NOW, THEREFORE BE IT RESOLVED, that the Council shall hold a public hearing in accordance with Section PM-107.7 in the Council Chambers at City Hall, 3200 Biddle Avenue, Wyandotte on Monday, May 20, 2024, at 7:00 p.m., at which time all interested parties shall be given the opportunity to show cause why, if any they have, the structure has not been demolished or why the City should not have the structure demolished and removed at 905 6th Street; AND BE IT FURTHER RESOLVED that the city Clerk shall give notice of said hearing ten (10) days before the hearing by certified mail, return receipt requested, and first class mail, in accordance with the provisions of Section PM-107.4 of the Property Maintenance Ordinance. Motion unanimously carried. 2024-140 240 ANTOINE – PLANNED DEVELOPMENT PHASE I By Councilperson Shuryan, supported by Councilperson Stec RESOLVED BY THE MAYOR AND CITY COUNCIL that the communication from the Planning Commission and the City Engineer regarding the proposed project at 240 Antoine, Wyandotte, is hereby received and placed on file; AND NOW THEREFORE BE IT RESOLVED, Council hereby APPROVES the Preliminary Site Plan for the project located at 240 Antoine with the following to be incorporated into the final plan: (1) A solid screen fence be constructed on the east property line not to extend into the front yard of the adjacent houses on Felice and Antoine. (2) Along the west property line, a minimum five (5) foot wide landscape area being 40 feet south of the north property line with a sign indicating TENANT ONLY PARKING in the landscape area. Motion unanimously carried. 2024-141 REZONING OF THE PROPETY AT 3138 BIDDLE AVENUE By Councilperson Shuryan, supported by Councilperson Stec RESOLVED that the communication from the Planning Commission regarding the rezoning of the property known as 3138 Biddle Avenue, Wyandotte is hereby received and placed on file; AND BE IT FURTHER RESOLVED that Council concurs with the recommendation of the Planning Commission and denies the rezoning of property known as 3138 Biddle Avenue to General Business District (B-2). Motion unanimously carried. 2024-142 BILLS & ACCOUNTS By Councilperson Shuryan, supported by Councilperson Stec RESOLVED that the total bills and accounts of $2,287,544.28 as presented by the Mayor and City Clerk are hereby APPROVED for payment.
