1 August 26, 2024 CITY OF WYANDOTTE REGULAR CITY COUNCIL MEETING A Regular Session of the Wyandotte City Council was held in Council Chambers and via Virtual Telecommunication methods, due to COVID-19 in accordance with Wayne County Local Public Health Department “Guidance for Meetings of Governmental Bodies” and PA228 of 2020, using the Zoom Audio platform, on Monday, August 26, 2024 and was called to order at 7:00pm with Honorable Mayor Robert A. DeSana presiding. The meeting began with the Pledge of Allegiance followed by roll call. Present: Mayor Robert A. DeSana, Councilpersons Robert Alderman, Christopher Calvin, Kaylyn Crayne, Todd Hanna ABSENT: Councilpersons Rosemary Shuryan, Kelly Stec Also Present: Todd Browning, City Treasurer; William R. Look, City Attorney; Jesus Plasencia, City Engineer; Theodore Galeski, City Assessor and Lawrence Stec, City Clerk PRESENTATIONS PRESENTATION OF PETITIONS PUBLIC HEARING UNFINISHED BUSINESS 2024-248 RESPONSE TO MR. JOSHUA AFFHOLTER – CHICKEN ORDINANCE By Councilperson Calvin supported by Councilperson Crayne RESOLVED by City Council that the communications from Mr. Joshua Affholter and the City Engineer regarding the allowance of chickens within City limits are hereby received and placed on file. BE IT FURTHER RESOLVED that no changes to the City's Code of Ordinances regarding allowance of chickens are hereby implemented. Motion unanimously carried. CALL TO THE PUBLIC CONSENT AGENDA 2024-249 MINUTES By Councilperson Calvin supported by Councilperson Crayne RESOLVED that the minutes of the meeting held under the date of August 12, 2024, be approved as recorded without objection. Motion unanimously carried. 2024-250 SPECIAL EVENTS REQUEST – DOWNRIVER FANFARE By Councilperson Calvin supported by Councilperson Crayne BE IT RESOLVED that City Council approves the use of the following city sidewalks, streets, and property for the Downriver Fanfare event to be held on October 3rd, 2023. a. Streets will be blocked from 3:00 pm to 10 pm b. Permission to close Maple Street between 5th and 7th Streets c. Permission to close 5th Street from Eureka to Maple d. Permission to close the alley behind the Auto Shop e. Overflow parking to use the Chase Bank parking lot located next to the Yack Arena f. Permission to close 6th Street from the RHS alley to Maple Street g. The use of 7th to Oak Street and when buses leave the Yack Arena parking lot they head west on Maple to 5th Street and load buses on 5th in RHS's bus lane, before heading onto Eureka Road. BE IT FURTHER RESOLVED that barricades shall be dropped off on the streets the morning of or the day before the event so they can be put out immediately after school pick-up is complete. 2 August 26, 2024 BE IT FURTHER RESOLVED that this event has been reviewed and approved by the appropriate internal departments, pending the following criteria are met. Motion unanimously carried. 2024-251 SPECIAL EVENTS REQUEST – CWCH BOW PLACEMENT 2024 By Councilperson Calvin supported by Councilperson Crayne WHEREAS, the Center of Women and Children’s Health has submitted a special event application to place pink bows on all trees on Biddle Avenue from Eureka to Northline Road in recognition of Breast Cancer Awareness Month in October; and WHEREAS, a special event application was submitted and reviewed by the Special Events Coordinator and approved by the Police Chief, Recreation Superintendent, and Department of Public Services; RESOLVED, that the applicant shall add the City of Wyandotte as additional insurance to their insurance policy and sign and hold harmless agreement; and BE IT RESOLVED by the City Council that Council Concurs with the recommendation of the Special Event Coordinator to approve the use of city sidewalks, streets and property from September 28th through November 2nd 2024 to place ribbons along Biddle Avenue; and BE IT FURTHER RESOLVED, that if there are any overtime costs for any city staff for said event, the group/organization will be responsible for those fees. Any tents on the street/sidewalk or grassy area must be weighted (no stakes are allowed to be used to anchor tents) to prevent collapse. Clean up before/during and after the event must be done by the Center for Women and Children’s Health, which includes any signs or decorations. All materials must be cleaned up and removed after the event has taken place. Motion unanimously carried. 2024-252 CHRISTMAS LIGHTING CONTRACT RENEWAL 2024-2025 By Councilperson Calvin supported by Councilperson Crayne BE IT RESOLVED, that the City Council hereby approve the renewal of the Downtown Holiday Lighting Proposal from Grosse Ile Lawn and & Sprinkler as approved in 2021 for the 2024 calendar year in the amount of $42,656.40 and authorize the DDA Director to proceed. Motion unanimously carried. 2024-253 REZONING APP. AT 966-970-974 FORD AVE By Councilperson Calvin supported by Councilperson Crayne BE IT RESOLVED that the zoning application submitted by Vince Vitale for the rezoning of the property at 966-970-974 Ford Avenue is hereby referred to the Planning Commission for the required public hearing. Motion unanimously carried. 2024-254 PLANNED DEVELOPMENT PHASE I AMENDMENT - 240 ANTOINE By Councilperson Calvin supported by Councilperson Crayne RESOLVED BY THE MAYOR AND CITY COUNCIL that the communication from the Planning Commission and the City Engineer regarding converting the school building at 240 Antoine into 17 residential units are hereby received and placed on file; AND NOW THEREFORE BE IT RESOLVED, Council hereby APPROVES the Preliminary Site Plan for the project located at 240 Antoine with the following to be incorporated into the final plan: 1. The owner shall contact the Archdioceses of Detroit for possible use of the parking lot on the south side of Antoine for deficient parking. 2. Relocate dumpster and shed to provide two (2) additional parking spaces. 3. Landscape areas are to be irrigated. 4. Add three (3) trees between the sidewalk and curb and between driveway approaches on Felice. 5. Restore or replace wooden fence along the northeast property line. 6. Clean/restore building exterior masonry. Motion unanimously carried. 3 August 26, 2024 2024-255 INTERGOVERNMENTAL AGREEMENT FOR EUREKA RESURFACING By Councilperson Calvin supported by Councilperson Crayne RESOLVED by the City Council that Council concurs with the recommendation of the City Engineer and hereby APPROVES the intergovernmental agreement between the City of Wyandotte and the County of Wayne for the resurfacing of Eureka Road from Fort Street to Biddle Avenue and that Council hereby authorizes the Mayor and City Clerk to sign said agreement. BE IT FURTHER RESOLVED the City Engineer is authorized to pay for the street improvements from account 202-444-825-460, including a working capital advance of $139,891. Motion unanimously carried. NEW BUSINESS 2024-256 CITIZEN COMMUNICATION: M. BARBEITO – BARRICADES ON OAK ST. By Councilperson Calvin supported by Councilperson Crayne BE IT RESOLVED that the communication from Miranda Barbeito placed on Oak Street near the tracks be referred to the Police Department and Engineering Department for review and recommendations. Motion unanimously carried. 2024-257 CITIZEN COMMUNICATION: B. WILLIAMS – VOLLEYBALL COURTS By Councilperson Calvin supported by Councilperson Crayne RESOLVED that the communication from Brent Williams regarding the volleyball courts be forwarded to the Recreation Commission for review. Motion unanimously carried. 2024-259 FIRST READING #1544: MOBILE FOOD TRUCK ORDINANCE By Councilperson Calvin supported by Councilperson Crayne BE IT RESOLVED that Council shall hold the 1st Reading of Ordinance #1544 regarding Mobile Food Trucks on Monday, August 26th, 2024. Motion unanimously carried. 2024-260 ASSISTANCE TO FIREFIGHTERS GRANT AWARD – FIRE HOSE By Councilperson Calvin supported by Councilperson Crayne BE IT RESOLVED that Council concurs with the recommendation of the Fire Chief to accept the Assistance to Firefighters Grant award in the amount of $245,801.81. BE IT FURTHER RESOLVED that the city of Wyandotte will bear the initial non-federal funds cost share of $24,580.19 and seek reimbursement from the grant partners for their cost share prior to disbursement of the equipment. Motion unanimously carried. 2024-261 HIRING: PROBATIONARY POLICE OFFICER – J. SYC By Councilperson Calvin supported by Councilperson Crayne RESOLVED BY THE CITY COUNCIL that Council acknowledges receipt of the communication from the Human Resource Specialist regarding the Probationary Police Officer position within the Police Department and CONCURS with the recommendation therein and hereby declares said position vacant and authorizes the filling of such vacancy and 4 August 26, 2024 FURTHER, RESOLVED BY THE CITY COUNCIL that the Council approves the hiring of John Syc as a Probationary Police Officer in the Police Department contingent on the successful completion of physical, drug screen and psychological examinations. Motion unanimously carried. 2024-262 POLICE DEPARTMENT DRONE PURCHASE By Councilperson Calvin supported by Councilperson Crayne BE IT RESOLVED that the council concurs with the chief of police to purchase (2) Drones from Safeware for the amount of $56,071.68 using funds which are available in the 23-24 FY police department budget, account #101-301-850-900. Motion unanimously carried. 2024-263 POLICE DEPARTMENT VEHICLE PURCHASE By Councilperson Calvin supported by Councilperson Crayne BE IT RESOLVED that the council concurs with the chief of police to purchase (2) Chevrolet Tahoes for the amount of $104,386.00 and (1) Dodge Durango for the amount of $44,818.00 using available funds in account #402-301-850-530 and #265-301-725-111 of the police department 23-24 budget. Motion unanimously carried. 2024-264 WMS CONNEX – BUCKET TRUCK PURCHASE By Councilperson Calvin supported by Councilperson Crayne Council concurs with the Municipal Services Commission in approving the purchase of an Altec Model AT40G vehicle for an amount not to exceed $168,606 as secured through the MiDeal vehicle bid contract #240000000160, as recommended by WMS Management. Motion unanimously carried. 2024-265 WMS COOPERATIVE BID AWARD – 2024 WATER MAIN REPLACEMENT By Councilperson Calvin supported by Councilperson Crayne Council concurs with the Municipal Services Commission approving the Riverview/Wyandotte intergovernmental (cooperative) bid for Bidigare Contractors, Inc. for Water Main Replacement on Cedar/11th in the amount of $990,200.00, as recommended by WMS management. Motion unanimously carried. 2024-266 PHASE II FINAL SITE PLAN - 640 PLUM By Councilperson Calvin supported by Councilperson Crayne BE IT RESOLVED that the communication from the Planning Commission and the City Engineer regarding the proposed development at 640 Plum Street, Wyandotte, is hereby received and placed on file; AND WHEREAS the Planning Commission held public hearings on May 16, 2024, and after said public hearing the Planning Commission determined that said development is in compliance with the planned development representations made at the time of approval of the Stage I Site Plan and, with the recommendation of the City Engineer, approved the plan as a final plan, meeting the requirements set forth in §190.279 of the Zoning Ordinance. BE IT FURTHER RESOLVED that the Final Site Plan and elevations are hereby APPROVED, including the recommendations from the Planning Commission as follows: •Dumpster enclosure to be split face block material •Provide a type of plants for the planting areas within the parking lot to be reviewed by the City Engineer •Provide an irrigation system •Provide proper drainage for parking lot •Fencing to be solid vinyl type adjacent to the parking lot area and an aluminum ornamental fence around the park/playground area •No wireless communication tower or equipment will be allowed on the site. •Amend the plan for the proposed single-family home at 3561 7th Street to indicate the side entrance off 5 August 26, 2024 the attached garage with architectural elements on the front elevation of the garage. Also, future single- family homes will have side entrances attached garages. AND, the proposed use, and shall become an integral part of the PD District, and for purposes of recordation, shall be referred to as Planned Development No. 2024-184. Approval of the Final site Plan shall be effective for a period of three (3) years, providing that development is commenced within one (1) year as evidenced, at a minimum, by issuance of a building permit. If development is not commenced within one (1) yard or not completed within three (3) years, the Planning Commission shall review progress to date and make a recommendation to the City Council as to action relative to permitting continuation under the original approval. Motion unanimously carried. 2024-267 PHASE I PRELIMINARY SITE PLAN - BIDDLE & ORCHARD DEV. By Councilperson Calvin supported by Councilperson Crayne RESOLVED BY THE MAYOR AND CITY COUNCIL that the communication from the Planning Commission and the City Engineer regarding the proposed development at Biddle and Orchard for the construction of a four (4) story 16-unit residential building is hereby received and placed on file; AND NOW THEREFORE BE IT RESOLVED, Council hereby concurs with the recommendation of the Planning Commission and REJECTS the Preliminary Site Plan for the project located at Biddle and Orchard, Wyandotte. Motion unanimously carried. 2024-268 BID FILE #4875 – LOG CABIN CONCRETE PATIO – LACARIA CONCRETE By Councilperson Calvin supported by Councilperson Crayne RESOLVED that Council concurs with the Recommendation of the City Engineer and accepts the bid from LaCaria Concrete of Detroit, Michigan, to construct a decorative concrete patio adjacent to the log cabin at Bishop Park in accordance with Bid File #4875 in the amount of $52,000, which shall be funded from Account 492-200-850-524; BE IT RESOLVED that the Mayor and City Clerk are authorized to sign the contract with LaCaria Concrete.
