1 December 16, 2024 CITY OF WYANDOTTE REGULAR CITY COUNCIL MEETING A Regular Session of the Wyandotte City Council was held in Council Chambers and via Virtual Telecommunication methods, due to COVID-19 in accordance with Wayne County Local Public Health Department “Guidance for Meetings of Governmental Bodies” and PA228 of 2020, using the Zoom Audio platform, on Monday, December 16, 2024 and was called to order at 7:00pm with Honorable Mayor Robert A. DeSana presiding. The meeting began with the Pledge of Allegiance followed by roll call. Present: Mayor Robert A. Motion unanimously carried. 2024-380 MUNICIPAL SERVICES/IBEW LOCAL 17 – LABOR AGREEMENT By Councilperson Hanna, supported by Councilperson Stec BE IT RESOLVED that City Council receives and places on file the ratified tentative agreement for the period January 1, 2025 through December 31, 2027 between the Department of Municipal Services and IBEW Local 17, as recommended by WMS management. Motion unanimously carried. 2024-381 POAM POLICE & FIRE DISPATCHER UNIT – TENTATIVE AGREEMENT By Councilperson Hanna, supported by Councilperson Stec BE IT RESOLVED that the Council hereby CONCURS in the recommendation of the City Administrator and APPROVES the tentative agreement between the City of Wyandotte and the Police Officer's Association of Michigan (POAM) Wyandotte Police and Fire Dispatcher Bargaining Unit and further instructs the City Administrator to prepare the collective bargaining agreement for the period of January 1, 2025 through December 31, 2028, and further authorizes the Mayor and City Clerk to execute said agreement. Motion unanimously carried. 2024-382 BID #4864: HIGH GRASS CUTTING CONTRACT EXTENSION By Councilperson Hanna, supported by Councilperson StecBE IT RESOLVED that Council agrees with the recommendation of the City Engineer and approves the Bid File #4864 contract extension for the work order generated high grass cuttings with Skarzynski's Landscaping; AND 2 December 16, 2024 BE IT FURTHER RESOLVED that the work performed under this contract extension be paid from Account 101-448-825-483. NEW BUSINESS 2024-383 CITIZEN COM: LETTERS OF APPEAL FOR TRAFFIC CONTROL ORDER 2024-4 By Councilperson Hanna, supported by Councilperson Stec BE IT RESOLVED that the letters of appeal from the Traffic Control Order 2024-4 about 13th & 15th street One-way traffic are hereby received and placed on file. DEMYANOVICH By Councilperson Hanna, supported by Councilperson Stec BE IT RESOLVED that the letter from Darcel Demyanovich about communication with residents be referred to the Mayor's Office for consideration. Motion unanimously carried. 2024-385 HIRING: PROBATIONARY FIRE FIGHTER – E. SALEMASSI By Councilperson Hanna, supported by Councilperson Stec BE IT RESOLVED that the Council acknowledges receipt of the communication from the Human Resource Specialist regarding the Probationary Fire Fighter position within the Fire Department and CONCURS with the recommendation therein and hereby declares said position vacant and authorizes the filling of such vacancy and BE IT FURTHER RESOLVED that the Council approves the hiring of Erick Salemassi as a Probationary Firefighter in the Fire Department contingent on the successful completion of a psychological evaluation, background check, physical and drug screen examination. Motion unanimously carried. 2024-386 FEE SCHEDULE: UPON SALE INSPECTIONS, RENTAL INSPECTIONS, ETC By Councilperson Hanna, supported by Councilperson Stec BE IT RESOLVED that City Council concurs with the recommendation of the City Engineer to raise fees for upon sale inspections, rental inspections, commercial inspections, and to establish the short term rental fee as summarized below. The new fees shall become effective January 1, 2025. TYPE FEE Single Family Dwelling $200.00 Two Family Dwellings $300.00 Each Additional Unit (in same building) $100.00 25 Units or More $2,600.00 No Show Fee $100.00 COMMERCIAL FEES: Minimum Fee $225.00 1st Floor per square foot $0.15 2nd Floor per square foot $0.10 Short-Term Rentals $100.00 Motion unanimously carried. 3 December 16, 2024 2024-387 FIRST & FINAL READING #1548: COMMERICAL & INDUSTRIAL PROPERTIES APPLICATION & FEE (Sec. 170.098) By Councilperson Hanna, supported by Councilperson Stec First & Final AN ORDINANCE ENTITLED AN ORDINANCE TO AMEND THE CITY OF WYANDOTTE ZONING ORDINANCE BY AMENDING COMMERCIAL AND INDUSTRIAL PROPERTIES CERTIFICATE OF CONFORMITY SECTION 170.098 – APPLICATION AND FEE CITY OF WYANDOTTE ORDAINS: Section 1. Section 170.098 Application and Fee amended to read as follows: Any person that is going to transfer a commercial or industrial premises must file an application prior to the transfer with the Department of Engineering and Building for the purpose of setting up an inspection of the commercial and industrial premises. The fee for the application and inspection shall be established by City Council resolution. The fees shall be available for viewing in the office of the City Clerk, the Engineering and Building Department, and published on the City’s website. Any required deposit shall be made in the form a cash, check or cashier’s check approved by the code official and the City Attorney. Section 2. Reservation of Rights. Nothing in this Ordinance or in the Code hereby adopted shall be construed to affect any suit or proceeding in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance hereby repealed; nor shall any just or legal right or remedy or any character be lost, impaired or affected by this Ordinance. Section 3. Severability. Severability. Should any word, sentence, phrase or any portion of this Ordinance be held in a manner invalid by any court of competent jurisdiction or by any state agency having authority to do so for any reason whatsoever, such holdings shall be construed and limited to such word, sentence, phrase or any portion of the Ordinance held to be so invalid and shall not be construed as affecting the validity of any of the remaining words, sentences, phrases or portions of this Ordinance. Section 4. Conflicting Ordinances. Conflicting Ordinances. All prior existing ordinances adopted by the City of Wyandotte inconsistent or in conflict with the provisions of this Ordinance are, to the extent of such conflict or inconsistency, hereby expressly repealed. Section 5. Effective Date. This ordinance shall take immediate effect. This ordinance is deemed necessary for the immediate preservation of the public peace, property, health, safety and for providing for the usual daily operation of the Department of Building & Engineering. A copy of the ordinance or a summary of this ordinance shall be published in a newspaper generally circulated in the City of Wyandotte within ten (10) days after adoption. Any summary shall designate the location in the city where a true copy of the ordinance can be inspected or obtained. On the question, “SHALL THIS ORDINANCE NOW PASS?” the following vote was recorded: Motion unanimously carried. 2024-388 ACQUISITION OF 2809 10TH STREET By Councilperson Hanna, supported by Councilperson Stec BE IT RESOLVED that the Council concurs with the recommendation of the City Engineer to acquire the property at 2809 10th Street in the amount of $35,000.00 to be appropriated from TIFA Area Funds Account No. 492-200-850-519; AND BE IT FURTHER RESOLVED that the Department of Legal Affairs, William R. Look, is hereby directed to prepare and sign the necessary closing documents and the Mayor and City Clerk be authorized to execute the Purchase Agreement. 4 December 16, 2024 BE IT RESOLVED that the City Engineer is directed to demolish the structure upon completion of the Wyandotte Historical Commission inspection of the home as it pertains to the preservation of historical and cultural items for the City of Wyandotte. Motion unanimously carried. 2024-389 BILLS & ACCOUNTS By Councilperson Hanna, supported by Councilperson Stec RESOLVED that the total bills and accounts of $1,735,756.19 as presented by the Mayor and City Clerk are hereby approved for payment.
