1 March 24, 2025 CITY OF WYANDOTTE REGULAR CITY COUNCIL MEETING A Regular Session of the Wyandotte City Council was held in Council Chambers and via Virtual Telecommunication methods, due to COVID-19 in accordance with Wayne County Local Public Health Department “Guidance for Meetings of Governmental Bodies” and PA228 of 2020, using the Zoom Audio platform, on Monday, March 24, 2025, and was called to order at 7:00 pm with Honorable Mayor Pro Tempore Kelly Stec presiding. The meeting began with the Pledge of Allegiance followed by roll call. Present: Mayor Pro Tempore & Councilperson Kelly Stec, Councilpersons Robert Alderman, Christopher Calvin, Kaylyn Crayne, Todd Hanna, Rosemary Shuryan ABSENT: Mayor Robert A. Look, City Attorney; Jesus Plasencia, City Engineer; and Lawrence Stec, City Clerk PRESENTATIONS PRESENTATION OF PETITIONS PUBLIC HEARING UNFINISHED BUSINESS 2025-71 SHOW CAUSE HEARING – 1757 4TH STREET By Councilperson Shuryan, supported by Councilperson Calvin WHEREAS, the new owner has legally obtained possession of 1757 4th Street through the Court and secured permits, with inspections, and is bringing the property back into compliance with current codes; NOW, THEREFORE BE IT RESOLVED, that the Council concurs with the recommendation of the City Engineer to CANCEL the Show Cause due to the improvements made; BE IT FURTHER RESOLVED that the City Engineer shall monitor the progress and completion of permits to address compliance. CALL TO THE PUBLIC CONSENT AGENDA 2025-72 MINUTES By Councilperson Shuryan, supported by Councilperson Calvin RESOLVED that the minutes of the meeting held under the date of March 10, 2025, be approved as recorded without objection. Motion unanimously carried. 2025-73 ROADSIDE GIVING APP: K OF C ANNUAL “TOOTSIE ROLL DRIVE” By Councilperson Shuryan, supported by Councilperson Calvin WHEREAS, the Wyandotte Knights of Columbus Council #1802 is requesting permission to solicit donations in the annual "Mentally Impaired Drive", also known as the "Tootsie Roll Drive", on April 11- 13,2025. WHEREAS, the fundraising event will consist of soliciting donations from motorists stopped at traffic signals at the intersections of Eureka and Fort, Fort and Northline, and the Eureka turnaround by persons wearing vests that clearly identify the Knights of Columbus. BE IT RESOLVED that Council permits the Knights of Columbus Council #1802 to solicit donations as part of the “Tootsie Roll Drive”, provided the organization complies with all regulations set forth in PA 2 March 24, 2025 112 of 2017, including the submission of a Liability Insurance Certificate in the amount of $500,000, and signs a Hold Harmless Agreement as prepared by the Department of Legal Affairs. Motion unanimously carried. 2025-74 FY25 BUDGET AMENDMENTS By Councilperson Shuryan, supported by Councilperson Calvin RESOLVED that Council hereby concurs in the recommendations of the Deputy Treasurer/Assistant Finance Director and approves the necessary 2025 Fiscal Year Budget amendments as presented at the meeting on March 24, 2025. Motion unanimously carried. 2025-75 FY24 WMS AUDITED FINANCIAL STATEMENTS By Councilperson Shuryan, supported by Councilperson Calvin BE IT RESOLVED that the audited Financial Statements for Municipal Services for the fiscal year ending September 30, 2024 are hereby received and placed on file. Motion unanimously carried. 2025-76 SPECIAL EVENT APP: VIETNAM VETERANS RECOGNITION DAY By Councilperson Shuryan, supported by Councilperson Calvin BE IT RESOLVED that the Council concurs with the recommendation of the Special Events Coordinator to approve the request from the VVA #259 to use city property for the Vietnam War Veterans Recognition Day on March 29th, 2025, from 1PM - 3:45PM. BE IT FURTHER RESOLVED that Council approves the use of the following city equipment and property: • Barricades - to be placed around the area of Superior Blvd and put up and taken down by VVA event members • Weights rings for cones - to be used to weigh down the memorial flags - qty. 25 • Sound system - to be picked up from DPS on Friday March 28th before 3:30 pm • Use of Superior Blvd from Biddle to Van Alstyne Street with: o Barricade placed at Biddle and E/B Superior (W/B Superior to remain open) o Barricade placed across S/B and N/B lanes on Van Alstyne just south of Superior o Barricade placed across S/B and N/B lanes on Van Alstyne north of Superior, but south of Co-Op parking lot. o No Parking signs will need to be displayed on Friday for Saturday on the east and west side of Van Alstyne from the barricade to Superior. BE IT FURTHER RESOLVED that this event has been reviewed and approved by the Chief of Police, Recreation Superintendent, Department of Public Service, and Fire Chief, provided that the organization add the City of Wyandotte as additional insured to their insurance policy and sign a hold harmless agreement as prepared by the Department of Legal Affairs. NEW BUSINESS 2025-77 CITY-WIDE SHRED DAY – APRIL 26, 2025 By Councilperson Shuryan, supported by Councilperson Calvin BE IT RESOLVED that the Council approves paper Shred Day for Wyandotte residents on April 26, 2025, between 9 AM and 12 PM in the City Hall Parking Lot, as recommended by WMS management. Motion unanimously carried. 3 March 24, 2025 2025-78 COURT HIRING: COURT CLERK – C. SUTKA By Councilperson Shuryan, supported by Councilperson Calvin RESOLVED that Council acknowledges receipt of the communication from the Human Resource Specialist regarding the hiring of a Full-Time Court Clerk/Clerk Typist I -Class Code 27A at the 27th District Court and with the recommendation therein and hereby declares said position vacant and authorizes the filling of such vacancy; and BE IT FURTHER RESOLVED that the Council approves the hiring of Christie L. Sutka as a Full-Time Court Clerk/Clerk Typist I at Class Code 27A within the 27th District Court, contingent on successful completion of a pre-employment physical, drug screen and background check. Motion unanimously carried. 2025-79 REVISION: BID #4800 RESOLUTION 2025-32 By Councilperson Shuryan, supported by Councilperson Calvin BE IT RESOLVED that the City Council concurs with the recommendation of the City Engineer to amend Resolution 2025-32 to now read as follows: BE IT RESOLVED that the City Council concurs with the recommendation of the City Engineer and approves the contract extension for Bid File #4800 with Al's Asphalt Paving Co. for the 2025 HMA Resurfacing Program, in the amount of $4,532,226.45, paid from the following accounts: Major Street Fund (202-440-825-460), the Local Street Fund (203-440-825-460), the TIFA Resurfacing Fund (492- 200-825-460), and the TIFA Parking Lots Fund (492-200-850-543). BE IT FURTHER RESOLVED that the City Clerk is directed to correct the minutes of February 10, 2025. Motion unanimously carried. 2025-80 GRANT OF LICENSE – 3218 VAN ALSTYNE ST. By Councilperson Shuryan, supported by Councilperson Calvin BE IT RESOLVED that Council has reviewed the Grant of License and Hold Harmless Agreements pertaining to the construction of the decorative fence on the north side of Parking Lot 6, the continuation of the fence along the west side of 3218 Van Alstyne, and the occupation and maintenance of City property by 3218 Van Alstyne between the fence line of Parking Lot 6 and the south property line of 3218 Van Alstyne; AND BE IT FURTHER RESOLVED that the Council authorizes the Mayor and City Clerk to sign the Grant of License. Motion unanimously carried. 2025-81 CITY ACQUISITION – 1723 7TH ST. By Councilperson Shuryan, supported by Councilperson Calvin BE IT RESOLVED that Council concurs with the recommendation of the City Engineer to accept the Quit Claim Deed from the family of Kenneth and Judith Carrier for the property at 1723 7th Street to be appropriated from TIFA Area Funds Account No. 492-200-850-519; AND BE IT RESOLVED that the rehabilitation lien in the amount of $5,400 is hereby forgiven; AND BE IT FURTHER RESOLVED that the City Engineer is directed to demolish the structure. Motion unanimously carried. 2025-82 SALE OF 16 FT OF FORMER 141 ANTOINE By Councilperson Shuryan, supported by Councilperson Calvin BE IT RESOLVED that Council concurs with the recommendation of the City Engineer regarding the sale of 16 feet of the former 141 Antoine, Wyandotte; AND 4 March 24, 2025 BE IT RESOLVED that Council accepts the offer from Dusty Culley, 131 Antoine, to acquire 16 feet of the former 141 Antoine for the amount of $800; AND BE IT FURTHER RESOLVED that the Department of Legal Affairs is hereby directed to prepare the necessary documents, and the Mayor and Clerk are hereby authorized to sign said documents. Motion unanimously carried. 2025-83 SALE OF FORMER 3634 4TH ST. By Councilperson Shuryan, supported by Councilperson Calvin RESOLVED that the communication from the City Engineer regarding the City-owned property located at the former 3634 4th Street, now known as 404 Plum, is hereby received and placed on file; AND BE IT FURTHER RESOLVED that the Council concurs with the recommendation to sell the property known as the former 3634 4th Street, now known as 404 Plum, to Britini McGuckin-Rayne and Dakota Rayne for the amount of $10,000.00; AND BE IT FURTHER RESOLVED that if the Purchaser(s), Britini McGuckin-Rayne and Dakota Rayne do not undertake development within six (6) months, or complete construction within one (1) year, it will result in the Seller’s right to repurchase property, including any improvements, for one ($1.00) dollar. A condition will be placed on the Deed that will include this contingency; NOW THEREFORE, BE IT RESOLVED that the Mayor and City Clerk are hereby authorized to execute the Offer to Purchase Real Estate for the property known as the former 3634 4th Street, now known as 404 Plum, between Britini McGuckin-Rayne and Dakota Rayne and the City of Wyandotte for $10,000 as presented to the Council. Motion unanimously carried. 2025-84 SALE OF 10 FT OF FORMER 3634 4TH ST. By Councilperson Shuryan, supported by Councilperson Calvin BE IT RESOLVED that Council concurs with the recommendation of the City Engineer regarding the sale of 10 feet of the former 3634 4th Street, Wyandotte; AND BE IT RESOLVED that Council accepts the offer from Mary and Duane Mackey, 416 Plum, to acquire 10 feet of the former 3634 4th Street for the amount of $500; AND BE IT FURTHER RESOLVED that the Department of Legal Affairs is hereby directed to prepare the necessary documents, and the Mayor and Clerk are hereby authorized to sign said documents. Motion unanimously carried. 2025-85 NEZ APPLICATION – 404 PLUM By Councilperson Shuryan, supported by Councilperson Calvin WHEREAS per a resolution adopted by the Wyandotte City Council on December 7, 1992, it is the policy of the City of Wyandotte to offer 12-year tax abatements for new single-family construction in Neighborhood Enterprise Zones within the City of Wyandotte; and WHEREAS the former 3634 4th Street, now known as 404 Plum, is within the City of Wyandotte’s Neighborhood Enterprise Zone #1, adopted on December 7, 1992; NOW THEREFORE BE IT RESOLVED by the City Council that Council CONCURS with the recommendation of City Engineer as set forth in his communication of March 24, 2025, that the City of Wyandotte will approve a 12-year Neighborhood Enterprise Zone Exemption Certificate for the proposed redevelopment at former 3634 4th Street, now known as 404 Plum, subject to the proper application materials being submitted to the city and the project’s compliance with the Neighborhood Enterprise Zone Act, Act 147 of 1992, as amended; AND WHEREAS the City Clerk and the City Assessor are hereby authorized to execute said application for a 12-year Neighborhood Enterprise Zone Certificate. Motion unanimously carried. 5 March 24, 2025 2025-86 FIRST & FINAL READING #1552: CH. 94 – NOXIOUS WEEDS & TALL GRASS By Councilperson Shuryan, supported by Councilperson Calvin FIRST & FINAL #1552 AN ORDINANCE ENTITLED AN ORDINANCE TO AMEND THE CODE OF ORDINANCES OF THE CITY OF WYANDOTTE BY AMENDING CHAPTER 94 “HEALTH AND SAFETY; NUISANCES” THE CITY OF WYANDOTTE ORDAINS: Section 1. Amendment of §94.035 through §94.040 and adding §94.041 to read as follows: §94.035 DEFINITION. As used in this subchapter, NOXIOUS WEEDS shall be defined to include: grass and weeds exceeding 8 inches in height, Canada thistle (Circium arvense); dodders (any species of Cuscuta); mustards (charlock, black mustard and Indian mustard, species of Brassica or Sinapis); wild carrot (Daucus carota); bindweed (Convolvulus arvensis); perennial sowthistle (Sonchus arvensis); hoary alyssum (Berteroa incana); ragweed (Ambrosia elatior 1.) and poison ivy (Rhus Toxicodendron); poison sumac (Toicodendron vernix), and noxious weeds as defined in the State Law of Michigan. §94.036 GROWTH PROHIBITED. It shall be unlawful for any owner, lessee, tenant, occupant, agent or other person having control of any lot or land, either public or private, occupied or vacant, within the city, to allow thereon or on any portion thereof or on the abutting or adjoining one-half of the public street or alley immediately adjacent to said lot or land, the presence of: (A) Noxious weeds; (B) Other weeds or grass exceeding 8 inches in height; (C) Wild growing brush or underbrush exceeding 8 inches in height. §94.037 REMOVAL. In any case in which the owner, lessee, tenant, occupant, agent or other person having control or management of any lot or land within the city, allows thereon any weeds, brush, grass or underbrush in violation of § 94.036 of this chapter, the City Engineer may assign employees or a city contractor to enter upon such land and to destroy such weeds, brush, underbrush and to remove such tall grass by spraying, cutting or other methods. §94.038 NOTICE TO COMPLY. (A) The City Engineer and / or City Clerk shall give notice to the person responsible for land within the city each year prior to May 1st by publishing in a newspaper having general circulation within the city declaring the provisions of the ordinance requiring maintenance of the property and that the city may cut and remove weeds and grass exceeding the height restrictions as many times as is necessary and the owner or other responsible party shall be charged with all expenses incurred by the city. The notice shall also provide that failure to reimburse the city expenses will result in the expenses being a Lien against the property and will be specially assessed against their real property tax bill. (B) Prior to the city cutting of or removing the weeds or tall grass, the city will provide written notice of a violation of this ordinance to the owner or other responsible party by either personal service or posting of the premises or the vacant lot. (C) Failure of the city to give the notice does not constitute a defense to an action to enforce the payment of the expenses incurred or any Lien against the property. §94.039 ACCESS TO PREMISES. The City Engineer and his or her authorized representatives shall be granted free access to and from any lot or land for the purpose of investigation and work necessary to accomplish the destruction, removal or cutting of said weeds, brush and grass. §94.040 ACCOUNTS OF EXPENDITURES. The City Engineer shall keep an accurate account of the city’s entire expenses (including administrative costs) incurred in destroying growths of noxious and injurious weeds, brush, underbrush or grass and the 6 March 24, 2025 cutting of grass with respect to each lot or parcel of land entered upon therefor, and shall make a sworn statement of said account and deliver the same to the City Clerk. The Clerk shall present all such accounts to the Council not later than the third Thursday in December of each year in which such labor is performed. The Council shall audit and, if correct, allow such accounts and order the same paid from the General Fund of the city. The sworn statement of the Engineer shall give the date or dates which such noxious or injurious weeds, brush, underbrush or grass exceeding the height restrictions were cut, destroyed and removed, and the owner and description of the land involved, the cost of such labor and administrative costs. §94.041 COLLECTION OF EXPENSES; PROCEDURE. (A) After said accounts have been audited, allowed and paid as above provided, it shall be the duty of the City Clerk to certify them forthwith to the City Assessor. (B) If the expenditure has not been paid, all expenditures represented by said accounts shall be severally spread upon the tax roll next in preparation, levied on the land on which such expenditures were made, be a lien and collected in the same manner as other city taxes and paid into the General Fund of the city. Section 2. Severability. All ordinances or parts of ordinances in conflict herewith are hereby repealed only to the extent necessary to give this ordinance full force and effect. Section 3. Effective Date. This ordinance shall take immediate effect. This ordinance is deemed necessary for the immediate preservation of the public peace, property, health, safety and for providing for the usual daily operation of the Engineering Department. A copy of the ordinance or a summary of this ordinance shall be published in a newspaper generally circulated in the City of Wyandotte within ten (10) days after adoption. Any summary shall designate the location in the city where a true copy of the ordinance can be inspected or obtained.
