1 May 12, 2025 CITY OF WYANDOTTE REGULAR CITY COUNCIL MEETING A Regular Session of the Wyandotte City Council was held in Council Chambers and via Virtual Telecommunication methods, due to COVID-19 in accordance with Wayne County Local Public Health Department “Guidance for Meetings of Governmental Bodies” and PA228 of 2020, using the Zoom Audio platform, on Monday, May 12, 2025, and was called to order at 7:00 pm with Honorable Mayor Robert A. DeSana presiding. The meeting began with the Pledge of Allegiance, followed by roll call. Present: Mayor Robert A. Motion unanimously carried. 2025-141 DUWA ODOR MITIGATION EFFORTS By Councilperson Calvin, supported by Councilperson Alderman BE IT RESOLVED that the communication from Dan Alford, DUWA System Manager, regarding DUWA odor mitigation efforts as of April 2025 is hereby received and placed on file. Motion unanimously carried. 2025-142 SPECIAL EVENTS SOUND AGREEMENT 2025 By Councilperson Calvin, supported by Councilperson Alderman BE IT RESOLVED that the Council approve the contract between Bass Note Productions to provide sound for various 2025 special events. July 4th - 4th of July Parade - 9 am to 12 pm– 285-225-925-826 $400 November 21st - Tree Lighting 5 - 7:30 pm - $250 November 22nd - Christmas Parade 9 am to 12 pm – 285-225-925-825 $400 August 23rd - Vintage Base Ball Game - 285-225-925-880 $150 BE IT FURTHER RESOLVED that the Mayor and City Clerk be authorized to sign said contract and Jim Zang/Bass Note Productions sign a hold harmless agreement created by our Department of Legal Affairs 2 May 12, 2025 and add the City of Wyandotte as additional insured to their insurance policy for no less than a million dollars for their duration at city events. Motion unanimously carried. 2025-143 WSAF LEMONADE AGREEMENT 2025 By Councilperson Calvin, supported by Councilperson Alderman BE IT RESOLVED that the Council Concurs with the recommendation of the Special Event Coordinator to approve the contract between the City of Wyandotte and Lori’s Festive Catering to provide & supply five lemonade stands for the Wyandotte Street Art Fair, July 9th – 12th, 2025. BE IT FURTHER RESOLVED that the vendor’s certificate of insurance and hold harmless will be submitted by June 1, 2025, pending approval of this contract. Motion unanimously carried. 2025-144 EVENT AGREEMENT: WYANDOTTE MUSIC BOOSTERS By Councilperson Calvin, supported by Councilperson Alderman BE IT RESOLVED that Council approves the contract between the City and the Wyandotte Music Boosters to provide assistance during the Wyandotte Collectibles Fair and Wyandotte Mom 2 Mom events and a hold harmless agreement, as prepared by the department of legal affairs shall be executed for the group and signed prior to the start of the events. Motion unanimously carried. NEW BUSINESS 2025-145 CITIZEN COMMUNICATION: R. GROAT – HOUSE DEVELOPMENT By Councilperson Calvin, supported by Councilperson Alderman BE IT RESOLVED that the communication from Rachel Groat regarding the McKinley Project has been received and placed on file; AND BE IT FURTHER RESOLVED that the request of Mrs. Groat be referred to the Engineering Department. Motion unanimously carried. 2025-146 RECIND RESOLUTION 2025-61 & APPROVE LEASE WYANDOTTE GARDEN CLUB By Councilperson Calvin, supported by Councilperson Alderman WHEREAS, on March 10, 2025, the Wyandotte City Council adopted Resolution 2025-61, approving a lease agreement with Wyandotte Family Church for the fenced-in community garden located in Green Belt Park; and WHEREAS, Wyandotte Family Church has since chosen not to proceed with the lease or the continued operation of the community garden; and WHEREAS, the Wyandotte Garden Club has agreed to assume full responsibility for the operation, maintenance, and insurance coverage of the community garden space; and NOW, THEREFORE, BE IT RESOLVED, that the Wyandotte City Council hereby rescinds Resolution 2025-61; and BE IT FURTHER RESOLVED, that the City Council approves a lease agreement between the City of Wyandotte and the Wyandotte Garden Club for the fenced-in community garden space located at the corner of Grove Street and Biddle Avenue (Green Belt Park) for a period beginning May 13, 2025, through April 22, 2026; and BE IT RESOLVED, that the Mayor and City Clerk are hereby authorized to execute the lease agreement on behalf of the City of Wyandotte. Motion unanimously carried. 2025-147 CONNEX BID #4883: FIBER PROJECT – MESH WI-FI ACCESS By Councilperson Calvin, supported by Councilperson Alderman BE IT RESOLVED that the Council concurs with the Municipal Services Commission authorizing the General Manager to execute a contract with AMT/Synamedia, the lowest qualified bidder, for managed 3 May 12, 2025 WiFi Access Point hardware and software under Bid # 4883 for an amount not to exceed $681,374.08, as recommended by WMS Management Motion unanimously carried. 2025-148 PULASKI PARK PLAYGROUND ADD-ON By Councilperson Calvin, supported by Councilperson Alderman BE IT RESOLVED that the Council concurs with the recommendation of the Superintendent of Recreation and accepts the proposal from Snider Recreation to add-on a pre-school designed playscape at Pulaski Park Playground for $45,699.28, which shall be funded from the TIFA Parks account. BE IT RESOLVED that the Mayor and City Clerk are authorized to sign the contract with Snider Recreation. Motion unanimously carried. 2025-149 BID AWARD #4886: GV CEMENT – 2025 NORTHEAST SEWER POINT REPAIRS By Councilperson Calvin, supported by Councilperson Alderman BE IT RESOLVED that Council concurs with the recommendation of the City Engineer and accepts the bid from GV Cement of Brownstown Township, Michigan, to perform the sewer point repair work in accordance with File #4886 in the amount of $508,769.00, which shall be funded from Account 590-200- 926-310; AND BE IT FURTHER RESOLVED that the Mayor and City Clerk are authorized to sign the contract with GV Cement. Motion unanimously carried. 2025-150 SAD #956 REQUEST – BISHOP CO-OP PARKING By Councilperson Calvin, supported by Councilperson Alderman BE IT RESOLVED that SAD #956 is hereby held in abeyance to allow for inclusion of opinions from Police and Fire Chiefs at the request of Council, and the public hearing is adjourned until the meeting of the Council on May 19, 2025. 2025-151 FIRST & FINAL READING #1553: AMEND CODE OF ORDINANCES CH. 170 By Councilperson Calvin, supported by Councilperson Alderman First & Final Reading #1553 AN ORDINANCE ENTITLED AN ORDINANCE TO AMEND CHAPTER 170 OF THE CODE OF ORDINANCES “BUILDING REGULATIONS; CONSTRUCTION” BY AMENDING “BUILDING CODE”, “SWIMMING POOL AND SPA CODE”, “MECHANICAL CODE”, “REHABILITATION CODE FOR EXISTING BUILDINGS” AND “PLUMBING CODE” BY ADOPTING BY REFERENCE THE 2021 MICHIGAN BUILDING CODE, THE 2024 INTERNATIONAL SWIMMING POOL AND SPA CODE, THE 2021 MICHIGAN MECHANICAL CODE, THE 2021 MICHIGAN REHABILITATION CODE FOR EXISTING BUILDINGS AND THE 2021 MICHIGAN PLUMBING CODE The City of Wyandotte Ordains: Section 1. Amend CHAPTER 170 “BUILDING REGULATIONS; CONSTRUCTION” by amending the following sections: §170.021 Adoption of 2021 Michigan Building Code §170.023 Adoption of 2024 International Swimming Pool and Spa Code §170.036 Adoption of 2021 Michigan Mechanical Code §170.051 Adoption of 2021 Michigan Rehabilitation Code for Existing Buildings §170.082 Adoption of 2021 Michigan Plumbing Code Section 2. Amend CHAPTER 170 “BUILDING REGULATIONS; CONSTRUCTION” “BUILDING CODE” by amending §170.021 Adoption of Michigan Building Code as follows: 4 May 12, 2025 (A) A certain document, one copy of which is on file in the City Clerk’s office, being marked and designated as the 2021 Michigan Building Code, including Appendices F, G, and H, is hereby referred to, adopted by the city and made a part hereof, as if fully set out in this subchapter, pursuant to the provisions of the State Construction Code, in accordance with Public Act 230 of 1972, as amended, being M.C.L.A. § 125.1508b. (B) The purpose of this code is to establish minimum regulations governing the design, construction, alteration, enlargement, repair, demolition, removal, maintenance and use of all buildings and structures; providing for the issuance of permits, collection of fees, making of inspections; and therefore providing penalties for the violation thereof. (C) The adoption of the 2021 Michigan Building Code is done in accordance with M.C.L.A. § 117.3(k). Section 3. Amend CHAPTER 170 “BUILDING REGULATIONS; CONSTRUCTION” “BUILDING CODE” by amending §170.023 Adoption of International Swimming Pool and Spa Code as follows: (A) A certain document, one copy of which is on file in the City Clerk’s office being marked and designated as the 2024 International Swimming Pool and Spa Code, including all appendices, is hereby referred to, adopted by the city and made a part hereof, as if fully set out in this subchapter, pursuant to the provisions of the State Construction Code, in accordance with Public Act 230 of 1972, as amended, being M.C.L.A. § 125.1508b. (B) The purpose of this code is to regulate the installation, repairs, and maintenance of swimming pools, spas and hot tubs, their appurtenances and accessories and providing for the issuance of permits and therefore providing penalties for the violation thereof. (C) The adoption of the 2024 International Swimming Pool and Spa Code is done in accordance with M.C.L.A. § 117.3(k). Section 4. Amend CHAPTER 170 “BUILDING REGULATIONS; CONSTRUCTION” “MECHANICAL CODE” by amending §170.036 Adoption of Michigan Mechanical Code as follows: (A) That a certain document, one copy of which is on file in the City Clerk’s office being marked and designated as the 2021 Michigan Mechanical Code is hereby referred to, adopted by the city and made a part hereof, as if fully set out in this subchapter, pursuant to the provisions of the State Construction Code, in accordance with Public Act 230 of 1972, as amended, being M.C.L.A. § 125.1508b. (B) The purpose of this code is to establish the minimum regulations governing the design, installation and construction of mechanical systems, by providing reasonable safeguards to protect the public health and safety against the hazards of inadequate, defective or unsafe mechanical systems and installations. (C) The adoption of the 2021 Michigan Mechanical Code is done in accordance with M.C.L.A. § 117.3(k). Section 5. Amend CHAPTER 170 “BUILDING REGULATIONS; CONSTRUCTION” “EXISTING STRUCTURE CODE” by amending §170.051 Adoption of Michigan Rehabilitation Code for Existing Buildings as follows: (A) That a certain document, one copy of which is on file in the City Clerk’s office being marked and designated as the 2021 Michigan Rehabilitation Code for Existing Buildings is hereby referred to, adopted by the city and made a part hereof, as if fully set out in this subchapter, pursuant to the provisions of the State Construction Code, in accordance with Public Act 230 of 1972, as amended, being M.C.L.A. § 125.1508b. (B) The purpose of this code is to protect the public health, safety and welfare in all existing structures, residential and nonresidential, and on all existing structures. (C) The adoption of the 2021 Michigan Rehabilitation Code for Existing Buildings is done in accordance with M.C.L.A. § 117.3(k). Section 6. Amend CHAPTER 170 “BUILDING REGULATIONS; CONSTRUCTION” “PLUMBING CODE” by amending §170.082 Adoption of Michigan Plumbing Code as follows: (A) A certain document, one copy of which is on file in the City Clerk’s office, being marked and designated as the 2021 Michigan Plumbing Code, including Appendices B, C, D, E and F, is hereby referred to, adopted by the city and made a part hereof, as if fully set out in this subchapter, pursuant to 5 May 12, 2025 the provisions of the State Construction Code, in accordance with Public Act 230 of 1972, as amended, being M.C.LA. § 125.1508b. (B) The purpose of this code is to establish minimum regulations governing the design, installation and construction of plumbing systems, by providing reasonable safeguards for sanitation to protect the public health against the hazards of inadequate, defective or unsanitary plumbing installations, providing for the issuance of permits, collection of fees, making of inspections; and therefore, providing penalties for the violation thereof. (C) The adoption of the 2021 Michigan Plumbing Code is done in accordance with M.C.L.A. § 117.3(k). Section 7. Interpretation. Nothing in this Ordinance or in the Code hereby adopted shall be construed to affect any suit or proceeding in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance hereby repealed; nor shall any just or legal right or remedy or any character be lost, impaired or affected by this Ordinance. Section 6. Severability. Severability. Should any word, sentence, phrase or any portion of this Ordinance be held in a manner invalid by any court of competent jurisdiction or by any state agency having authority to do so for any reason whatsoever, such holdings shall be construed and limited to such word, sentence, phrase or any portion of the Ordinance held to be so invalid and shall not be construed as affecting the validity of any of the remaining words, sentences, phrases or portions of this Ordinance. Section 7. Conflicting Ordinance. Conflicting Ordinances. All prior existing ordinances adopted by the City of Wyandotte inconsistent or in conflict with the provisions of this Ordinance are, to the extent of such conflict or inconsistency, hereby expressly repealed. Section 8. Effective Date. This ordinance shall take immediate effect. This ordinance is deemed necessary for the immediate preservation of the public peace, property, health, safety and for providing for the usual daily operation of the City Engineers Office and the City Clerk’s Office. This ordinance shall be published in a newspaper generally circulated in the City of Wyandotte with in ten (10) days after adoption. A complete copy of the codes are made available to the public at the office of the City Clerk. Motion unanimously carried. 2025-152 BILLS & ACCOUNTS By Councilperson Calvin, supported by Councilperson Alderman RESOLVED that the total bills and accounts of $1,827,035.94 as presented by the Mayor and City Clerk are hereby approved for payment.
