Presentations and Proclamations Marvin Compton Day Proclamation - Mayor Pillmore read the proclamation. He said it was an honor to meet Marvin. Mike Devenitch emphasized that this is 75 years with the Yukon American Legion, Mr. Compton will be turning 100 at the end of this month. Consider a motion( s) to vote on behalf of the City of Yukon for two ( 2) Oklahoma Municipal Assurance Group ( OMAG) Board of Trustees The motion to vote for Tim Crissup of Waynoka and Daniel McClure of McLoud, was made by Council Member Pillmore and seconded by Council Member Wootton. Consider appointing one member and one or two alternates to serve on the Association of Central Oklahoma Governments ( ACOG) Board of Directors, 911 ACOG Board of Directors, ACOG MPO Policy Committee, and Garber- Wellington Association Policy Committee ( GWAPC) The motion to appoint Council Member Selby as appointed member with no alternate, was made by Mayor Pillmore and seconded by Council Member Wootton. Discussion and possible action on Ordinance No. 1471, an ordinance amending the Code of Ordinances of the City of Yukon, Oklahoma, to authorize and regulate the operation of slow- moving vehicles including golf carts and utility vehicles on designated city streets; providing for definitions, registration, safety requirements, restrictions, and penalties; and declaring an emergency The motion to amend this ordinance to move the City streets from 35 mph to 30 mph, was made by Council Member Pillmore and seconded by Council Member Wootton. Zak Kastl, 728 Villa, wanted to know why this is on the City streets. Mayor Pillmore said it promotes alternative forms of transportation within neighborhoods. Mr. Kastl expressed that this would allow these vehicles to operate on one street outside a neighborhood, Holly Ave. Mayor Pillmore advised that you cannot jump on certain streets, like Garth Brooks Blvd., with these golf carts. Mr. Kastl asked if these vehicles would need to be tagged. Mayor Pillmore advised that they are not required to be tagged or registered. Chief Corn informed Council that more of a utility type can be tagged with the tax commission with certain requirements. This is the City' s decision, it is very restrictive, and we can still pull these vehicles over. There are still laws that will apply to these, and this will be within the permitting and stickering. Council Member Wootton asked if the Chief heard of any issues with this ordinance. Chief Corn said he had not heard of any issues, and they also reached out to El Reno and Blanchard. Council Member Shriver asked if you need to have a driver' s license and insurance. Chief Corn said that you will need to have a driver' s license, and nobody under the age of six may ride. The laws for this are very restrictive on who can be in them when being driven. He advised the Council that there is no requirement for insurance. Lakin Kastl, 728 Villa, said she spoke to her insurance agent, and she begs to differ. She was informed that these vehicles will need to be registered and have insurance. She asked if the citizens have to bear the burden if somebody pulls out in front of other drivers. She said the Council is putting this on Oklahoma insured drivers. Mayor Pillmore recessed at the Council Chambers to reconvene at the Yukon Police Department for Best Practices training. Lakin Kastl, 728 Villa, asked why we are using the Emergency Clause. Mayor Pillmore said he does not know. Lakin said that you use emergency clauses for certain reasons, not just because you want it done quickly. She said to use an emergency clause you need to state the emergency; we should know the emergency. Mayor Pillmore said these are permitted land uses for the use of the land. Suzanne Heggy, 720 Chateau Ave., said emergency provisions need to be in separate sections, stating why these are adopted immediately. Mayor Pillmore said the ordinance states the emergency. Council Member Wootton requested a breakdown of what will be considered a high- volume user and asked Mr. Castro to talk about Greywater. Mr. Castro said this is a high- volume user, 1 million gallons, and it' s a tiered rate. The Ordinance is calling for is a separate agreement that we would enter into with Greywater. Greywater agreements will be unique to the City and how the City uses water. Council Member Wootton asked how many high- volume users we currently have and if this will affect users. Mr. Castro said he isn' t aware of any current users, and it won' t affect users unless they use this much water. Mayor Pillmore said that there were two users, previously told to him last year. Water is one of the City' s most precious resources within our City. The staff has envisioned a scenario, to help undo a burden. Suzanne Heggy, 720 Chateau Ave., asked why we are having an emergency if we only had two users last year. When the word emergency is in there, it means something is urgent. She asked if the Council cannot tell her the emergency, then why is the Council doing this. Mayor Pillmore said that right now we do not have any mechanisms in place right now and the City could have something occur within the next 30 days. The lack of water is the issue in Yukon. Discussion and possible action to approve the request from Riz Najmi/ NAFA Engineering for a Simplified Planned Unit Development, located at 1225 Vandament Ave, as recommended by the Planning Commission Mayor Pillmore opened the discussion. Sharon O' Brien, 1210 Dorchester Ct., said she has lived here for years and it has been a field that wasn' t being taken care of. She doesn' t mind with something being built, but she isn' t a fan of a two- story building. She also has concerns about this being affordable housing, and Council Member Zimmerman advised that it is not his understanding. Riz Najmi, the developer, will be putting new fences as part of the planned unit development, along with enhanced landscaping. The code requires them to put windows in the back due to those areas being a bedroom. Nancy Seaton, 905 Lancaster Dr., said her concerns are adding to the school system with more families and the traffic in that area. The traffic with commercial development will not be around the clock traffic. Erika Swann, 904 Garden Grove, is all for commercial development to get the tax dollars for Yukon. She would like to see a win for the residents with more commercial aspects on this side of town. She is trying to think of what is best for the residents against that property. Council Member Zimmerman states that he has looked over the plan and doesn' t mind the plan, but his concern is do we give up commercial property. Stephanie Burdine, 515 Maple, remembers reading something about this in the paper and she isn' t sure there is enough room for this project. With there being a huge concern about commercial property, why would we give up commercial development to build something so dense. Yukon residents live here for the quality of life, and she believes the Council needs to look at the quality of life. Riz Najmi mentions that this is currently commercial, and we are going to keep all but two acres of this development commercial. This area has been vacant for years because of it' s location, and if this is left vacant, it won' t create any taxes. Stephanie Burdine, 515 Maple, feels strongly about making this a one- story handicap accessible for seniors in our community. That type of housing is much needed for our seniors. Mayor Pillmore clarified that the pieces on the side will be commercial and the ones against the back line will be residential. Joe Doan, 704 Side Track, the developer said that it was not viable for commercial, but he is bringing in commercial. Mayor Pillmore said that the developer doesn' t see it viable to put commercial behind the current commercial, so that is why he is putting it on the side. Mayor Pillmore thanked the Fire Fighters and believes they do a great job. They are always on the ball no matter what the call is for. Trey Bishop, 12541 W Reno Ave., requested a two- minute video be played of an arrest in Yukon. After the video played, he talked about how the man in the video died three hours after being dropped off at the Canadian County Sheriff' s Office. He wanted the video showed so that people would pay attention to the fact that the Police Officer was not invited into the house. There was no reason for the arrest, and this could happen to any one of us at any time. Stephanie Burdine, 515 Maple Ave., wants the Council to consider not going into business with JW Roth and Venu. She explains what the business model is for them and doesn' t believe it is a good fit for Yukon. She is not against development on this land, but would like Council to do their research. Joe Doan, 704 Side Track, has heard the pros and cons of this development and if it' s such an important topic that will affect the community, then he asked why not bring this to a vote of the people. Joe Horn, 102 S 5th St., was a member of the Board of Adjustments for many years. From his experience, the people should have the right to enjoy their property. The Council has let these people speak and says they are listening to the people but some members still voted for the study, Council Member Selby was the only one listening to the people. He expresses that the people in the community have voted for the Council, but they have chosen not to listen. Mr. Horn encourages the Council to do what they were elected to do and represent these people. Lisa Hobbs, 715 Kingsgate Rd., has had friends who work in the finance business look into Venu and they were advised by their friend not to invest in this company. She then goes on to express that the citizens of Yukon will pay for this and they have expressed they do not want this. She would like if the Council would listen to the citizens and not those that drive in occasionally. The citizens are your neighbors, your friends, your church family; we are the ones that pay taxes and we are the ones that matter and we have the right to enjoy our homes. 15. New Business None 16.
