INTRODUCED BY COUNCIL
AN ORDINANCE ADOPTING AN ECONOMIC DEVELOPMENT PLAN
FOR THE DEADWOOD CITY INCENTIVE DISTRICT
WHEREAS, Section 5709.40 (C) of the Ohio Revised Code authorizes the legislative
authority of a Municipal Corporation to create, by Ordinance, an incentive district and
declare improvements to each parcel of real property within that district to be a public
purpose;and
WHEREAS, Section 5709.40 (A) of the Ohio Revised Code requires an incentive district
to have one or more distress characteristics, which may be defined as inadequate public
infrastructure serving the district as evidenced by a written economic development plan for
the District; and
WHEREAS, the City has determined to create an incentive district as depicted and
described on Exhibit A attached hereto; and
WHEREAS, the Area within the Deadwood City Incentive District has been studied and
an economic development plan has been prepared for that area, which Economic
Development Plan has been submitted to Council and contains recommendations addressing
land use, housing, and public infrastructure related issues.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ZANESVILLE, AS
FOLLOWS:
SECTION ONE: The Council hereby adopts and approves the Economic Development
Plan and authorizes the Administration to consult and utilize the Economic Development
Plan as guidance in establis hing the Deadwood City Incentive District and providing financing
for public infrastructure improvements. Copies of the Economic Development Plan shall be
kept on file with the Community Development Department at City Hall.
SECTION TWO: Council may hereafter proceed to establish the Incentive District under
Section 5709.40 (C) of the Ohio Revised Code.
SECTION THREE: It is found and determined that all formal actions of this Council
concerning and relating to this legislation were adopted in an open meeting of this Council
and that all deliberations of this Council and any of its committees that resulted in such
formal action were in meetings open to the public in compliance with all legal requirements,
including §121.22 of the Ohio Revised Code.

EXHIBIT A
Deadwood City Development
TIF Incentive District Economic Development Plan
Introduction
Sections 5709.40, 5709.42, and 5709.43 of the Ohio Revised Code authorize the council of a
municipality to create, by ordinance, one or more tax increment financing incentive districts and
declare improvements within those districts to be a public purpose. "Improvements" are defined
as increases in assessed values of properties that occur after the effective date of the ordinance
that created the district(s).
To be eligible for establishment, an incentive district must (1) be enclosed by a contiguous
boundary, (2) contain no more than three hundred acres, and (3) have one or more distress
characteristics as defined by the Ohio Revised Code. Distress characteristics include (but are not
limited to) blighted property, high unemployment rates, and above-average poverty rates.
Distress characteristics may also be defined as inadequate public infrastructure serving the
district as evidenced by a written economic development plan for the district. The engineer
serving the municipality must certify that the existing infrastructure within the district is
inadequate to meet the future development needs of the district and the plan must be adopted
by the corresponding legislative authority.
The Plan
This Economic Development Plan (this " Plan") is intended to facilitate the creation of one or more
incentive districts within the City of Zanesville, Ohio (the "Planning Area"). This Plan proposes
development projects that will help carry out the objectives set forth in this Plan by promoting a
full spectrum of housing choices and adequate educational, recreational, and civic opportunities,
all of which are essential components of the development of a sustainable community.
The parcels located within the Planning Area have been or are expected to be approved for this
development, and public infrastructure improvements will be necessary to ensure that the
development is adequately served by roadways, utilities, parks, and other forms of public
facilities and infrastructure. The incremental revenue generated within the incentive district(s)
will provide funds for these public infrastructure improvements.
Planning Area
The Planning Area is identified and depicted on Attachment A. It is within the City of Zanesville,
Muskingum County, Ohio (the "City").

Proposed Development
The Planning Area is currently expected to be developed to provide for an appropriate mix of
land uses and associated community facilities and infrastructure. The current anticipated
development for the Planning Area includes new residential development.
This proposed development, including the public infrastructure improvements, will promote
responsible growth while protecting environmentally sensitive areas.
Objectives include:
• Develop neighborhoods with a variety of housing types and options
• Provide a safe, efficient and attractive network of streets
• Develop strong neighborhoods based on pedestrian orientation, proper scale, quality
architecture and design, and proximity of parks and open space and retail, transportation
and other necessities
• Ensure that all development is served by appropriate utility services
Public Infrastructure Improvements
Payments in lieu of taxes collected from the incentive district(s) will fund public infrastructure
improvements necessary to support the development of the Planning Area. These public
infrastructure improvements include, but are not limited to, the following improvements:
• Street and roadway improvements
• Utility improvements
• Streetscape and landscape improvements
• Gas, electric and communications service facilities improvements
• Public park improvements
• Public facilities
• Environmental remediation projects
• Land acquisition and site preparation for the foregoing improvements
Economic Impact
The anticipated development of the Planning Area will help carry out the objectives set forth by
the City and will play a vital role in the growth and preservation of the community through
planned development. The development will provide housing options and job opportunities for
new and existing area residents and generate additional tax revenue for the area. The anticipated
development will create an urgent need for infrastructure throughout the Planning Area. The
proposed incentive districts will assist in financing those public infrastructure improvements.

Conclusion
The proposed development and investment in public infrastructure will benefit the Planning Area
in many ways. They will address existing deficiencies, enhance the physical landscape, enrich
community life, and serve to align the Planning Area with the greater vision for Muskingum
County. In the years ahead, the improvements will also enable the area to accommodate further
growth and redevelopment. The creation of one or more incentive districts will help provide
funding for public infrastructure and thus accommodate the future growth, while still providing
for the preservation of environmentally sensitive areas.

AN ORDINANCE AUTHORIZING THE CITY OF ZANESVILLE TO ENTER INTO A COMMUNITY
REINVESTMENT AREA AGREEMENT WITH MID-OHIO DEVELOPMENT/KENSINGTON VILLAGE LLC
WHEREAS, the Council of the City of Zanesville desires to pursue all reasonable and legitimate
incentive measures to assist in encouraging economic and community development; and
WHEREAS, pursuant to Ohio Revised Code ("R.C.") Sections 3735.65 through 3735.70 (the "CRA
Act") and by Ordinance No. 88-191 dated November 14, 1988 (together with any amendments, the "CRA
Ordinance"), the Council created the Fairview Road Community Reinvestment Area (the "CRA" ); and
WHEREAS, City, pursuant to Ordinance No. 89-84 adopted by this Council on June 26, 1989,
Ordinance No. 90-74, adopted by this Council on June 25, 1990, Ordinance No. 90-159 (amended),
adopted by this Council on December 10, 1990, Ordinance No. 91-194, adopted by this Council on
December 23, 1991, Ordinance No. 92-53, adopted by this Council on March 23, 1992, Ordinance No. 92-
251, adopted by this Council on December 28, 1992, Ordinance No. 93-203, adopted by this Council on
November 8, 1993, Ordinance No. 98-84, adopted by this Council on May 26, 1998, Ordinance No. 19-12,
adopted by this Council on February 26, 2019, and Ordinance No. 2024-148, adopted by this Council on
December 23, 2024, amended the CRA and the CRA Ordinance; and
WHEREAS, Mid-Ohio Development/Kensington Village LLC, an Ohio limited liability company (the
" Developer") owns or is expected to own vacant unimproved properties, which real property currently has
been assigned tax parcel number 86-34-01-01-068 in the Muskingum County Auditor' s Office (the "Project
Site"); and
WHEREAS, the Project Site is within the boundaries of the aforementioned CRA established by the
CRA Ordinance; and
WHEREAS, the Developer desires to participate in the CRA program; and
WHEREAS, the Developer wishes to enter into a community reinvestment area agreement (the "CRA
Agreement") to receive an exemption from taxation for the construction of residential multi-family units on
a portion of the Project Site (the " Project"); and
WHEREAS, the Project Site is located within the West Muskingum Local School District (the "School
District") and the Mid-East Ohio Joint Vocational School District (the "JVSD") and the Boards of Education of
each of the School District and the JVSD have been notified of the proposed approval of the CRA Agreement
in accordance with Sections 3735.671 and 5709.83 of the Ohio Revised Code, or have waived such notice,
and have been given a draft of the CRA Agreement; and
WH EREAS, the City of Zanesville desires to enter into the CRA Agreement in order to provide the
exemptions from taxation as described herein in accordance with the City's Community Reinvestment Area
program .

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ZANESVILLE, OHIO:
SECTION ONE: That the Council of the City of Zanesville hereby grants tax exemptions for real
property improvements consisting of the Project pursuant to ORC Section 3735.67 which exemption shall
be in the amount of seventy-five percent (75%) for a period of fifteen (15) years commencing in the first
year for which the Project would first be taxable were that property not exempted from taxation.
SECTION TWO: That the CRA Agreement in the form presently on file with the City Clerk, providing
for, among other things, the provision of the real property tax exemption for the Project, is hereby approved
and authorized with changes therein and completions thereto not inconsistent with this ordinance and not
substantially adverse to this City and which shall be approved by the Community Development Director. The
Community Development Director, for and in the name of this City, is hereby authorized to execute and
deliver that CRA Agreement and any amendments thereto that do not increase the percentage or number
of years of the tax exemption, provided further that the approval of changes, completions or amendments
thereto by that official, and their character as not being substantially adverse to the City, shall be evidenced
conclusively by the Community Development Director's execution thereof.
SECTION THREE: That the Council further hereby authorizes the Mayor, the Community
Development Director, the Finance Director and the Law Director, and other appropriate officers of the City,
to sign those agreements, certificates, and instruments; submit or file any documents or materials as
necessary or appropriate; make those arrangements; and take any other actions as are necessary or
appropriate to carry out the purposes of this Ordinance and the CRA Agreement, and facilitate the tax
exemption described herein.
SECTION FOUR: It is hereby found and determined that all formal actions of this Council concerning
and relating to the passage of the ordinance were adopted in an open meeting of Council, and that all
deliberations of the Council and any of the decision-making bodies of the City of Zanesville which resulted
in such formal actions were in meetings open to the public in compliance with all legal requirements of the
State of Ohio.

INTRODUCED BY COUNCIL
AN ORDINANCE IMPLEMENTING SECTIONS 3735.65 THROUGH 3735.70 OF THE
OHIO REVISED CODE, ESTABLISHING AND DESCRIBING THE BOUNDARIES OF A
COMMUNITY REINVESTMENT AREA IN THE CITY OF ZANESVILLE, OHIO.
WHEREAS, the City of Zanesville, Ohio ("City") desires to pursue all reasonable and
legitimate incentive measures to assist and encourage development in specific areas of the City
that have not enjoyed reinvestment from remodeling or new construction; and
WHEREAS, a survey of housing ("Housing Survey") of the area described and depicted in
Exhibit A attached hereto and incorporated herein by this reference ("Area") has been prepared
as required by Ohio Revised Code ("R.C.") Section 3735.66, a copy of which survey is on file with
the City; and
WHEREAS, the maintenance of existing and construction of new structures in such area
would serve to encourage economic stability, maintain real property values, and generate new
employment opportunities; and
WHEREAS, the Council for the City ("Council") has determined that the construction of
new structures and the remodeling of existing structures in the Area is a public purpose, and
would encourage the creation and retention of employment opportunities and would benefit the
overall economic health of the City; and
WHEREAS, the City desires to designate the Area as the "Zanesville Northwest Community
Reinvestment Area" (the "CRA" ) pursuant to R.C. Sections 3735.65 through 3735.70 (the "Act")
to encourage such development.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL FOR THE CITY OF ZANESVILLE,
OHIO, THAT:
Section 1. The CRA constitutes an area in which developable land exists where housing
facilities or are located, and in which new construction or repair of existing facilities has not been
encouraged.
Section 2. This Council hereby establishes the CRA pursuant to the Act, with boundaries
as described and depicted in Exhibit A. Only residential, commercial, and/or industrial properties
consistent with the applicable zoning regulations within the designated CRA will be eligible for
exemptions pursuant to this Ordinance.

Section 3. All properties identified in Exhibit A as being within the designated Community
Reinvestment Area are eligible for this incentive (the city/village may determine that all or any
combination of project types - residential, commercial and industrial as eligible). This proposal is a
public/private partnership intended to promote and expand conforming uses in the designated area.
As part of the project, the City Zanesville intends to undertake supporting public improvements in
the designated area.
Section 4: Within the CRA, the percentage of the tax exemption on the increase in the
assessed valuation resulting from improvements to commercial and industrial real property and the
term of those exemptions shall be negotiated on a case-by-case basis in advance of construction or
remodeling occurring pursuant to R.C. Section 3735.67. The results of the negotiation as approved
by this Council will be set in writing in a CRA Agreement as outlined in R.C. Section 3735.671. For
residential property, a tax exemption on the increase in the assessed value resulting from the
improvements as described in R.C. Section 3735.67 shall be granted upon application by the
property owner and certification thereof by the designated Housing Officer (as defined herein) for
the following periods:
a. Fifteen (15) years for the remodeling of every residential dwelling unit upon which the cost
of remodeling is at least $2,500, as described in R.C. Section 3735.67, and with such
exemption being seventy-five percent (75%) for each of the fifteen (15) years.
b. Up to, and including, fifteen (15) years, and up to, and including, one hundred percent (100%)
for the remodeling of existing commercial and industrial facilities and upon which the cost of
remodeling is at least $5,000, as described in R.C. Section 3735.67, the term and percentage
of which shall be negotiated on a case-by-case basis in advance of remodeling occurring.
c. Fifteen (15) years for the construction of new residential dwelling units, with such exemption
being seventy-five percent (75%) for each of the fifteen (15) years
d. Up to, and including, fifteen (15) years, and up to, and including, one hundred percent (100%)
for the construction of new commercial or industrial facilities, the term and percentage of
which shall be negotiated on a case-by-case basis in advance of construction occurring.
For the purposes of the above described CRA, structures exclusively used for residential
purposes shall be classified as residential structures.
If remodeling qualifies for an exemption, during the period of the exemption, the exempted
percentage of the dollar amount of the increase in market value of the structure shall be exempt
from real property taxation. If new construction qualifies for an exemption, during the period of the
exemption, the exempted percentage of the structure shall not be considered to be an improvement
on the land on which it is located for the purpose of real property taxation.

Section 5. To administer and implement the provisions of this Ordinance, the Director of
Community Development (the "Director") is designated as the Housing Officer as described in the
Act.
Section 6. The City's Community Reinvestment Area Housing Council ("Housing Council")
shall make an annual inspection of the properties within the CRA for which an exemption has been
granted under R.C. Section 3735.67. The Housing Council shall also hear appeals related to the CRA
under R.C. Section 3735.70.
The City's Tax Incentive Review Council ("TIRC") shall review annually the compliance of all
agreements involving the granting of exemptions for commercial or industrial real property
improvements under R.C. Section 3735.671 and make written recommendations to the Council as to
continuing, modifying, or terminating said agreement based upon the performance of the agreement.
Section 7. The Mayor and/or Director are hereby authorized to take any and all actions
required by the Act for the establishment of the CRA consistent with the requirements of the Act and
this Ordinance.
Section 8. The Council hereby finds and determines that all formal actions relative to the
passage of this Ordinance were taken in an open meeting of this Council, that all deliberations of this
Council and of its committees, if any, which resulted in formal action were taken in meetings open to
the public, in full compliance with the applicable legal requirements, including R.C. Section 121.22.
Section 9. That this ordinance shall take effect and be in force from and after the earliest
period allowed by law and upon confirmation by the Director of the Ohio Development Services
Agency of the findings in this Ordinance.

WHEREAS, the City received proceeds from bond sales to improve the facility, which includes new
seating and acoustic panels; and
WHEREAS, the City solicited quotes under the State of Ohio Cooperative Purchasing Agreement for
new seating and acoustic panels.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Zanesville, State of Ohio, t hat:
SECTION ONE: The Community Development Director is hereby aut horized to enter into a purchase
agreement and execute all documents related to installation of seating and acoustics improvements with
Loth Incorporated under OMNIA Purchasing Contract NCPA #07-116.
SECTION TWO: The estimated cost of this project is $821,759.26 and shall be taken from Line Item
354-7951-56185.
SECTION THREE: This Council hereby finds and determine that all formal actions relative to the
