TOWN OF ZIONSVILLE, INDIANA BOARD OF POLICE COMMISSIONERS JULY 20, 2020 at 8 a.m. PUBLIC MEETING MEMORANDA ELECTRONIC MEETING 1100 West Oak Street Zionsville, IN I. OPENING Call meeting to order Attendance: President Nagy took attendance of the members. Members in attendance: Suzanne Nagy, Josh Garrett, Joe Culp, Marcia Rosenfeld, Bryan Traylor Members not present: None Also in attendance, Heather Willey, legal counsel for the Board of Police Commissioners, Chief Michael Spears II. APPROVAL OF THE MINUTES OF THE MAY 18, 2020 REGULAR MEETING (copy posted) Josh Garrett made a motion to approve the minutes from the May 18, 2020 Board of Police Commissioners meeting. Marcia Rosenfeld seconded the motion. All in favor. Motion passed with a vote of 5-0. ill. OLD BUSINESS None. IV. NEW BUSINESS A. UPDATED USE OF FORCE POLICIES AND USE OF FORCE BOARD Chief Spears would like to review the Use of Force policy with the board and ask for approval of the updated policy and the implementation of a Use of Force Board with civilian membership. There are (4) policies within the Use of Force. The first one (#300) Use of Force. The updates would include medical examination of all parties after the use of force. Josh Garrett asked Heather Willey if there are any complications with state statutes in appointing a civilian member to a board. Heather Willey will look into this matter and advise President Nagy and the Board. Chief Spears wants the police department to be as transparent as possible, and it will be an asset to have a civilian membership on the review board. Joe Culp asked if all of the officers have body cameras. Chief Spears stated that the officers have body cams and cameras in the vehicles. The other policies (#303 and #304) involve tasers, use of chemical sprays and these are now including medical evaluation for all parties involved. B. REQUIRMENT TO ADMINISTER PRELIMINARY BREATH TESTS AFTER ALL  VEHICULAR ACCIDENTS OF INCIDENTS. Chief Spears presents policy #501 and this involves officers having accidents in police vehicles. This updated policy will include a breath test be administered when an officer is involved in a vehicle crash. This protects the officer and answers any questions for the community. Suzy Nagy asked Chief Spears when are you required to administer a breath test. Chief Spears stated that taking a PBT when no one seems intoxicated is assurance that there is no intoxication. If a person seems intoxicated, you start a criminal investigation, and advise them of their rights. These findings can be used in the criminal investigation. Josh Garrett asked if we would use an outside agency if there was an incident involving one of our officers. Chief Spears is not opposed, and would adhere to the boards’ decision to utilize an outside agency. If there is a serious accident, the FACT team would be involved. Marcia Rosenfeld made a motion to approve policy #501. Joe Culp seconded the motion. Roll Call Vote: Josh Garrett – Yes Joe Culp – Yes Bryan Traylor – Yes Marcia Rosenfeld – Yes Suzy Nagy – Yes All approved. Motion passed with a vote of 5-0. Josh Garret has left the meeting. Marcia Rosenfeld made a comment about the internal component of the Use of Force Board is great than the civilian component. Chief Spears stated that the (3) components of the department (management, training and investigations). All of these investigations will ultimately be brought before the Board of Police Commissioners for review. Bryan Traylor made a motion to approve policy #300, #301, #302, #303, #304 as presented. Joe Culp seconded the motion. Roll call vote: Joe Culp – Yes Bryan Traylor – Yes Marcia Rosenfeld – Yes Suzy Nagy – Yes All approved. Motion passed with a vote of 4-0. C. JUNE 2020 MONTHLY REPORT Chief Spears would like to show comparisons from this year and last year going forward. Bryan Traylor like the format of this report. Marcia Rosenfeld has left the meeting. D. UPDATE ON RECRUITING EFFORTS Chief Spears gave an update on the current hiring process. He shared that we have over 105 indeed resumes and 18 formal applications received thus far. Chief Spears shared that our testing will be on August 2nd and invited the Board to come watch the physical agility testing. E. TRANSFER OF OWNERSHIP OF RETIRED OFFFICERS BALDWIN’S FIREARM Chief Spears would like to present Officer Nick Baldwin his duty firearm upon his retirement. Joe Culp made a motion to present Officer Nick Baldwin his duty firearm upon retirement. Bryan Traylor seconded the motion. Roll call vote:  Joe Culp – Yes Bryan Traylor – Yes Suzy Nagy – Yes Motion approved by a vote of 3-0. F. ZPD FIELD ROLL CALL SCHEDULE AND LOCATIONS The police officers have been asked to complete their daily roll-calls out in the community. This gives the community a presence of visibility of the police department. V. OTHER MATTERS None VI. ADJOURN Motion to adjourn by Bryan Traylor. Motion seconded by Joe Culp. All in favor, meeting is adjourned by a vote of 3-0. The next regular Board of Police Commissioners meeting is scheduled for Monday, August 17, 2020 at 8:00 a.m. or upon the conclusion of the Town Council meeting. Determination of the need for an electronic meeting will be evaluated prior to the meeting and final notice will be posted in compliance with the Indiana Open Door Law. In his Executive Orders 20-02, 20-04 AND 20-08 (collectively, the "Executive Orders"), Governor Eric J. Holcomb has ordered all political subdivisions of the State of lndiana to limit public gatherings and to implement the Centers for Disease Control and Prevention's and the Indiana State Department of Health's recommended virus mitigation strategies. The Executive Orders suspend certain requirements for Essential Governmental Functions that facilitate Essential Infrastructure with respect to public meetings and open door laws, including suspending physical participation requirements by members of public agency governing bodies and permitting public attendance through electronic means of communications. As a political subdivision of the State of Indiana, the Zionsville Board of Police Commissioners must comply with the Executive Orders throughout the duration of the COVID19 Public Health Emergency. If an electronic meeting format is selected, members of the public shall have the right to attend Board of Police Commissioners Public Meetings via the following forms of electronic communication.
