MEETING MEMORANDA
FOR
Monday, October 23, 2017 at 7:30 AM

Members Present: Elizabeth Hopper, Josh Garrett, Jason Plunkett, Tom Schuler, and Susana Suarez
Members Absent: Kevin Spees and Bryan Traylor
Also Present: Tim Haak, Mayor; Ed Mitro, Deputy Mayor; Adam Steuerwald, Town Attorney; Amy Lacy, Director of Finance & Records;
Mark Adam and Rebecca Zakowski, Crowe Horwath and Town Department Staff.
1. OPENING

B. Pledge of Allegiance
Councilor Garrett announced that Councilor Hopper had resigned her position as Town Council President as well as her positions on the
Safety Board and Board of Police Commissioners. He thanked Councilor Hopper for her leadership during her tenure as President and
called for a nomination for President.
COUNCIL ACTION: Councilor Suarez moved to nominate Councilor Garrett for Town Council President.
Councilor Plunkett seconded the motion. Councilor Garrett was elected Town Council President by a vote of five in favor, zero opposed.
President Garrett made a motion to nominate Councilor Traylor as Vice-President. Councilor Suarez seconded the motion. Councilor
Traylor was elected Town Council Vice-President by a vote of five in favor, zero opposed.
2. APPROVAL OF THE MEMORANDUM OF THE October 2, 2017 REGULAR MEETING (copy posted).
COUNCIL ACTION: Councilor Hopper moved to approve the Memoranda of the October 2, 2017 Town Council Meeting.
Councilor Suarez seconded the motion.
The Memoranda of the October 2, 2017 meeting was approved by a vote of five in favor, zero opposed.
3. DEPARTMENTAL MONTHLY REPORTS
Monthly Reports submitted by the Town Management staff for Council review on October 2, 2017 and posted on the Town’s
website (www.zionsville-in.gov).
4. PRESENTATION BY JOHN CINELLI – METRONET
MetroNet President John Cinelli gave an overview of MetroNet, highlighting the company’s positive impact to local economic
development and employment as well as their commitment to customer service and safety. Steve Biggerstaff of MetroNet
discussed the efforts and improvements the company had made regarding safety issues following recent gas line hits in other
communities.
Mr. Cinelli and Mr. Biggerstaff answered questions and addressed concerns from the Council.
5. REQUEST TO SPEAK
Zionsville resident Steve Bullington elected to speak during consideration of item 6A.
Zionsville resident Roger Burrus elected to speak during consideration of item 6D.
6. OLD BUSINESS
A. Consideration of an Ordinance Amendment to the Traffic Code of the Town of Zionsville Code of Ordinances (Colony Woods
no parking on portions of Williamsburg Lane and Williamsburg Court) ORDINANCE #2017-09 (CONTINUED FROM THE
OCTOBER 2, 2017 MEETING).
Street and Stormwater Superintendent Lance Lantz briefly reviewed Ordinance #2017-09.
Steve Bullington spoke in opposition to Ordinance #2017-09 and presented the results of a survey of directly impacted
residents. The submitted survey indicated there were four opposed and six in support of the proposed ordinance.
HOA President Leo Bianchi requested to speak. President Garrett noted that it was not a Public Hearing and a Request to
Speak card had not been submitted. Superintendent of Streets and Stormwater Lance Lantz explained that he had assumed
Mr. Bianchi would be allowed to speak as HOA President and originator of the ordinance request and had indicated the same
to Mr. Bianchi. Mr. Lantz stated that the lack of a Request to Speak card was his fault and asked President Garrett to
entertain allowing Mr. Bianchi the opportunity to comment. President Garrett allowed Mr. Bianchi to speak, asking that he
submit a Request to Speak card before the end of the meeting. Mr. Bianchi then spoke in support of the ordinance.
COUNCIL ACTION: President Garrett moved to adopt Ordinance #2017-09 on final reading. Councilor Hopper seconded
the motion. Ordinance #2017-09 was adopted on final reading by a vote of four in favor, one opposed, with Councilor Suarez
opposing.
B. Consideration of an Ordinance to Adopt the 2018 Budget for the Town of Zionsville ORDINANCE #2017-11 (SECOND
READING).
Deputy Mayor Mitro announced that due to an oversight in the publication of legal notice, the final reading and adoption of
the budget could not take place at the October 23, 2017 meeting. A special meeting for final reading and adoption of the
budget was set for October 30, 2017 at 7:30 AM.
C. Consideration of an Ordinance amending the Cash Drawer Ordinance ORDINANCE #2017-12 (SECOND READING).
Director of Finance and Records Amy Lacy briefly reviewed Ordinance #2017-12.
COUNCIL ACTION: Councilor Suarez moved to adopt Ordinance #2017-12 on final reading. Councilor Plunkett seconded the
motion. Ordinance #2017-12 was adopted on final reading by a vote of five in favor, zero opposed.
D. Consideration of a Zone Map Change Ordinance to rezone 6.0 acres from the B-2 and B-3 Commercial Districts to the VBD
(Urban Village Business) District. ORDINANCE #2017-13 (SECOND READING)
Attorney Roger Burrus spoke on behalf of the owner of the property up for rezoning in Ordinance #2017-13. He stated that his
client was opposed to the rezoning of the property.
COUNCIL ACTION: President Garrett moved to adopt Ordinance #2017-13 on final reading. Councilor Suarez seconded the
motion. Ordinance #2017-13 was adopted on final reading by a vote of five in favor, zero opposed.
E. Consideration of a Zone Map Change Ordinance to rezone 46.45 acres from the R-2 Residential District to the SU-7 (Special
Use) District to provide for current and projected programming associated with Interactive Academy ORDINANCE #2017-14
(SECOND READING)
Director of Planning and Economic Development Wayne DeLong briefly reviewed Ordinance #2017-14 and answered
questions from the Council.
COUNCIL ACTION: Councilor Suarez moved to adopt Ordinance #2017-14 on final reading. Councilor Hopper seconded the
motion. Ordinance #2017-14 was adopted on final reading by a vote of five in favor, zero opposed.
7. NEW BUSINESS
A. Consideration of a request to waive filing fees – DeRossi Estates re-plat.
Attorney Matt Price reviewed the request for a waiver of the application fees in connection with a plat filing before the
Zionsville Plan Commission.
Deputy Mayor Mitro answered questions from the Council.
COUNCIL ACTION: Councilor Suarez moved to waive the filing fees. Councilor Hopper seconded the motion. The request to
waive filing fees was granted by a vote of five in favor, zero opposed.
8. OTHER MATTERS
President Garrett announced the resignation of Beth Casselman from the Zionsville Architectural Review Committee and noted that
this was a Council appointed position.
COUNCIL ACTION: President Garrett moved to nominate Cara Weber to the Zionsville Architectural Review Committee.
Councilor Suarez seconded the motion. Cara Weber was appointed to the Zionsville Architectural Review Committee by a vote of
five in favor, zero opposed.
President Garrett noted an opening to be filled on the Safety Board.
COUNCIL ACTION: President Garrett moved to nominate Councilor Plunkett to the Safety Board.
Councilor Suarez seconded the motion. Councilor Plunkett was appointed to the Safety Board by a vote of five in favor, zero
opposed
President Garrett noted an opening to be filled on the Board of Police Commissioners.
COUNCIL ACTION: President Garrett moved to nominate Councilor Traylor to the Board of Police Commissioners.
Councilor Suarez seconded the motion. Councilor Traylor was appointed to the Board of Police Commissioners by a vote of five in
favor, zero opposed
9. ADJOURN
COUNCIL ACTION: Councilor Hopper moved to adjourn the meeting. Councilor Suarez seconded the motion.
The motion was approved by a vote of five in favor, zero opposed.
A Special Town Council Meeting is scheduled for Monday, October 30, 2017 at 7:30 AM in the New Zionsville Town Hall Council
Chambers.
The next regular Town Council meeting is scheduled for Monday, November 6, 2017 at 7:00 PM in the New Zionsville Town Hall
Council Chambers.
