ZIONSVILLE TOWN COUNCIL MEETING MEMORANDA FOR Monday, October 2, 2017 at 7:00 PM New Zionsville Town Hall Council Chamber 1100 West Oak Street Date of Preparation: October 3, 2017 Members Present: Josh Garrett, Vice-President; Jason Plunkett, Tom Schuler, Kevin Spees, Bryan Traylor, and Susana Suarez Members Absent: Elizabeth Hopper, President Also Present: Tim Haak, Mayor; Ed Mitro, Deputy Mayor; Heather Willey, Town Attorney; Mark Adam, Crowe Horwath; Amy Lacy, Director of Finance & Records and Town Department Staff. 1. OPENING A. Call meeting to order B. Pledge of Allegiance 2. APPROVAL OF THE MEMORANDUM OF THE September 5, 2017 REGULAR MEETING (copy posted). COUNCIL ACTION: Councilor Spees moved to approve the Memoranda of the September 5, 2017 Town Council Meeting. Councilor Suarez seconded the motion. The Memoranda of the September 5, 2017 meeting was approved by a vote of six in favor, zero opposed. 3. DEPARTMENTAL MONTHLY REPORTS Monthly Reports submitted by the Town Management staff for Council review and posted on the Town’s website (www.zionsville-in.gov). 4. REQUEST TO SPEAK Zionsville resident Steve Bullington discussed item 5A and urged Council to vote against the Ordinance Amendment to the Traffic Code because he and his immediate neighbors who are most impacted do not feel there is a problem with the current parking situation. Zionsville resident Attorney Roger Burrus spoke regarding item 6C. Mr. Burrus stated that he represented the owner of the property up for rezoning in Ordinance #2017-13. He expressed concerns over the potential rezoning and stated that his client was opposed to any rezoning of her property due to the complications it may pose to potential buyers. 5. OLD BUSINESS A. Consideration of an Ordinance Amendment to the Traffic Code of the Town of Zionsville Code of Ordinances (Colony Woods no parking on portions of Williamsburg Lane and Williamsburg Court) ORDINANCE #2017-09 (SECOND READING). Street and Stormwater Superintendent Lance Lantz reviewed Ordinance #2017-09 and answered questions from the Council. Councilor Suarez stated that she felt more information was needed from the residents of the affected neighborhood before making a decision. Following Council discussion it was the decision of the Council to continue item 5A to the October 23, 2017 Town Council meeting in order to gather more public input. No further action was taken.  B. Consideration of a Zone Map Change Ordinance to rezone 13 acres from the RV (Urban Residential Village) and R-SF-2 (Urban Single Family Residential) Districts to the Planned Unit Development (PUD) Classification ORDINANCE #2017-10 (SECOND READING). Attorney Matt Price spoke on behalf of MAP Development 1861 LLC regarding Ordinance #2017-10. He answered questions from the Council. COUNCIL ACTION: Councilor Suarez moved to adopt Ordinance #2017-08 on final reading. Councilor Schuler seconded the motion. Ordinance #2017-10 was adopted on final reading by a vote of five in favor, one opposed, with Councilor Spees opposing. 6. NEW BUSINESS A. Consideration of an Ordinance to Adopt the 2018 Budget for the Town of Zionsville ORDINANCE #2017-11 (FIRST READING and PUBLIC HEARING). Deputy Mayor Mitro introduced Ordinance #2017-11, giving a brief overview of the proposed budget, emphasizing that the budget was robust, but balanced and fully funded. Mayor Haak then gave an overview of the proposed 2018 budget. He presented highlights from each department, including several new line items and new positions for 2018. He answered questions from the Council. Deputy Mayor Mitro concluded the presentation with a review of the cash summary. He noted the very healthy balances and cited the Public Safety LIT as an important contribution to that. He stated that the proposed 2018 budget was very healthy and sustainable. He reiterated that the second reading of the Ordinance would occur at the October 23, 2017 Town Council meeting. With Proof of Publication for a Public Hearing noted, Vice President Garrett opened the Public Hearing for comment. Zionsville resident Ralph Stacy expressed his concerns over the condition of Lincoln Park and Village streets as funding of various projects is considered. In answer to his interest in reviewing the budget Deputy Mayor Mitro and Vice President Garrett directed Mr. Stacy to the Town of Zionsville website to view a copy of the 2018 budget. With no further public comment, Vice President Garrett closed the Public Hearing. Mayor Haak, Deputy Mayor Mitro and Mark Adam of Crowe Horwath answered additional questions from the Council. Vice-President Garrett called for a motion to introduce Ordinance #2017-11 on first reading. COUNCIL ACTION: Councilor Suarez moved to introduce Ordinance # 2017-11 on first reading and Councilor Traylor seconded the motion. The motion passed with a vote of six in favor, zero opposed. Ordinance 2017-11 was introduced on first reading. No further action taken. B. Consideration of an Ordinance amending the Cash Drawer Ordinance ORDINANCE #2017-12 (FIRST READING). Director of Finance and Records Amy Lacy reviewed Ordinance #2017-12, stating that in the interest of customer service and convenience there was a need to fund cash drawers for both the Department of Finance and Records and the Nature Center in order to provide change to customers. COUNCIL ACTION: Councilor Traylor moved to introduce Ordinance # 2017-12 on first reading and Councilor Suarez seconded the motion. The motion passed with a vote of six in favor, zero opposed. Ordinance 2017-12 was introduced on first reading. No further action taken. C. Consideration of a Zone Map Change Ordinance to rezone 6.0 acres from the B-2 and B-3 Commercial Districts to the VBD (Urban Village Business) District. ORDINANCE #2017-13 (FIRST READING) Director of Planning and Economic Development Wayne DeLong reviewed Ordinance #2017-13, stating that it was coming to the Council with a favorable recommendation from the Plan Commission. He answered questions from the Council. COUNCIL ACTION: Councilor Traylor moved to introduce Ordinance # 2017-13 on first reading and Councilor Suarez seconded the motion. The motion passed with a vote of six in favor, zero opposed. Ordinance 2017-13 was introduced on first reading. No further action taken. D. Consideration of a Zone Map Change Ordinance to rezone 46.45 acres from the R-2 Residential District to the SU-7 (Special Use) District to provide for current and projected programming associated with Interactive Academy ORDINANCE #2017-14 (FIRST READING) Todd Rottman spoke on behalf of Interactive Academy, giving an overview and history of Interactive Academy and the programs offered to the community. He explained the need for the requested rezoning. Mr. Rottman and Mr. DeLong answered questions from the Council. COUNCIL ACTION: Councilor Suarez moved to introduce Ordinance # 2017-14 on first reading and Councilor Plunkett seconded the motion. The motion passed with a vote of six in favor, zero opposed. Ordinance 2017-14 was introduced on first reading. No further action taken.  E. Consideration of an Additional Appropriation Resolution from the CCD Fund ($150,000 to assist in funding the CR 700 East pathway) RESOLUTION #2017-24 (PUBLIC HEARING). Superintendent of Streets and Stormwater Lance Lantz reviewed Resolution #2017-24 and the need for the additional appropriation in order to complete the pathway project. He answered questions from the Council. With Proof of Publication for a Public Hearing noted, Vice-President Garrett opened the Public Hearing for comment. With no public comment, Vice-President Garrett closed the Public Hearing and called for discussion or a motion. COUNCIL ACTION: Councilor Schuler moved to approve Resolution #2017-24. Councilor Suarez seconded the motion. Resolution #2017-24 was approved by a vote of six in favor, zero opposed. F. Consideration of a Resolution creating the TIF Economic Development Area for US 421 and CR 300 South Area. RESOLUTION #2017-25 Town Attorney Heather Willey reviewed Resolution #2017-25, explaining the process of creating the Economic Development area. Attorney Matt Price spoke on behalf of Harris FLP. Ms. Willey and Mr. Price answered questions from the Council. COUNCIL ACTION: Councilor Suarez moved to approve Resolution #2017-25. Councilor Plunkett seconded the motion. Resolution #2017-25 was approved by a vote of six in favor, zero opposed. G. Consideration of Modification of Commitments in order to allow for Integrated Center Signage in the PR (Rural Professional Business) Zoning District at the Stonegate Subdivision Wayne DeLong gave a brief introduction and review of the Modification of Commitments and explained why it was necessary in order to add a second sign in the area. He also noted that it came to the Council with a favorable recommendation from the Plan Commission. Carol Reitz, Stonegate business and property owner and the developer of Stonegate and Attorney James Carter, legal counsel for the Reitz family spoke in favor of the signage. Mr. DeLong and Mr. Carter answered questions from the Council. Vice-President Garrett called for a motion to approve the Plan Commission’s recommendation. COUNCIL ACTION: Councilor Suarez moved to approve the Plan Commission’s recommendation of Modification of Commitments in order to allow for Integrated Center Signage in the PR Zoning District at the Stonegate Subdivision. Councilor Plunkett seconded the motion. The motion passed with a vote of six in favor, zero opposed. 7. OTHER MATTERS There were no other matters to discuss. 8. APPROVAL OF CLAIMS COUNCIL ACTION: Councilor Traylor moved to approve claims as presented. Councilor Spees seconded the motion. Claims were approved by a vote of six in favor, zero opposed. 9. ADJOURN COUNCIL ACTION: Councilor Suarez moved to adjourn the meeting and Councilor Plunkett seconded the motion. The motion was approved by a vote of six in favor, zero opposed. The next regular Town Council meeting is scheduled for Monday October 23, 2017 @ 7:30 AM in the New Zionsville Town Hall Council Chambers.
