ZIONSVILLE TOWN COUNCIL MEETING MEMORANDA FOR Tuesday, September 5, 2017 at 7:30 AM Zionsville Town Hall Community Room 1100 West Oak Street Date of Preparation: 09.07.2017 Members Present: Elizabeth Hopper, President; Josh Garrett, Vice-President; Jason Plunkett, Tom Schuler, Kevin Spees, Bryan Traylor, and Susana Suarez Members Absent: None Also Present: Tim Haak, Mayor; Ed Mitro, Deputy Mayor; Heather Willey, Town Attorney; Amy Lacy, Director of Finance & Records and Town Department Staff. 1. OPENING A. Call meeting to order B. Pledge of Allegiance 2. APPROVAL OF THE MEMORANDUM OF THE August 21, 2017 REGULAR MEETING (copy posted). COUNCIL ACTION: Vice President Garrett moved to approve the Memoranda of the August 21, 2017 Town Council Meeting. Councilor Suarez seconded the motion. The Memoranda of the August 21, 2017 meeting was approved by a vote of seven in favor, zero opposed. 3. DEPARTMENTAL MONTHLY REPORTS Deputy Mayor Mitro explained that due to the Labor Day holiday Departmental Monthly Reports would be submitted by the Town Management staff for Council review and posted on the Town’s website on Wednesday, September 6, 2017. (www.zionsville-in.gov) 4. REQUEST TO SPEAK Zionsville Resident John Finnell spoke regarding item #6B, Consideration of a Zone Map Change Ordinance to rezone 13 acres RV and R-SF-2 Districts to the Planned Unit Development Classification. Mr. Finnell shared his concerns regarding population density, which he felt would be excessive for Village standards. He also expressed concern regarding drainage and flooding issues. 5. OLD BUSINESS – None 6. NEW BUSINESS A. Consideration of an Ordinance Amendment to the Traffic Code of the Town of Zionsville Code of Ordinances (Colony Woods no parking on portions of Williamsburg Lane and Williamsburg Court) ORDINANCE #2017-09 (FIRST READING). Street and Stormwater Superintendent Lance Lantz presented Ordinance #2017-09 stating the ordinance amendment was at the request of the homeowners, had been vetted by Fire and Police Departments and was being presented with a favorable recommendation from the Safety Board. COUNCIL ACTION: Councilor Suarez moved to introduce Ordinance # 2017-09 on first reading. Councilor Spees seconded the motion. The motion passed with a vote of seven in favor, zero opposed. Ordinance 2017-09 was introduced on first reading. No further action taken.  B. Consideration of a Zone Map Change Ordinance to rezone 13 acres from the RV (Urban Residential Village) and R-SF-2 (Urban Single Family Residential) Districts to the Planned Unit Development (PUD) Classification ORDINANCE #2017-10 (FIRST READING). Attorney for the petitioner, Matt Price of Bingtham Greenebaum Doll gave an overview of the proposed project. Mr. Price answered questions from the Council. He addressed density and drainage issues. He stressed that the project density would not substantially deviate from that of the existing Village. He stated that it was the intent of the project to put in place additional Stormwater measures to improve existing drainage conditions, and would raise the proposed homes out of the flood plain. Mr. Price also assured the Council that the Town would not incur any costs for relocating any existing residents from the current trailer park. He said they would add trails within the project’s property, which would be open to the public and would connect the trails with the Town’s existing public pathways. COUNCIL ACTION: Councilor Suarez moved to introduce Ordinance # 2017-10 on first reading. Councilor Plunkett seconded the motion. The motion passed with a vote of six in favor, one opposed, with Councilor Spees opposing. Ordinance 2017-10 was introduced on first reading. No further action taken. C. Consideration of a Resolution authorizing the transfer of Lot 2 and Lot 3 of the Zionsville Government Center Minor Plat to the RDC upon completion of the bond exchange process and the Town receiving title from the Town Hall Building Corporation. RESOLUTION #2017-23 Town Attorney Heather Willey presented Resolution #2017-23. She explained this was basically a “bond swap” on the existing Town Hall bond allowing property to be transferred from the Town Hall Building Corporation to the Redevelopment Commission while the bond would remain with the Town Hall Building Corporation. Ms. Willey answered questions from the Council. COUNCIL ACTION: Vice President Garrett moved to approve Resolution #2017-23. Councilor Spees seconded the motion. Resolution #2017-23 was approved by a vote of seven in favor, zero opposed. 7. OTHER MATTERS Deputy Mayor Mitro stated that the Town Hall staff would be officially moving to the new location within the next two weeks. He said that Town Hall would be closed for business on Friday, September 15, 2017 through Monday, September 18, 2017 while staff, with the assistance of Wheaton Moving and Storage, make the move to the new Town Hall. He announced that the new Town Hall would officially open for business on Tuesday, September 19, 2017. He also reminded all that this would be the last Town Council meeting in the Beverly Harves Room in the Old Town Hall and that the next Town Council meeting would be held in the council chambers at the new Town Hall on October 2, 2017. 8. APPROVAL OF CLAIMS COUNCIL ACTION: Councilor Traylor moved to approve claims as presented. Councilor Suarez seconded the motion. Claims were approved by a vote of seven in favor, zero opposed 9. ADJOURN COUNCIL ACTION: Vice President Garrett moved to adjourn the meeting and Councilor Suarez seconded the motion. The motion was approved by a vote of seven in favor, zero opposed. The next regular Town Council meeting is scheduled for Monday October 2, 2017 @ 7:00 PM in the new Zionsville Town Hall Council Chambers (Please note that the September 18, 2017 Zionsville Town Meeting has been cancelled).
