ZIONSVILLE TOWN COUNCIL MEETING MEMORANDA FOR Monday, December 18, 2017 at 7:30 AM Zionsville Town Hall Council Chamber 1100 West Oak Street Date of Preparation: December 21, 2017 Members Present: Josh Garrett, President; Bryan Traylor, Vice-President; Elizabeth Hopper, Jason Plunkett, Kevin Spees, Susana Suarez Members Absent: Tom Schuler Also Present: Tim Haak, Mayor; Ed Mitro, Deputy Mayor; Heather Willey, Town Attorney; Lisa Pendleton, Chief Deputy Director of Finance & Records and Town Department Staff 1. OPENING A. Call meeting to order B. Pledge of Allegiance 2. APPROVAL OF THE MEMORANDUM OF THE December 4, 2017 REGULAR MEETING (copy posted). COUNCIL ACTION: Councilor Suarez moved to approve the Memoranda of the December 4, 2017 Town Council Meeting. Councilor Hopper seconded the motion. The Memoranda of the December 4, 2017 meeting was approved by a vote of five in favor, zero opposed. 3. REQUEST TO SPEAK There were no requests to speak. 4. OLD BUSINESS A. Consideration of an Ordinance to Establish the Town of Zionsville, Indiana, as a Broadband Ready Community (SECOND READING). ORDINANCE #2017-16 Deputy Mayor Mitro briefly reviewed Ordinance #2017-16. COUNCIL ACTION: President Garrett moved to adopt Ordinance #2017-16 on final reading. Vice-President Traylor seconded the motion. Ordinance #2017-16 was adopted on final reading by a vote of five in favor, zero opposed. Councilor Spees joined the meeting at this time. B. Consideration of a Zoning Ordinance amendment related to the calculation of lot coverage in the Urban Residential Zoning Districts (SECOND READING). ORDINANCE #2017-17 Deputy Mayor Mitro briefly reviewed Ordinance #2017-17, stating that it came to the Council with a favorable recommendation from the Plan Commission. COUNCIL ACTION: Vice-President Traylor moved to adopt Ordinance #2017-17 on final reading. Councilor Spees seconded the motion. Ordinance #2017-17 was adopted on final reading by a vote of six in favor, zero opposed. C. Consideration of a Zone Map Change Ordinance to rezone 3.8 acres from the (B-1) Urban Neighborhood Business District, (R-SF-2) Single-Family Residential District, and (MRO) Michigan Road Overlay District, to the (B-O) Office Business Zoning classification to provide for a Memory Care Facility (SECOND READING). ORDINANCE #2017-18 Deputy Mayor Mitro briefly reviewed Ordinance #2017-18 stating that it came to the Council with a favorable recommendation from the Plan Commission. Mr. Mitro and Planning and Economic Development Director Wayne DeLong answered questions from the Council. COUNCIL ACTION: Councilor Spees moved to adopt Ordinance #2017-18 on final reading. Councilor Plunkett seconded the motion. Ordinance #2017-18 was adopted on final reading by a vote of six in favor, zero opposed. 5. NEW BUSINESS A. Consideration of an Ordinance amending the 2018 Budget for the Town of Zionsville (amendment to the Police Fund tax rate) (FIRST READING) ORDINANCE #2017-20 Mark Adam of Crowe Horwath reviewed Ordinance #2017-20, explaining the amendment was necessary to correct the AV on the Police Fund on the originally adopted budget. He explained this was a clerical fix and not a tax increase. Mr. Adam answered questions from the Council. Deputy Mayor Mitro also addressed questions from the Council. COUNCIL ACTION: Councilor Spees moved to adopt Ordinance #2017-20 on first reading. Councilor Suarez seconded the motion. The motion passed with a vote of six in favor, zero opposed. Vice-President Traylor moved to suspend the rules and consider Ordinance for adoption. Councilor Suarez seconded the motion. The motion passed with a vote of six in favor, zero opposed. Councilor Hopper moved to adopt Ordinance #2017-20 on final reading. Councilor Spees seconded the motion. Ordinance #2017-20 was adopted on final reading by a vote of six in favor, zero opposed. B. Consideration of an Ordinance to amend the Town Hall Improvement Fund Ordinance #2004-04 (FIRST READING). ORDINANCE #2017-19 Deputy Mayor Mitro reviewed Ordinance #2017-19, giving an overview of the original Ordinance #2004-04 and explaining Ordinance #2017-19 was an amendment to the Ordinance originally adopted in 2004. He explained the amended Ordinance would allow flexibility of use of existing revenues in the fund, rental payments, room sponsorships and sale of the Old Town Hall out lots for improvements and expenses for the new Town Hall, including lease payments. Mr. Mitro answered questions from the Council. COUNCIL ACTION: Vice-President Traylor moved to introduce Ordinance # 2017-19 on first reading. Councilor Spees seconded the motion. The motion passed with a vote of six in favor, zero opposed. Ordinance 2017-19 was introduced on first reading. No further action taken. 6. OTHER MATTERS There were no other matters to discuss. 7. ADJOURN COUNCIL ACTION: Councilor Hopper moved to adjourn the meeting. Councilor Suarez seconded the motion. The motion was approved by a vote of six in favor, zero opposed. The next regular Town Council meeting is scheduled for Wednesday January 3, 2017 @ 7:00 PM in the Zionsville Town Hall Council Chambers.
