ZIONSVILLE TOWN COUNCIL MEETING MEMORANDA FOR Monday August 06, 2018 at 7:00 PM Zionsville Town Hall Council Chamber 1100 West Oak Street Date of Preparation: August 7, 2018 Members Present: Josh Garrett, President; Bryan Traylor, Vice-President; Jason Plunkett, Tom Schuler, Kevin Spees, Elizabeth Hopper, and Susana Suarez Members Absent: None Also Present: Tim Haak, Mayor; Ed Mitro, Deputy Mayor; Heather Willey, Town Attorney; Amy Lacy, Director of Finance & Records; Officer Josh Chapman and Town Department Staff. 1. OPENING A. Call meeting to order B. Pledge of Allegiance 2. APPROVAL OF THE MEMORANDUM OF THE JULY 02, 2018 REGULAR MEETING (copy posted). COUNCIL ACTION: Councilor Spees moved to approve the Memoranda of the July 2, 2018 Town Council Meeting. Councilor Plunkett seconded the motion. The Memoranda of the July 2, 2018 meeting was approved by a vote of five in favor, zero opposed. 3. DEPARTMENTAL JULY MONTHLY REPORTS – Reports are submitted by the Town Management staff for Council review and posted on the Town website (www.zionsville-in.gov). 4. PRESENTATION BY POLICE CHIEF ROBERT KNOX and MAYOR TIM HAAK – Honoring Robert Musgrave on 40 years of service with the Zionsville Police Department. Chief Knox shared a brief history of Captain Musgrave’s time with the Zionsville Police Department, highlighting his many achievements throughout the years. Mayor Haak expressed his gratitude for Captain Musgrave’s many contributions and his dedication to the Town. Chief Knox concluded the ceremony by presenting Captain Musgrave with a plaque commemorating his 40 years of service to the Town. Captain Musgrave thanked Mayor Haak, Chief Knox, the Town Council and the citizens of Zionsville. 5. REQUEST TO SPEAK There were no requests to speak. 6. OLD BUSINESS - None 7. NEW BUSINESS A. Consideration of a Zone Map Change Ordinance to rezone approximately 14.56 acres from the Urban (B-2) Business Zoning District to the Urban Residential (R-MF-2) Multi-Family Zoning Classification (recommendation of approval from the Zionsville Plan Commission). ORDINANCE #2018-16 Director of Planning and Economic Development Wayne DeLong briefly reviewed Ordinance #2018-16, stating that it came to the Council with a favorable recommendation from the Zionsville Plan Commission. Discussion followed. Director DeLong answered questions from the Council. Attorney Jason McNeil of Ice Miller spoke on behalf of the petitioner, requesting a continuance on the matter until the September 4, 2018 regular Town Council meeting. He answered questions from the Council. COUNCIL ACTION: Councilor Schuler moved to continue the consideration of Ordinance #2018-16. Councilor Hopper seconded the motion. Resolution #2018-16 was continued to the September 4, 2018 Town Council meeting by a vote of seven in favor, zero opposed.  B. Consideration of a Zone Map Change Ordinance to rezone approximately 18.054 acres from the Urban (SU-7) Special Use Zoning District to the Urban Residential (R-SF-2) Single-Family Zoning Classification (recommendation of approval from the Zionsville Plan Commission). ORDINANCE #2018-17 Director of Planning and Economic Development Wayne DeLong briefly reviewed Ordinance #2018-17, affirming that it came before the Council with a unanimous favorable recommendation from the Plan Commission. He answered questions from the Council. COUNCIL ACTION: Councilor Suarez moved to adopt Ordinance #2018-17 on final reading. Councilor Schuler seconded the motion. Ordinance #2018-17 was adopted on final reading by a vote of seven in favor, zero opposed. C. Consideration of a Resolution of the Town Council of the Town of Zionsville, Indiana Authorizing Investments. RESOLUTION #2018-13 Director of Finance and Records Amy Lacy explained that Resolution #2018-13 was a modification to existing Investment Resolution #2016-15 in order to comply with 2018 legislation changes affecting the expiration period of a certain section of the policy. She answered questions from the Council. COUNCIL ACTION: President Garrett moved to approve Resolution #2018-13. Councilor Schuler seconded the motion. Resolution #2018-13 was approved by a vote of seven in favor, zero opposed. D. Consideration of an Ordinance adopting Boone County Code Sections Relating to Animal Control (FIRST READING). ORDINANCE #2018-18 Deputy Mayor Mitro reviewed Ordinance #2018-18, explaining that a position had been created for a Boone County Animal Control Officer and in order for that Officer to carry out the duties of the position in the municipality of Zionsville; Zionsville must adopt the Boone County Ordinance relating to Animal Control. He answered questions from the Council, emphasizing that this did not affect the local Animal Control Ordinance currently in place COUNCIL ACTION: Councilor Hopper moved to introduce Ordinance # 2018-18 on first reading. Vice-President Traylor seconded the motion. The motion passed with a vote of seven in favor, zero opposed. Ordinance #2018-18 was introduced on first reading. No further action taken. 8. OTHER MATTERS Zionsville Police Department’s liaison to Special Olympics Indiana, Officer Josh Chapman, gave a presentation highlighting the accomplishments of the organization and the funds raised to benefit Special Olympians, not just locally, but internationally. He expressed his appreciation for the support and involvement of Chief Knox, Mayor Haak and the Town Council, presenting them each with a small gift from Special Olympics of Indiana and a photobook of the Zionsville Police Department’s endeavors with Special Olympics. President Garrett stated that current Town Prosecutor Lori Schein had resigned. President Garrett made a motion to appoint eleven-year veteran Boone County Deputy Prosecutor Craig Olsinski as Zionsville Town Prosecutor to take Ms. Schein’s place. Councilor Schuler seconded the motion. Craig Olsinski was appointed Zionsville Town Prosecutor by a vote of seven in favor, zero opposed. 9. APPROVAL OF CLAIMS COUNCIL ACTION: Councilor Spees moved to approve claims as presented. Councilor Suarez seconded the motion. Claims were approved by a vote of seven in favor, zero opposed. 10. ADJOURN COUNCIL ACTION: President Garrett moved to adjourn the meeting and Councilor Hopper seconded the motion. The motion was approved by a vote of seven in favor, zero opposed.
