ZIONSVILLE TOWN COUNCIL MEETING MEMORANDA FOR Monday, March 04, 2019 at 7:00 PM Zionsville Town Hall Council Chamber 1100 West Oak Street Date of Preparation: March 7, 2019 Members Present: Josh Garrett, President; Bryan Traylor, Vice-President; Elizabeth Hopper, and Kevin Spees Members Absent: Jason Plunkett, Susana Suarez and Tom Schuler Also Present: Tim Haak, Mayor; Ed Mitro, Deputy Mayor; Heather Willey, Town Attorney; Amy Lacy, Director of Finance & Records; Mark Adam; Crowe; and Town Department Staff. 1. OPENING A. Call meeting to order B. Pledge of Allegiance 2. APPROVAL OF THE MEMORANDUM OF THE February 19, 2019 REGULAR MEETING (copy posted). COUNCIL ACTION: President Garrett moved to approve the Memoranda of the February 19, 2019 Town Council Meeting. Councilor Spees seconded the motion. The Memoranda of the February 19, 2019 meeting was approved by a vote of four in favor, zero opposed. 3. DEPARTMENTAL YEAR-END REPORTS AND PRESENTATION – Reports are submitted by the Town Management staff for Council review and posted on the Town website (www.zionsville-in.gov). Presentations by Management Staff of Year-end Reports. Each department head or representative gave a brief presentation, sharing highlights from their year-end report. 4. REQUEST TO SPEAK Zionsville resident Robert Betz spoke regarding the adverse health effects that 5G small cell towers and electromagnetic fields could have on the Village population. He distributed an informative letter to each Councilor and a report from the Environmental Health Trust. 5. OLD BUSINESS – NONE 6. NEW BUSINESS A. Consideration of an Ordinance to amend the 2019 Salary Ordinance for the Town of Zionsville (FIRST READING). ORDINANCE #2019-03 Deputy Mayor Mitro introduced the Ordinance, stating that the amendment pertained to the Stormwater Assistant Superintendent position. Street and Stormwater Superintendent Lance Lantz explained that the position is unique, highly specialized, very technical and skilled and that the current salary is inadequate. He also stated he had lost the former Stormwater Assistant Superintendent as well as new two candidates due to the salary and currently has a candidate with experience, skills and impeccable credentials but the current salary is not sufficient to secure the individual’s acceptance of the position. He answered questions from the Council. President Garrett asked Superintendent Lance if there was a time crunch and if voting on the Ordinance tonight would be helpful. Superintendent Lance stated it would be very helpful. . COUNCIL ACTION: President Garrett moved to adopt Ordinance #2019-03 on first reading and Vice-President Traylor seconded the motion. The motion passed with a vote of four in favor, zero opposed.  President Garrett moved to suspend the rules and Councilor Hopper seconded the motion. The motion passed with a vote of four in favor, zero opposed. Councilor Spees moved to adopt Ordinance #2019-03 on first reading and President Garrett seconded the motion. Ordinance #2019-03 was adopted by a vote of four in favor, zero opposed. B. Consideration of an Ordinance to Re-Establish the Cumulative Capital Development Fund (FIRST READING). ORDINANCE #2019-04 Deputy Mayor Mitro reviewed the Ordinance, stating that Items B and C were related and that they would both re- establish the maximum rate in order to capture the highest amount of tax allowed for those funds. In response to Vice- President Traylor’s question Deputy Mayor Mitro explained the CCD fund and its allowed uses. COUNCIL ACTION: Councilor Spees moved to introduce Ordinance # 2019-04 on first reading. Vice-President Traylor seconded the motion. The motion passed with a vote of four in favor, zero opposed. Ordinance 2019-04 was introduced on first reading. No further action taken. C. Consideration of an Ordinance to Re-Establish the Cumulative Firefighting Building Equipment Fund (FIRST READING). ORDINANCE #2019-05 Deputy Mayor Mitro reviewed the Ordinance, again explaining that it would re-establish the maximum rate. He explained uses of the Cumulative Firefighting Building Equipment Fund and answered questions from the Council. COUNCIL ACTION: President Garrett moved to introduce Ordinance # 2019-05 on first reading. Vice-President Traylor seconded the motion. The motion passed with a vote of four in favor, zero opposed. Ordinance 2019-05 was introduced on first reading. No further action taken. D. Consideration of an Ordinance Amending and Restating Title I of the Town of Zionsville Code of Ordinances – Chapter 10 (FIRST READING). ORDINANCE #2019-06 Attorney Heather Willey presented the Ordinance, stating that the Zionsville Code of Ordinances has not been comprehensively updated since before the two reorganizations. She explained it would be reviewed and updated chapter by chapter over the next several months in order to ensure that definitions, terminology and terms adopted in the reorganizations were reflected in the Code. COUNCIL ACTION: Councilor Spees moved to introduce Ordinance # 2019-06 on first reading. President Garrett seconded the motion. The motion passed with a vote of four in favor, zero opposed. Ordinance 2019-06 was introduced on first reading. No further action taken. E. Consideration of an Ordinance Amending and Restating Title III of the Town of Zionsville Code of Ordinances – Chapter 30 (FIRST READING). ORDINANCE #2019-07 Attorney Willey presented the Ordinance, reiterating that Title III, Chapter 30 would be updated as well to reflect current terms, definitions, language, Council Districts, as well as ensuring that codes are up to date with current Indiana State Statute. COUNCIL ACTION: Councilor Hopper moved to introduce Ordinance # 2019-07 on first reading. Vice-President Traylor seconded the motion. The motion passed with a vote of four in favor, zero opposed. Ordinance 2019-07 was introduced on first reading. No further action taken. 7. OTHER MATTERS Mayor Haak introduced new Town Judge Samantha Spencer, sharing her background and experience with the Council and welcoming her to the Town of Zionsville. 8. APPROVAL OF CLAIMS COUNCIL ACTION: President Garrett moved to approve claims as presented. Councilor Spees seconded the motion. Claims were approved by a vote of four in favor, zero opposed. 9. ADJOURN COUNCIL ACTION: President Garrett moved to adjourn the meeting. Councilor Hopper seconded the motion. The motion was approved by a vote of four in favor, zero opposed.
