ZIONSVILLE TOWN COUNCIL MEETING MEMORANDA FOR Monday June 3, 2019 at 7:00 PM Zionsville Town Hall Council Chamber 1100 West Oak Street Date of Preparation: June 4, 2019 Members Present: Josh Garrett, President; Bryan Traylor, Vice-President; Tom Schuler, Kevin Spees, Elizabeth Hopper, and Susana Suarez, Jason Plunkett Also Present: Tim Haak, Mayor; Ed Mitro, Deputy Mayor; Heather Willey, Town Attorney; Cindy Poore, Chief Deputy Director of Finance & Records and Town Department Staff. 1. OPENING A. Call meeting to order B. Pledge of Allegiance 2. APPROVAL OF THE MEMORANDUM OF THE May 6, 2019 REGULAR MEETING (copy posted). COUNCIL ACTION:  Councilor Spees moved to approve the Memoranda of the May 6, 2019 Town Council Meeting.  Councilor Suarez seconded the motion.  The Memoranda of the May 6, 2019 meeting was approved by a vote of 7 in favor, 0 opposed. 3. DEPARTMENTAL APRIL MONTHLY REPORTS Reports are submitted by the Town Management staff for Council review and posted on the Town website (www.zionsville-in.gov). 4. PRESENTATION OF UNIT AND DEPARTMENTAL CITATIONS – Rob Knox, Chief of Police Chief Knox presented Officer Josh Chapman a plaque for his service to the Community of Zionsville over the last 6 years. Officer Chapman will be leaving ZPD for a position with Homeland Security. 5. REQUEST TO SPEAK President Garrett said that we would have 5 speakers at 3 minutes each. There were more requests to speak that were opposed to Sycamore Flats, than those in favor. Three speakers in opposition were chosen to speak & two in favor. (Chief Dep. Director Poore chose three speakers from the “opposition” pile and 2 from the “in favor” pile.) Opposed: Mark Zelonis, Heather Lusk & Marcia Angstadt. Mrs Angstadt ceded her spot to Shari Jenkins In Favor: David Franz & Larry Jones 6. OLD BUSINESS – A. Consideration of an Ordinance (Zone Map Change) to rezone approximately 4.329 acres from the (VBD) Village Business District to the (PUD) Planned Unit Development Zoning Classification (continued from the May 6, 2019 Zionsville Town Council Meeting). ORDINANCE #2019-11  Attorney Matt Price answered questions from the Council. Lengthy discussion followed.  Boone County Commissioner – Tom Santelli was asked by Councilor Suarez to give his view of the project on a County level.  Prior to voting, the Councilors gave a statement regarding the contention surrounding this project and how it has impacted them and the community.  COUNCIL ACTION:  Councilor Suarez moved to continue the process prior to voting for Ordinance #2019-11.  Councilor Hopper seconded the motion. Councilor Suarez believes there is more dialog that is needed prior to taking a vote. President Garrett requested a roll call vote in favor of a continuation.  Councilor Schuler: Yea  Councilor Hopper: Yea  Councilor Suarez: Yea  Vice-President Traylor: Nay  President Garrett: Nay  Councilor Spees: Nay  Councilor Plunkett: Nay  The motion to continue was denied by a vote of 3 in favor, 4 opposed. COUNCIL ACTION:  Councilor Spees made a motion to deny Ordinance #2019-11.  President Garrett seconded the motion. President Garrett requested a roll call vote. President Garrett also clarified that voting “yea” is voting in opposition to Ordinance #2019-11.  Councilor Schuler: Nay  Councilor Hopper: Nay  Councilor Suarez: Nay  Vice-President Traylor: Yea  President Garrett: Yea  Councilor Spees: Yea  Councilor Plunkett: Yea  The motion to deny Ordinance #2019-11 was passed by a vote of 4 in favor, 3 opposed. 7. NEW BUSINESS A. Consideration of an Ordinance vacating a portion of Andrade Drive right-of-way. (FIRST READING) ORDINANCE #2019-13 - Deputy Mayor Mitro introduced the proposed ordinance and the petitioner’s representative, Andrew West discussed it with the Council. With proof of Publication, President Garrett asked to open the Public Hearing for comment. There was none. President Garrett closed the Public Hearing. COUNCIL ACTION:  Councilor Hopper made a motion to introduce Ordinance #2019-13.  Councilor Schuler seconded the motion.  Motion do introduce Ordinance #2019-13 on first reading passes with a vote of 7 in favor 0 opposed. B. Consideration of an Ordinance amending the 2019 Salary Ordinance for the Town of Zionsville (FIRST READING) ORDINANCE #2019-14 - Barry Cook briefly outlined the proposal. COUNCIL ACTION:  President Garrett made a motion to introduce Ordinance #2019-14.  Vice President Traylor seconded the motion.  Motion to introduce Ordinance #2019-14 on first reading passes with a vote of 7 in favor 0 oppose. COUNCIL ACTION:  President Garrett made a motion to suspend the rules, to allow adoption on first reading.  Vice President Traylor seconded the motion.  Motion to suspend the rules passes with a vote of 7 in favor 0 oppose.  Vice President Traylor made a motion to adopt Ordinance #2019-14 on first reading.  Councilor Suarez seconded the motion.  Motion to approve Ordinance #2019-14 on first reading passes with a vote of 7 in favor 0 oppose.  C. Consideration of a Re-Appropriation Resolution reallocating $31,500.00 in the Wastewater Department from the Chief Operator position to the Plant and Lift Station Maintenance position. RESOLUTION #2019-06 - Barry Cook COUNCIL ACTION:  Councilor Spees made a motion to approve Resolution #2019-06.  Councilor Suarez seconded the motion.  Motion to approve Resolution #2019-06 passes with a vote of 7 in favor 0 oppose. D. Consideration of an Additional Appropriation Resolution (G.O. Refunding Bond, Series 2017) (PUBLIC HEARING). RESOLUTION #2019-07 - Deputy Mayor Mitro outlined the request. With proof of Publication, President Garrett asked to open the Public Hearing for comment. There was none. President Garrett closed the Public Hearing. COUNCIL ACTION:  Councilor Suarez made a motion to approve Resolution #2019-07.  Councilor Spees seconded the motion.  Motion to approve Resolution #2019-07 passes with a vote of 7 in favor 0 oppose. 8. OTHER MATTERS There were no other matters to discuss. 9. APPROVAL OF CLAIMS COUNCIL ACTION:  President Garrett moved to approve claims as presented.  Councilor Suarez seconded the motion.  Claims were approved by a vote of 7 in favor, 0 opposed. 10. ADJOURN COUNCIL ACTION:  President Garrett moved to adjourn the meeting  Councilor Hopper seconded the motion.  Motion to adjourn was approved by a vote of 7 in favor, 0 opposed. The next regular Town Council meeting is scheduled for Monday June 17, 2019 @ 7:30 AM in the Zionsville Town Hall Council Chamber.
