16866 CITY COUNCIL PROCEEDINGS City Council Chambers, 123 South Lincoln Street, Municipal Building, Aberdeen, South Dakota, January 17, 2017, at 5:30 p.m., regular meeting of the Board of City Council Members, Mayor Mike Levsen presiding. Present at roll call were City Councilors David Bunsness, Todd Campbell, Alan Johnson, Dennis “Mike” Olson, Rob Ronayne by teleconference call, Clint Rux, and Jennifer Slaight-Hansen. City Councilor Mark Remily was absent. City Staff present were Lynn Lander, Ron Wager, Robin Bobzien, Brett Bill, Karl Alberts, and Tanner Jondahl. Mayor Levsen led the Pledge of Allegiance. City Councilor Mark Remily arrived at 5:31 p.m. MINUTES Rux moved, Ronayne seconded to approve the minutes of January 9, 2017, as circulated. Upon roll call, all voting aye, motion carried. OPEN FORUM – No one was present. CONSENT CALENDAR Slaight-Hansen moved, Remily seconded to approve the following items on the consent calendar: SET BID DATE – of January 31, 2017 at 2:00 p.m. for Merton Street Holding Pond Project (SS-2017-2). LOTTERY NOTICES – Lincoln Elementary PTA; NSU Veterans Club; Presentation College Men’s Soccer – receive and place on file. LICENSES – Taxi Cab/Motor Bus Driver – Casey Walker; Taxi Cab Driver – Monica (Amberg) Wolff. Upon roll call, all voting aye, motion carried. NEW BUSINESS ORDINANCE NO. 17-01-02 Ordinance No. 17-01-02 amending City Code Chapter 58 – Vehicles For Hire - to repeal the regulation of delivery vehicles for hire was presented. Bunsness moved, Rux seconded to approve first reading of Ordinance No. 17-01-02. Upon roll call, all voting aye, motion carried. RESOLUTION NO. 17-01-01R Johnson moved, Bunsness seconded to approve Resolution No 17-01-01R to vacate public right-of-way for the 16’ wide public alley right-of-way commencing at the west side of Kline Street south public right-of-way and continuing 180’ west to point of termination within Block 65, Hagerty & Lloyd’s Addition (324 Railroad Ave., SE and 317 First Ave., SE). Upon roll call, all voting aye, motion carried. RESOLUTION NO. 17-01-02R Remily moved, Rux seconded to approve Resolution No. 17-01-02R to vacate public right-of-way for the 16’ wide public alley right-of-way commencing at the south side of Third Ave., SE public right-of-way and continuing south 300’ to point of termination in Block 34, Roches East Side Addition (3000 Third Ave., SE). Upon roll call, all voting aye, motion carried. HEARING ON TRANSFER OF MALT BEVERAGE LICENSE This being the time and place set for a hearing on an application for the transfer of a Malt Beverage License with Video Lottery for ASC Inc. from 23 – 6th Ave., SW (Inactive) to 1923 – 6th Ave., SE – Suite #103, recommendations received were to approve contingent upon an inspection by the Fire Department, Remily moved, Slaight-Hansen seconded to approve the Retail On-Off Sale Malt Beverage License with Video Lottery for ASC Inc. from 23 – 6th Ave., SW to Heartland Players Club #3 at 1923 – 6th Ave., SE – Suite #103  16867 contingent upon a location inspection by the Fire Department. Upon roll call, all voting aye, motion carried. CONSULTANT FOR PEG ACCESS NEEDS ANALYSIS FOR CABLE TV Remily moved, Ronayne seconded to retain the consulting firm of The Buske Group to conduct a public, educational, and government (PEG) access needs analysis for use in conjunction with cable television franchise renewal negotiations with Midcontinent Communications and Northern Valley Communications, to authorize the City Manager to accept the proposal, to designate the City Attorney as contact person for the City, and to supplement the City Attorney’s 2017 Budget by $12,390 to cover anticipated professional service costs of the PEG access needs analysis.
