16940 CITY COUNCIL PROCEEDINGS City Council Chambers, 123 South Lincoln Street, Municipal Building, Aberdeen, South Dakota, May 22, 2017, at 5:30 p.m., regular meeting of the Board of City Council Members, Mayor Mike Levsen presiding. Present at roll call were City Councilors David Bunsness, Todd Campbell, Alan Johnson, Dennis “Mike” Olson, Mark Remily, Rob Ronayne, Clint Rux, and Jennifer Slaight-Hansen. City Staff present were Lynn Lander, Ron Wager, Robin Bobzien, Brett Bill, Karl Alberts, Dave McNeil, and Peggi Badten. Mayor Levsen led the Pledge of Allegiance. MINUTES Bunsness moved, Rux seconded to approve the minutes of May 15, 2017, as circulated. All voting aye, motion carried. OPEN FORUM – No one was present. CONSENT CALENDAR Campbell moved, Ronayne seconded to approve the following items on the consent calendar: RESCHEDULE HEARING – from May 22, 2017 at 5:30 p.m. to June 26, 2017 at 5:30 p.m. for a petition to rezone from (C-1) District to (C-1)/(R-4) Districts property described as Lot 6, Block 15, Sullivan & Easton Addition (801 North First Street). PETITION OF VOLUNTARY ANNEXATION – for Lot 16A, Engel’s Replat of a portion of Lot 4, Culbert’s Subdivision (1851 Eisenhower Circle) – refer to City Attorney, City Engineer, and Planning/Zoning Director for review and recommendations. PLATS – 1) Centennial Commons Addition to the City of Aberdeen in the NW ¼, SE ¼ of Section 17, T123N, R63W of the 5th P.M., Brown County, South Dakota (3324 Milwaukee Avenue, NE) with stipulation that a developer’s agreement will be approved by the City Council; 2) Lamont Eleventh Addition in the S ½, NE ¼, Section 20, T123N, R63W of the 5th P.M., Brown County, South Dakota (1104 South Melgaard Road South of 10th Avenue, SE). LICENSES – Ambulance Driver – Ashley Wampler; Home Day Care – Alan Frazier; Home Day Care – Jodi May; Residential Building Contractor – Ryan Tschetter dba Dakota Storage Building, LLC; Residential Building Contractor – Jose Dubon; Sidewalk Contractor – Dakota Construction dba Allan Ochsner; Taxi Cab Driver – Dave Weigel. LOTTERY NOTICE – U12 Boys National Soccer Team; Aberdeen Nitro Soccer Team; and Aberdeen Elks Lodge #1046 – receive and place on file. All voting aye, motion carried. NEW BUSINESS HEARING ON SPECIAL ALCOHOL LICENSES This being the time and place set for a hearing on Special One-Day Retail On-Sale Liquor Licenses on June 8th and June 24th for Aberdeen Downtown Association’s Summer Concert Series on South Main Street from 3rd Avenue to 4th Avenue, recommendations to approve were received, Remily moved, Olson seconded to approve the Special One-Day Retail On-Sale Liquor Licenses on June 8th and June 24th for Aberdeen Downtown Association’s Summer Concert Series including Community Event Permits with street closures on South Main Street from 3rd Avenue to 4th Avenue from 9:00 a.m. until midnight and a time extension until midnight for the music. All voting aye, motion carried. COMMUNITY EVENT PERMITS FOR FALLOUT CREATIVE COMMUNITY Johnson moved, Remily seconded to approve the request for Community Event Permits for Fallout Creative Community for the “Art & Bicycle Spectacle” on May 27th, the “Fallout Creative Community/Mayor’s Advisory Board’s ADA Celebration” on July 21st, and the “Fallout Art & Music Festival” on September 8th to be held on 2nd Avenue, SW from 16941 South Main Street to alley including street closures at the location during each event. All voting aye, motion carried. BIDS FOR WATER RECLAMATION DIGESTER CLEANING Bids were received and publicly opened on May 16, 2017 for the Water Reclamation Digester Cleaning Project. A detailed list of the bids is on file at the City Finance Office. Bunsness moved, Johnson seconded to award the Water Reclamation Digester Cleaning Bid to Muddy Septic Service in the amount of $50,750 and authorize the City Manager and City Finance Officer to sign all necessary documents after approval by the City Attorney. All voting aye, motion carried. BIDS FOR UTILITY PIPELINE INSPECTION SYSTEM Bids were received and publicly opened on May 9, 2017 for the Utility Pipeline Inspection System. A detailed list of the bids is on file at the City Finance Office. Rux moved, Remily seconded to award the Utility Pipeline Inspection System Bid to Flexible Pipe Tool in the amount of $64,500 and authorize the City Manager and City Finance Officer to sign all necessary documents after approval by the City Attorney. All voting aye, motion carried. CHANGE ORDER FOR NEW LIBRARY PROJECT Johnson moved, Ronayne seconded to approve of Change Order #4 in the amount of $4,348 for Quest Construction for additional work on the new Library Construction Project. All voting aye, motion carried. BILLS Slaight-Hansen moved, Olson seconded to approve the following audited bills for services, supplies, repairs, and maintenance: Northwestern Energy 13,805.34; Dakota Pump & Control 22,000.00; Morrison Construction 15,576.02; Western Area Power Administration 4,613.13; SD Government Finance Officers 150.00; SD Government Human Resource Association 150.00; Wellmark Blue Cross/Blue Shield 40,000.00; DTC 23,970.00; Cole Papers Inc 329.22; Fleet Services 41.61; Konica Minolta 126.85; Matheson Tri-Gas Inc 90.83; Sanford Health Occupational 3,598.00; SD Dept. of Health 150.00. Upon roll call, all voting aye, motion carried. CITY MANAGER’S REPORT Lynn Lander presented the City Manager’s Report. EXECUTIVE SESSION Ronayne moved, Remily seconded to move into executive session to consult with legal counsel about contractual matters per SDCL §1-25-2(3). Rux moved, Slaight-Hansen seconded to move out of executive session. All voting aye, motion carried. There being no further business, Remily moved, Ronayne seconded that the meeting be adjourned.
