Board of Trustees Minutes November 8, 2021 Meeting called to order at 7:30 p.m. MEMBERS PRESENT: Mayor Dennis Siry, Deputy Mayor Smith, Trustee Whalen, Trustee O’Neill, Trustee Brooks ALSO PRESENT: Village Attorney Bruce Kennedy Chief Bryan Burton Chief Robert Waegerle Clerk/Treasurer Catherine Murdock Assistant to the Mayor Wendy O’Neill Mayor Siry welcomed everyone to the Meeting and invited Chief Burton to conduct the Pledge of Allegiance. Mayor Siry called on Deputy Mayor Smith to share upcoming events, which included: • Nov. 11 Veterans Day Commemoration with the VFW on Village Triangle, at 11:00 a.m. • Nov. 13 Historical Society Dinner at Unqua Corinthian Yacht Club, honoring Ellen McVeety and Andy Powell • Masonic Lodge Pre-Holiday Dinner on Nov. 21st • Field of Honor at the High School and Park Ave. School. Dedicate a flag in honor of a Veteran. • He also reported that the dedication of Jerry Graziano Police and Firefighters Memorial Park was held last Saturday and it was a nice dedication and a long time coming. • He also reported that a Special Election for Proposition No. 1 (Cannabis Law) was held. Voters voiced their support for the Village opting out of the Law which would have allowed the sale and consumption of cannabis in establishments within the Village. Mayor’s Actions: Request to approve the October 25, 2021 Board of Trustees Meeting Minutes MOTION to APPROVE was made by Trustee Whalen and seconded by Deputy Mayor Smith Vote on Motion: Mayor Siry aye Deputy Mayor Smith aye Trustee Whalen aye Trustee Brooks aye Motion Carried: 4 ayes 0 nays 1 abstain (Trustee Brooks) Licenses: Automotive License - New Jacek Fic, On-Track Automotive, LLC, 45H Burch Ave., Amityville MOTION to APPROVE was made by Trustee O’Neill and seconded by Trustee Whalen Vote on Motion: Mayor Siry aye Deputy Mayor Smith aye Trustee Whalen aye Trustee O’Neill aye Motion Carried: 4 ayes 0 nays Automotive License - Renewal James Giambrone, NYS Discount Tire and Auto, 199 County Line Rd., Amityville 1 Board of Trustees Minutes November 8, 2021 The Board discussed with Mr. Giambrone the condition of his car lot. They called for the following stipulations: the driveways must remain free of vehicles and passable, the flags and tires holding them would be removed from the Village property, and he must apply for a Storage of Trailer Permit for the vehicle he is using for storage on the property. MOTION to APPROVE with the above stipulations was made by Trustee O’Neill and seconded by Trustee Whalen Vote on Motion: Mayor Siry aye Deputy Mayor Smith aye Trustee Whalen aye Trustee O’Neill aye Trustee Brooks aye Motion Carried: 5 ayes 0 nays Cabaret License Renewal William Hall, Liam’s Landing, 248 S. Ketcham Ave, Amityville The Trustees asked Mr. Hall to share his plans for securing adequate parking, to which he responded that additional parking would be available at a neighboring property. He produced a copy of an open-ended lease for parking with his neighbor to the south. MOTION to APPROVE with the stipulation that parking accommodations are in place for any large event (bands, parties) was made by Deputy Mayor Smith and seconded by Trustee Whalen. Vote on Motion: Mayor Siry aye Deputy Mayor Smith aye Trustee Whalen aye Trustee O’Neill aye Trustee Brooks aye Motion Carried: 5 ayes 0 nays Daniel Valentino, Amityville Music Hall, 198 Broadway, Amityville The Trustees raised the issue of crowd security, littering and loitering in the parking lot. Mr. Valentino asserted he would stay on top of things. MOTION TO APPROVE with the stipulations that he: 1. addresses all stipulations relating to health and safety violations on the application. 2. provides security staff at both the front and rear entrances and 3. cleans up the rear outdoor area after all events was made by Trustee Whalen and seconded by Trustee O’Neill. Truck Equipment for one tailgate spreader in the amount of $3,365.23 (A5110.240) MOTION to APPROVE was made by Trustee Whalen and seconded by Trustee O’Neill Vote on Motion: Mayor Siry aye Deputy Mayor Smith aye Trustee Whalen aye Trustee O’Neill aye Trustee Brooks aye Motion Carried: 5 ayes 0 nays 4 Board of Trustees Minutes November 8, 2021 With no further agenda items, Mayor Siry then opened the floor to public commentary. Several people addressed the trustees regarding the condition of Avon Lake. Dave Ehlers, 47 W. Lake Dr., Amityville, NY: The resident announced he has 287 signatures on a petition to restore Avon Lake which he said is in a state of disrepair. Little has bene done since the issue was raised with the Village in 2018. Susan Geiger, 57 W. Lake Dr., Amityville, NY stated the bulkhead needs repair, the dam needs replacing and the parrot feather is out of control. Tree roots are exposed and the road is puddling, making run off a potential problem. Mayor Siry reminded the residents that he had met with residents during a walk through with the DEC and some attempts were made to remedy their concerns but the DEC is involved. John Giglio, 47 W. Lake Dr., Amityville, NY said there is ivy, dead trees, poison ivy and the parrot feather needs to be addressed as well as curbing. Tom White, 26 E. Lake Dr., Amitvville, NY said he believes the lake is dying, water levels and oxygenation are a concern, as well as maintenance. He also offered his help as a volunteer. Katie Campbell, 20 E. Lake Dr., Amityville, NY expressed concern that people are out around the lake at 1-2 a.m., smoking pot and playing loud music. Residents also were concerned about the absence of or reduction in turtles, baby ducks and fish. Michael Parente, 45 Sterling Pl, Amityville, NY expressed support for the residents’ petition and suggested there be no fishing in the lake. Karen White, 26 E. Lake Dr., Amityville, NY requested that the Board approve a holiday sleigh display with a lighted tree, to float in Avon Lake. The Trustees asked for an email to approve it. Mayor Siry reminded that parrot feather but there is a window of time it can be done and the work must start further to the north in the Delano Preserve where the water begins to flow into the lake. The Trustees stated they would develop and provide a timeline for improvements. On another matter, Matt Nicholas, 25 Nicoll Ave, Amityville, NY asked the Board why the voting hours were so limited for the Special Election. Trustee O’Neill shared that the limited hours were a result of having the General Election on the same day. Only a limited number of poll workers were available and no scanners were available from the Board of Elections.
